THE CONSTRUCTIOI�� OF NEW SIDEWALKS
IN THE PL�CE OF S�iID SIDEWALIiS
SO CONDEI�NED AP1D REP�OVED
WHEREhS, the City Council of the City of Cape Girardeau,
P�issouri, by and with the advice of the city engineer, has
determined that the existing sidewalks and curbs on both sides
of North P�ain Street from Themis Streetto Independence Street
are defective , and should be condemned and removed and new
sidewalks and curbs constructed in place of the sidewalks and
curbs so condemned and removed ; and
WH�,R�kS, plans and specifications for the removal of
said defective sidewalks and curbs and the construction of
new sidewalks and curbs have been prepared by the city engineer,
and approved by the City Council, and are on file with the
City Clerk; NOGI TH�REFORE
BE IT RESOLVED by the City Council of the City of Cape
Girardeau, I�iissouri as foilows :
1. That the existing sidewal'xs and curbs on both sides
of idorth T�Iain Street from Themis Street to Independence Street
be, and the same hereby are, condemned and ordered removed , and
new sidewalks and curbs in place of said sidewalks and curbs
so condemned and so rer�oved be constructed in place of said
sidewalks and curbs so condemned and removed .
2. That the property owners whose property abuts on said
sidewalks and curbs so condemned and so ordered removed, be
notified by the City Clerk of the passage of this resolution;
and that said property owners be advised in such notice that
plans and specifications for the removal of said defective
sidewalks and curbs , and the construction of new sidewalks and
curbs , are on file in the office of the Cit�r Clerk; and that
said property owners be further advised in said notice to remove
said defective sidewalks and curbs and construct new sidewalks
and curbs in accordance with said plans and specifications within
a reasonable time after receipt of such notice ; and that said
property owners be furtner advised in said notice that if said
defective sidewalks anci curbs are not removed and new sidewalks
and curbs constructed in accordance with said plans and speci-
fications in a reasonable time after receipt of said notice
that the City Counci� will, by ordinarice, provide ior the re-
rnoval of said defective sidewalks and curbs and the construction
of new sidewalks and curbs in accordance with the applicable
statutes of the atate of I�Iissouri at the cost of the abutting
property owners .
