WHEREAS, the Government has, under authority of Public
Law 516, 81st Congress, approved 17 May 1950, undertaken the
development of a flood cantrol project known as Cape Girardeau
Flood Protection Project, Cape Girardeau, Missouri, including
certain sewer alterations in Broadway from Lorimier Street east
to the Mississippi River, (hereinafter called the '�Project") ; and
WHEREAS, on several occasions since the sewer altera-
tions w�re completed (July 1956} , precipitation from storms
of less than design intensity flowing east on the surface of
Broadway west of Loriunier Street has been partially bypassing
the curb inlet catch basins installed in Broadway at Lorimier
Street and has been flowing down the paved surface of Broadway
into the Mississippi Ri.ver, and
WHEREAS, when the floodwall to be constructed as part
of the flood protection is constructed on the riverfront at the
intersection of Broadway, such excess run-off would be impounded
behind the floodwall, and
WHEREAS, it is �he responsibility of the Government to
construct such remedial measures as are necessary to correct
this condition, and
WHER�AS, the Government has prepared preliminary plans
for the construction of an open-grated type catch basin across
Broadway east of the intersection of Lorisnier Street to correct
�his condition, the est3.mated cost of which is $3,100, and
WHEREAS, the City has prepared plans and specifieations
for the construction of a storm sewer to collect the surface
flow in Broadway west of Lori.mier Street and connection of this
sewer to the existing sewer cons�ructed in Broadway by the
Government, and
WHER�AS, the construction o� this storm s�wer will
eliminate the necessity for installing a catch basin across
Broadway as most of the storm flow in Broadway will be
intercepted west of Lorimier Street and will enter the sewer
in Broadway constructed by the Government, and

WHEIiEAS, it is in �he interest of the City for the
safety of vehicles usi.ng the street and pedestrians crossing
the street to eliuninate the construction of the open-grated
type basin across Broadway, and
WHEREAS, the City has advertised for bids for the
construction of this storm sewer on two different occasions
and has not received a bid within the funds that are available
for construction, and
WiiEREAS, the City is agreeable to advertise again for
bids for the storm sewer, provided the Government will pay the
estimated cost ($3,100) of the catch basin across Broadway
that would no longer be necessary, and
WHEREAS, the Government has presented the City a
contract to be dated November 7, 1957, by the terms of which
the Government agrees to pay the City $3,100 upon the completion
of the construction of the storm sewer as hereinbefore described.
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
1. That the Mayor of the City of Cape Girardeau,
Missouri, be, and he hereby is, authorized for and on behalf
of the City of Cape Girardeau, Missouri, to execute and deliver
to the United States of America said contract, which is
described as Contract No. DA-23-065-CIVENG-58-149.
