RESOLUTION AP�'ROVING A�PLICATION OF THE PROVISIONS OF SECTION 23
OF THE UNITED STATE.S HOUSING ACT OF 1937, AS AMENDED, TO LOCALITY

VSHEREAS, under the provisions of Secti,on 23 of the United
States: Housing Act of 1937, as amended, th.e Department of Housing
and Urban Dedelopment is authorized to provide financial assistance
to local �ublic hausing agencies in providing lo�nr-rent housing
units by leasi;ng d�elling units in existi.ng or new privately-owned
s tructures; and
W�iEREA5, said Section 23 provides that the provisions thereof
shall not apply to an�r locality unless the governing body of the
locality has: b�r resolution approved th.e application of such
provisions to suclz locality.
NO�i, THEREFORE, BE IT RESOLVED $Y THE CITY COUNCIL OF THE
CITY OF CAP� GIRARDEAU, MIS50URI, AS FOLLOWS:
l. The application of the provisions of Section 23 of the
United States Housing Act ot 1937, as amended, to the City of Cape
Girardeau, Missouri, is approved subject to tIze following terms
and conditions:
(a) Auth.orization is limited to fifty (50) units of
neHr or rehabi.li.tated lo�nr-rent housing units .
(b) No high xise and no large multiple unit projects
will be authorized.
(c) No unit construction larger than 4-family capacity
shall be authorized. Units shall be grouped so tIzat not more than
four f amily units are located upon one site. Sites shall be
chosen so as to provide dispersion of units .
(d) All units authorized will be distributed 40� to
the elderly and handicapped and 60� to low %ncome residents .
(e) In order to insure that the lo�nr-rent housing
authorized under this agreement is made availab le to tY�.e Citizeris
o� this City, and shall not act as an inducement to non-residents
moving into th.i�s City, the Local Authoxity agrees to establish a
residency requirement of twelve (12) months as a minimum standard
for eligib%lity. Suclz residency requirement sYiall require that an

applicant for lotnr-rent iiousing be a re�i:dent of tY�.e City of Cape
Girardeau, Mi,s�ouri, for at least tw�elve (12) montfi:s prior to the
time an application for low-xent housing is made.
(f� All units will conform with the planning and zoning
ordinances of the City and �hall be in keeping rnritlz the current
building and economic status of tFie neighborhoods in which they
shall be placed.
(g) Strict regulations for the maintenance and
upkeep of all units will be established and enforced, so that the
physical condition and appearance of the units �rill be in keeping
wi,th th.e city as a whole.
