A RESOLUTION DECLARING IT NECESSARY TO IMPROVE THAT PART
OF CAPE ROCK DRIVE, FROM A POINT 19 .5 FEET EAST OF THE EAST
RIGHT OF WAY LINE OF PERRYVILLE ROAD, NORTHEASTERLY 4,070 .7
FEET TO THE CITY LIMITS, IN THE CITY OF CAPE GIR.ARDEAU, MISSOURI
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS :
That the Council of the City of Cape Girardeau, Missouri,
deems and declares hereby that a public necessity exists
for the improvemen� of Cape Rock Drive, from a point 19 .5
feet East of the East right of way line of Perryville Road,
Northeasterly 4,070 .7 feet to the City Limits, by grading
to the established grade and constructing thereon an Asphaltic
Cement Pavement, 9 inches thick and 36 feet in width between
the back of Portland Cement Concrete curbs , except at the
various intersecting streets, where the pavement shall be
constructed as shown on the plans, together with integral
curb along the sides thereof and the necessary pipe and inlets
for removal of storm water, all as shown on the plans for
said improvement.
li That said improvement of said Cape Rock Drive shall
be done in accordance with the plans and specifications and
estimate of cost for said improvement prepared by the City
Engineer, filed with the City Clerk, approved and adopted
by the City Council, and now on file in the office of the
City Clerk, and in accordance with Chapter 88, Revised Statutes
of Missouri, and all ordinances which may be enacted governing
the construction of this particular improvement.
That the proposed work shall be done by contract, �
as provided by law and ordinance and upon completion of the
project, the cost of the proposed work, not to exceed $ /?,QU
per front foot shall be charged to the abutting property
by the issuance of special tax bills and the balance, if
any, shall be charged to the City and any cost in excess
of $1?,O(� per front foot shall be borne by general revenue
and only $ �7� per front foot shall be charged against
the abutting property, all in accordance with Chapter 88,
Revised Statutes of Missouri and such ordinances as may be
hereafter enacted to carry out said work and it is the judgment
of the City Council that the condition of the general revenue
fund of the City is such that only the portion of the cost
of the work in excess of $ , per front foot shall
be paid therefrom.
That the City Clerk is hereby instructed to publish
this resolution in seven consecutive issues of the Cape Girardeau
Southeast Missourian, a daily newspaper printed and published
in the City of Cape Girardeau, Missouri, and if a majority
of the resident owners of land that would be liable for the
cost of the improvement, at the date of the passage of this
resolution, who shall own a majority of front feet owned
by the residents of the City, abutting on the street or part
of the street proposed to be improved, shall not within ten
(10) days after the date of the last publication of this

resolution, file with the City Clerk their protest against
such improvement, then the Council shall proceed to cause
the improvement to be made.
