A RESOLUTION GRANTING PERMISSION TO THE INDUSTRIAL DEVELOPMENT
AUTHORITY OF THE COUNTY OF CAPE GIRARDEAU, MISSOURI , AND FIRST
NATIONAL BANK OF CAPE GIRARDEAU, MISSOURI , FOR THE LOCATION
WITHIPI THE INCORPOR.ATED LIMITS OF THE CITY OF CAPE GIRARDEAU,
MISSOURI OF A "PROJECT" (WITHIN THE MEANING OF CHAPTER 349 ,
REVISED STATUTES OF MISSOURI, 1978 , AS AMENDED) FOR FIRST
NATIONAL BANK OF CAPE GIR.ARDEAU, MISSOURI .
WHEREAS, the Industrial Development Authority of the County
of Cape Girardeau, Missouri, (the "Authority") is authorized and
empowered by the provisions of Chapter 349 of the Revised Statutes
of Missouri, 1978, as amended (the "Act") , to acquire, improve,
maintain, equip and furnish Projects (as defined in the Act) for
the uses and public purposes set forth in the Act; and
WHEREAS, Section 349. 010(4) of the Act requires that projects
of a county authority must be located within an unincorporated
area of such county except that such projects may be located
within the incorporated limits of a municipality within such
county, when approved by the governing body of the municipality;
and
WHEREAS, there has been presented to this City Council , in
its capacity as the governing body of the City of Cape Girardeau,
an Application requesting approval of a Project of the Authority
to be located at Silver Springs Road and Route K within the
incorporated limits of the City of Cape Girardeau, Missouri,
such Project to be leased or conveyed to First National Bank
of Cape Girardeau, Missouri (the "Applicant") , pursuant to the
Authority' s powers under the Act; and
WHEREAS, the Project consists of (i) the improvement,
furnishing and equipping of a leasehold consisting of the bottom
two floors of a four-story office building to be constructed
and located at Silver Springs Road and Route K in the City
of Cape Girardeau, Cape Girardeau County, Missouri, and (ii)
the acquisiton and installation of a vault in said office
space, which leasehold improvements and equipment will be used
by Applicant as its banking facilities and to provide general
office space.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF CAPE GIRARDEAU, MISSOURT AS FOLLOWS :

SECTION 1. Acting in its capacity as the governing body
of the City of Cape Girardeau, Missouri, the City Council does
hereby grant permission for the location within the incorporated
limits of the City of Cape Girardeau, Missouri, or a project
of the Authority for First National Bank of Cape Girardeau,
Missouri.
SECTION 2. The passage and approval of this Resolution
is not a waiver of any, and First National Bank of Cape
Girardeau, Missouri, and the Authority shall comply with all,
ordinances, rules, regulations and requirements of the City of
Cape Girardeau, Missouri, and its various agencies and departments
regarding zoning codes , permits , licenses, approvals and filings
in connection with the acquisition and construction of the
Project.
SECTION 3. That this Resolution shall be in full force
and effect from and after the date of its adoption.
