A RESOLUTION DECLARING IT NECESSARY TO IMPROVE THAT PART OF
LEXINGTON AVENUE, FROM A POINT ON THE WEST EDGE OF PAVEMENT OF
CAPE ROCK DRIVE, NORTHWESTERLY 657. 15 FEET TO A POINT THAT IS
35. 75 FEET NORTHWEST OF THE WEST RIGHT-OF-WAY LINE OF AMBLEWOOD
DRIVE, IN THE CITY OF CAPE GIRARDEAU, MISSOURI
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIR.ARDEAU,
MISSOURI, AS FOLLOWS:
That the Council of the City of Cape Girardeau, Missouri,
deems and declares hereby that a public necessity exists for the
improvement of Lexington Avenue, from a point on the West edge of
pavement of Cape Rock Drive, Northwesterly 657. 15 feet to a point
that is 35. 75 feet Northwest of the West right-of-way line of
.Amblewood Drive, by grading to the established grade and constructing
thereon a Portland Cement Concrete Pavement, 6 inches thick and
36 feet in width between the back of 6 inch Portland Cement
Concrete integral curbs and gutters, except at the various
intersecting streets, where the pavement shall be constructed as
shown on the plans, together with necessary pipe and inlets for
removal of storm water, all as shown on the plans for said inlprovement.
That said improvement of Lexington Avenue shall be done in
accordance with the plans and specifications and estimate of cost
for said improvement prepared by the City Engineer, filed with
the City Clerk, approved and adopted by the City Council, and now
on file in the Office of the City Clerk, and in accordance with
Chapter 88, Revised Statutes of Missouri, and all ordinances
which may be enacted governing the construction of this particular
improvement.
That the proposed work shall be done by contract, as provided
by law and ordinance and upon completion of the project, the cost
of the proposed work, not to exceed $47. 20 per front foot shall
be charged to the abutting property by the issuance of special
tax bills and only $47. 20 per front foot shall be charged against
the abutting property, all in accordance with Chapter 88, RSMo
and such ordinances as may be hereafter enacted to carry out said
work.
That the City Clerk is hereby instructed to publish this
Resolution in seven (7) consecutive issues of the Cape Girardeau
Southeast Missourian, a daily newspaper printed and published.in
the City of Cape Girardeau, Missouri, and if a majority of the
resident owners of land that would be liable for the cost of the
inprovement, at the date of the passage of this resolution, who
shall own a majority of front feet owned by residents of the City
abutting on the street or part of the street proposed to improved,
shall not within ten (10) days after the date of the last publication
of this resolution, file with the City Clerk their protest against
such improvement, then the Council snall proceed to cause the
improvement to be made.
