A RESOLUTION DECLARING IT NECESSARY TO IMPROVE THAT PART OF
LYNNWOOD DRIVE, FROM A POINT ON THE EAST EDGE OF PAVEMENT OF
GRANDVIEW DRIVE, SAID POINT BEING 14. 35 FEET NORTHEAST OF THE
POINT OF INTERSECTION OF THE CENTER LINE OF GRANDVIEW DRIVE WITH
THE PROPOSED CENTER LINE OF LYNNWOOD DRIVE, MEASURED ALONG THE
PROPOSED CENTER LINE OF LYNNWOOD DRIVE, NORTHEAST 276. 8 FEET, TO
A POINT THAT IS 42. 7 FEET SOUTHWEST OF THE POINT OF INTERSECTION
OF THE CENTER LINE OF DAVID STREET WITH THE PROPOSED CENTER LINE
OF LYNNWOOD DRIVE, MEASURED ALONG THE PROPOSED CENTER LINE OF
LYNNWOOD DRIVE, IN THE CITY OF CAPE GIRARDEAU, MISSOURI
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
That the Council of the City of Cape Girardeau, Missouri,
deems and declares hereby that a public necessity exists for the
improvement of Lynnwood Drive, from a point on the East edge of
pavement of Grandview Drive, said point being 14. 35 feet Northeast
of the point of intersection of the center line of Grandview
Drive with the proposed center line of Lynnwood Drive, measured
along the proposed center line of Lynnwood Drive, Northeast 276. 8
feet, to a point that is 42. 7 feet Southwest of the point of
intersection of the center line of David Street with the proposed
center line of Lynnwood Drive, measured along the proposed center
line of Lynnwood Drive, by grading to the established grade and
constructing thereon a Portland Cement Concrete Pavement, 6
inches thick and 30 feet in width between the back of 6 inch
Portland Cement Concrete integral curbs and gutters, except at
the various intersecting streets, where the pavement shall be
constructed as shown on the plans, together with necessary pipe
and inlets for removal of storm water, all as shown on the plans
for said improvement.
That said improvement of Lynnwood Drive shall be done in
accordance with the plans and specifications and estimate of cost
for said improvement prepared by the City Engineer, filed with
the City Clerk, approved and adopted by the City Council, and now
on file in the office of the City Clerk, and in accordance with
Chapter 88, Revised Statutes of Missouri, 1978, and all ordinances
which may be enacted governing the construction of this particular
improvement.
That the proposed work shall be done by contract, as provided
by law and ordinances and upon completion of the project, the
cost of the proposed work, not to exceed $22. 672 per front foot
shall be charged to the abutting property by the issuance of
special tax bills and only $22. 672 per front foot shall be charged
against the abutting property, all in accordance with Chapter 88,
RSMo and such ordinances as may be hereafter enacted to carry out
said work.
That the City Clerk is hereby instructed to publish this
Resolution in seven (7) consecutive issues of the Cape Girardeau
Southeast Missourian, a daily newspaper printed and published in
the City of Cape Girardeau, Missouri, and if a majority of the
resident owners of land that would be liable for the cost of the
improvement, at the date of the passage of this resolution, who
shall own a majority of front feet owned by residents of the City
abutting on the street or part of the street proposed to be
improved, shall not within ten (10) days after the date of the
last publication of this resolution, file with the City Clerk
their protest against such improvement, then the Council shall
proceed to cause the improveme t to be made.
