A RESOLUTION AUTHORIZING THE CITY MANAGER TO
ENTER INTO AN AGREEMENT WITH CAPE SWIM TEAM
FOR USE OF THE CENTI2AL POOL
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI , AS FOLLOWS:
SECTION 1 . The City Manager on behalf of the City of Cape
Girardeau, Missouri , is hereby authorized to enter into an
Agreement with Cape Swim Team for use of the Central Pool . A
copy of this agreement is attached to this resolution and made
a part hereof .

� AGREEMENT
This Agreement made and entered into this day
of , 1986 , by and between the City of Cape
Girardeau, Missouri , a municipal corporation, t�ereinafter
called "City" and the Cape Swim Team, an unincorporated
association, hereinafter called "Swim Team. "
1 . During the winter season ( from the first official day
of school through the last official day of school )
SWim Team will have the exclusive use of at least four
( 4 ) swimming lanes at the Central Pool at the
following times:
5 : 00 p.m. to 8 : 00 p.m. Monday through Friday
9 : 00 am, to 12 : 00 noon on Saturdays .
2 . During the summer season (after the last official day
of school through the day before the first official
day of school ) Swim Team will have exclusive use of at
least four ( 4 ) lanes of the Central Pool for practices
from 7 : 00 a .m, to 11 : 00 a.m. Swim Team may use a
small section of the shallow end of the pool from
� 11 : 00 to 12 : 30 a.m. Monday through Saturday - area to
be determined by the Aquatics Superintendent .
3 . Swim Team may have the exclusive use of the Central
Pool for no more than three ( 3 ) meets at such times as
are mutually agreed upon by both parties . Written
notification of exclusive dates and times should be
received by the Director of Parks and Recreation at
least thirty ( 30 ) days prior to requested date .
4 . Swim Team shall not be charged for use of the pool
pursuant to paragraphs 1 and 2 of this Agreement .
Swim Team shall pay City $75 . 00 for each meet it
conducts pursuant to paragraph 3 of this Agreement .
5 . The Cape Swim Team will relinquish all rights of
ownership to the concession equipment located at
Central Pool to the City of Cape Girardeau in full
payment of all amounts it owes City for use of the
Central Pool in fiscal year 1985-86 .
6 . The City of Cape Girardeau shall be named co-sponsor
of the Swim Team on all Swim Team' s advertising and
promotional material .
7 . This Agreement shall be in effect from July 1 , 1986 to
^ June 30 , 1987 .
^ IN WITNESS WHEREOF, the parties hereto have executed this
Agreement the day and year first above written .
