A RESOLUTION AUTHORIZING THE CITY MANAGER TO
ENTER INTO A CONTRACT WITH RIVERVIEW
INVESTMENTS, LTD TO CONSTRUCT AND MAINTAIN A
CANOPY OVER A PUBLIC SIDEWALK
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI , AS FOLLOWS:
SECTION 1 . The City Manager on behalf of the City of Cape
Girardeau, Missouri , is hereby authorized to enter into a
contract with Riverview Investments, LTD to construct and
maintain a canopy over a public sidewalk . A copy of this
contract is attached to this resolution and made a part hereof .

CONTRACT
This Contract entered into this day of ,
1986 , by and between the City of Cap�ardeau, Missouri , a
Municipal Corporation, hereinafter referred to as "City" and
Riverview Investments, LTD, a Missouri Partnership, hereinafter
referred to as "Riverview. "
In consideration of the mutual covenants contained herein,
City and Riverview agree as follows:
1 . City shall allow Riverview to construct a canopy over
the Broadway entrance to the building located at 132 North Main
in conformity with the plans attached to the application for
building permit .
2 . Riverview shall maintain in force for as long as the
canopy remains in place a policy of general liability insurance
insuring Riverview against liability for personal injury and
property damage arising out of the placement and maintenance of
the canopy. The insurance policy shall be in the minimum
amount of $300 ,000 bodily injury and property damage combined.
Riverview shall provide City with certificates of insurance
verifying its compliance with this paragraph .

3 . Riverview hereby binds itself to indemnify and hold
the City harmless from all claims, demands, suits and actions
of every name and description brought against the City for or
on account of any injuries or damages received or sustained by
any parties or party in any way arising out of the placement or
maintenance of the canopy.
4 . If at any time Riverview or its successors and assigns
fails to meet its obligations under this contract , City shall
have the right to require Riverview to remove the canopy or to
remove the canopy itself.
5 . This contract is binding upon the parties hereto and
their successors and assigns .
IN WITNESS WHEREOF, the City of Cape Girardeau, Missouri
has caused this agreement to be signed by its City Manager and

hereto by and through its General Partner , affixed its name the
day and year first above written.
