A RESOLUTION DECLARING IT NECESSARY TO
IMPROVE SOUTH SPRIGG STREET FROM STATION 78
+ 17 , NORTH 3 ,584 . 78 FEET TO STATION 114 + 00
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI , AS FOLLOWS:
SECTION 1 . The City Council of the City of Cape Girardeau ,
Missouri , hereby declares that a public necessity exists for
the improvement of South Sprigg Street from Station 78 + 17 ,
North 3 , 584 . 78 feet to Station 114 + 00 .
It is the intention of the City Council to have this project
done by contract and to tax bill the abutting property in an
amount not to exceed $11 . 42 per front foot in accordance with
applicable law.
SECTION 2 . The City Manager is hereby directed to file
with the City Clerk for public inspection the following:
�.. A. The plans and specifications for the project .
B. An estimate of the total cost of the project,
including construction , construction contingency and
fees and other expenses .
C . An estimate of the portion of the total cost to be
assessed against each property to be benefitted by the
project .
SECTION 3 . A public hearing will be held before the City
Council at 7 : 30 P. M, on May 21, 1986 , at City Hall , 401
Independence, Cape Girardeau , Missouri at which citizens and
all interested parties may express their assent or objection to
the project .
SECTION 4 . The City Clerk is hereby directed to publish
notice for seven ( 7 ) consecutive insertions in a daily paper
that the items set forth in Section 2 have been filed with the
City Clerk for public inspection and that a public hearing will
be held at the time and place and for the purpose stated in
Section 3 . The notice shall also state that the City Council
shall not impose special assessments in excess of $10 . 00 per
front foot where a valid written protest against the
improvement has been filed with the City Clerk within ten ( 10 )

�'' days after May 19 , 1986 . In order to be valid, the protest
must be signed by a majority of the resident owners of the
lands that would be liable for the cost of the improvement who
shall own a majority of the front feet owned by residents of
the City abutting on the street or part of the street proposed
to be improved.
