A RESOLUTION AUTHORIZING THE CITY MANAGER TO
ENTER INTO A CONTRACT WITH CROSPIOE
LANDSCAPING COMPANY TO SEED RIGHT-OF-WAY IN
THE RED STAR COMMUNITY DEVELOPMENT BLOCK
GRANT PROJECT AREA
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI , AS FOLLOWS:
SECTIOrI 1 . The City Manager on behalf of the City of Cape
Girardeau, Missouri, is authorized to enter into a contract
with M. Paul Crosnoe, d/b/a Crosnoe Landscaping, to seed the
right-of-way in the Red Star Community Development Block Grant
Project area . A copy of this agreement is attached to this
resolution and made a part hereof .

CONTRACT
This Contract made and entered into this day
of , 1986 , by and between the City of Cape
Girardeau , Missouri , hereinafter called "City" and M. Paul
Crosnoe, d/b/a Crosnoe Landscaping, hereinafter called
"Contractor . "
1 . Contractor , for and in consideration of the payments
to be made as hereinafter provided, hereby agrees at his own
expense, to perform all of the labor and services, and to
furnish all of the materials and equipment necessary to seed
the right-of-way along the following s�reets and alleys paved
as part of the Community Block Grant, Red Star Neighborhood,
Project No . 83-CO-02 :
1 . Fourth Street from the east edge of Big Bend Road east
668 . 5 feet to the west end of radius of its
intersection with Main Street ;
2 . Spanish Street from the north end of radius of its
intersection �vith Fourth Street north 456 . 6 feet to
the south edge of Fifth Street;

3 . Fifth Street from the east edge of Big Bend Road east
676 . 0 feet to the west end of radius of its
intersection with Main Street ;
4 . North/South Alley between Big Bend Road and Spanish
Street from the north edge of Fifth Street north
378 . 36 feet;
5 . North/South Alley between Spanish Street and Main
Street from the north edge of Fifth Street north
623 . 79 feet to the south edge of Johnson Street ;
6 . Johnson Street from the east edge of Big Bend Road
east 639 . 7 feet to the west end of radius of its
intersection with Main Street;
7 . Spanish Street from the north edge of Johnson Street
north 530 . 4 feet to the south edge of Roberts Street;
8 . Roberts Street from the east edge of Big Bend Road
east 782 . 1 feet to the west edge of T�7ain Street .
The seeding shall consist of properly applying a 200 pounds per
acre proportion of 20-20-20 commercial type fertilizer and a
mixture of red fescue of eight pounds per acre and bluegrass of

four pounds per acre. A scattered straw cover shall be applied
� after the seeding.
2 . City shall pay Contractor the lump sum amount of One
Thousand Eight Hundred Twenty Dollars ( $1 ,820 .00 ) within thirty
( 30 ) days of satisfactory completion of the contract work .
3 . Contractor shall begin and complete the contract work
as soon as the weather permits .
4 . Contractor binds himself to indemnify and hold the
City harmless from all claims, demands, suits and other actions
brought against the City on account of any injuries or damages
received or sustained by any parties by or from the act of
Contractor , or his servants or agents in doing the work herein
contracted for or on account of any omission of the Contractor
or his servants or agents .
5 . Contractor agrees to make payment of all wages in
conformance with Federal Wage Determination No. M083-4047 and
State Wage Determination No. 4-016-032 . Contractor agrees that
he will comply with the provisions of the Prevailing Wage Law.
Contractor hereby agrees that he will forfeit to the City as a
penalty the sum of Ten Dollars ( $10 . 00 ) for each workman
employed, for each calendar day, or portion thereof, for which
such workman is paid less than the stipulated rates as
�. determined by the Department of Labor and Industrial Relations
in the wage determination for any work done under this
contract. Contractor hereby agrees that the City can withhold
payment under the terms of this Contract for all sums and
amounts due and owing as a result of any violations of the
Prevailing Wage Law.
6 . This Contract shall not be assigned nor shall
Contractor subcontract the contract work .
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement the day and year first above written .
