FOR RADIO EQUIPMENT MAINTENANCE SERVICES BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI , AS FOLLOWS: SECTION 1 . The City Manager on behalf of the City of Cape Girardeau, Missouri , is hereby authorized to enter into a contract with Motorola Communications and Electronics , Inc. for two-way radio equipment maintenance services . Stoverink , City Clerk � � CONTRACT This Contract made and entered into this day of , 1985 , by and between the City of Cape Girardeau , Missouri , a municipal corporation, hereinafter referred to as "City" and Motorola Communication and Electronics , Inc. , hereinafter referred to as "Motorola . " WITNESSETH: 1 . DESCRIPTION OF WORK. Motorola, for and in consideration of the payments to be made as hereinafter provided, hereby agrees to perform two-way radio equipment maintenance services for the City in accordance with the specifications set forth in the Notice to Bidders which are attached to this contract and made a part hereof . 2 . PAYMENT. City agrees to pay Motorola in accordance with the Bid Form submitted by Motorola which is attached to this contract and made a part hereof . Invoices for service work may be submitted � monthly for the month that the service is rendered. Bills received at the Purchasing Department by the 20th of the month will be paid on the lOth of the following month. Bills received after the 20th will be paid by the lOth of the second month . Monthly bills shall be directed to the Purchasinq Department . Invoices for extra work shall be directed to the Police Department . 3 . COMMUNICATIONS. All work tickets and written or verbal communication shall be directed to the Chief of Police . 4 . INSURANCE . Motorola shall purchase and maintain insurance in accordance with the requirements set forth in the Notice to Bidders which requirements are attached to this contract and made a part hereof . 5 . PENALTY . A penalty for late response or slow repair will be assessed, Late response for service calls will be penalized by a prorated deduction of the quoted extra service rate per hour for every hour or portion the servic� call is late, up to a maximum of One Hundred Dollars ( $100 .00 ) per occurrence . Slow '�' repairs shall be penalized in that any unit not repaired and returned within ten ( 10 ) days of notification of the service �►,, shop of a defect shall be removed from the service agreement for billing purposes , only for that month or months in which it is out of service. Deduction will be made on the next months invoice . 6 . CONTRACT TIME . This contract shall be in effect for a period of one ( 1 ) year from the date of its execution . Mandatory coverages 1 ) Comprehensive Form 2) Owned 3) Hired 4) Non-Owned. � 5 � 1 . 35 Routine Maintenance Bidders shall include as a part of their flat monthly quotation the cost of routine inspection service twice during the contract period. All equipment shall be routined beginning on the first business day after the first day of the third and ninth month of any agreement. This work shall be coordinated with and at the pleasure of Cape Girardeau. Measurements shall be made and adjustments shall be done in accordance with the service standards listed elsewhere in this specification. ..-.. 1 . 40 Location of Service Work Equipment to be maintained shall be repaired at the following locations: Fixed Equipment At equipment location. Mobile Equipment At maintenance shop during normal work hours. Portable Equipment City wi 11 del iver and pick up at maintenance shop. The maintenance shop shall be located within 30 minutes of the Police Department. � ^ � 8 � 1. 50 Response Time The required response for service shall be as follows : Fixed Equipment (24 hour coverage) 1 Hour Normal business hours Fixed Equipment (24 hour coverage) 2 Hours Evenings , nights , weekends, holidays Mobile Equipment 1/2 Hour Normal business hours Portable Equipment 1/2 Hour Normal business hours Response time is defined as the time between the City' s request for service and when a technician arrives at the equipment. Time will be allowed for normal travel consistent ,,� — — — with bidder's business location and travel conditions at that time. Response time for mobile and portable equipment when delivered to the service shop is the time between arrival of the equipment and when a technician first looks at the equipment. Service shall be available on fixed equipment on a 24-hour- per-day, 365-day-a-year basis. 1 . 60 Time to Repair Equipment shall be repaired as quickly as possible consistent with the problem and parts availability. Parts required, but not in stock, shall be ordered immediately for fastest � delivery. n � For any unit where a delay of one day for fixed equipment or three days for all other equipment is expected, the City shall be notified immediately and given an expected date of repair and return. 1 . 70 Repair Quality All service work shall be done in a competent and workman- like manner. Repaired units shall be returned completely to factory specifications, but in no case less than those standards set forth in the Service Standards Section. Parts used shall be manufacturers' recommended replacements or �,.� e q ua 1 . 1 . 80 Parts Inventory The bidder shall certify that within 30 days of contract award, they will maintain, on hand, sufficient parts to adequately repair the City's radio equipment. This includes all semiconductor devices that may be reasonably expected to fail, relays, and other items. It is not expected that such items as power transformers or heat sinks will be stocked by the bidder unless at his option. 1 . 90 Documentation ^ All service work shall be substantiated by job tickets which shall be supplied monthly to the City. These tickets shall clearly show work done, parts replaced, by part number and � . clearlv show work done , parts replaced, bv vart number and descriotion, and test measurements taken before and afrer adiustment. Failure to sup�lv the above inf�rmation will cause �avment to be delaved. All iob . tickets shall be complete with the sienature of its Technician and his FCC license number or other certification. The orieinal iob r_icket shall be su��lied. 2 . 00 Tele�hone Line Problems NOTWITHSTANDING the �enaltv Drovisions of this s�ecification. the Citv will not impose the �enaltv �rovision if eoui�ment �, or svstem malfunction is caused bv the failure of leased tele�hone circuits. The service a�encv is resnonsible , however , to interface with and coordinate telenhone line problems . 2 . 01 Other Problems Rase Station downtime caused bv antenna, feed line, or tower difficulties will not invoke the oenaltv provision of the contract. 2.02 Covered ilnits The auantitv, make and model of the units to be covered bv � this bid are detailed in Apnendix A. attached. Hi�h antenna SWR shall be immediatelv revorted. 3 .02 Installation Standards Installations shall be dcne in a workmanlike manner in accordance with the direction eiven bv the Chief of Police or his reUresentative. Cables shall be securelv connected and Dosts clean. Drawer units , housin�s , control heads , and s�eakers shall be securelv mounted. All cable runs shall be routed of the wav, --�. tie-wrapped and run in such a wav as to reduce maintenance nroblems. All wires and cables run throu�h metal shall be included in rubber �rommetinQ. All other metal edges shall 15 �'1 be filed to remove anv roueh ed�es. Antennas shall be mounted on surfaces clean of paint and dirt and in such a wav as to reduce SWR. Cables shall be routed and tie-wra��ed to reduce maintenance nroblems.
