A RESOLUTION AUTHORIZING THE CITY MANAGER TO
ENTER INTO AN AGREEMENT WITH CAPE SWIM TEAM
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
SEC`rION 1 . The City Manager on behalf of the City of Cape
Girardeau , Missouri , is hereby authorized to enter into an
agreement with Cape Swim Team. A copy of said agreement is
attached to this resolution and made a part hereof.

AGR EEM ENT
This Agreement made and entered into this day
of , 1987 , by and between the City of Cape
Girardeau , Missouri , a Municipal Corporation, hereinafter called
"City" and the Cape Swim Team, an unincorporated association ,
hereinafter called "Swim Team. "
WITNESSETH:
1 . During the Winter session (for the first official day of
school through the last official day of school ) Swim Team
will have the exclusive use of at least six ( 6) swimming
lanes at the Central Pool at the following times:
5 : 00 P. M. to 8 : 00 P. M. Monday through Friday .
8 : 30 A.M. to 11 : 00 Am, on Saturdays .
2 . During the Summer session (after the last official day of
school through the day before the first official day of
school ) Swim Team will have exclusive use of six ( 6)
lanes of the Central Pool for practice from 7 :00 A.M, to
9 : 00 A. M. long course and 9 :00 A. M. to 11 : 00 A. M. for
short course . Swim Team may use a small section of the
shallow end of the pool from 11 : 00 A. M. to 12 : 30 P. M.
Monday through Saturday - area to be determined by the
Aquatics Superintendent .
3 . Swim Team may have the exclusive use of the Central Pool
for no more than three ( 3) meets at such times as are
mutually agreed upan by both parties . Written
notification of exclusive dates and times should be
received by the Director of Parks and Recreation at least
thirty ( 30) days prior to requested date .
4 . Swim Team shall not Y�e charged for use of the pool
pursuant to Paragraphs 1 and 2 of this Agreement . Swim
Team shall pay to City One Hundred Dollars (�100 . 00 ) per
day for each meet it conducts pursuant to Paragraph 3 of
this Agreement .
5 . The City of Cape Girardeau shall be named co-sponsors of
the Swim Team on all Swim Team's advertising and
promotional material and a copy of all advertisements
pr_ovided as proof thereof.
5 . This Agreement shall be in effect from July 1 , 1987 to
June 30 , 1988 .
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement the day and year first above written .
