The City Manager on behalf of the City of Cape Girardeau , Missouri , is hereby authorized to enter into an agreement for engineering services with Booker Associates , Inc . for a railroad spur line into Cape Industrial Park . Box 617 Cape Girardeau, Missouri 63702 Re: Professional Services Industrial Rail Spur Cape Girardeau, Missouri Booker Proposal No. PE-87523 Dear Mr. 4Jorth: We are pleased to submit this proposal for the provision of professional services in connection with the above project. OBJECTIVE The objective of the professional services to be provided by Booker Associates, Inc. , hereinafter referred to as Booker, to the City of Cape Girardeau, Missouri , hereinafter referred to as the Client, will be the preparation of contract documents for a railroad spur line into Cape Industrial Park. SCOPE OF SERVICES In order to achieve the above objectives, Booker will perform the following services: A. Topographic and Design Surveys 1. Booker will obtain the topographic data and design surveys necessary for tne preparation of the contract for the proposed improvements. Such survey information shall include, but not be limited to, the following: a. Establishment of construction centerlines or baselines for referencing all existing topograpf�ic features. b. Establish benchmarks, obtain profiles, cross sections, and such other data to provide a spur track compatible with existing tracks and buildings. Obtain elevations of existing pipe culverts and ditches and locate and reference all above and below ground utilities to the construction centerline or baseline. B. Contract Plans and Cost Estimates 1. Booker will prepare cornplete and final contract plans of tne proposed improvements for construction. The plans will include, but not be limited to, the following: a. Plan and profile sheets at a scale of 1" = 20' horizontally and 1" = 5 ' vertically, showing all survey data, topography, existing utilities, proposed improvements, construction limits, and the existing and proposed profile grades at centerline of the proposed spur track. b. Cover sheet, typical sections, and construction details. c. Cross-sections at a scale pf 1" = 5' horizontally and vertically at 50 foot intervals and any other necessary cross-sections. d. Storrn drainage profiles, complete with flowlines and grades. 2. Booker will assist the City in obtaining the approval of final agreements with the Railroad Company, the Missouri Division of Transportation, the Missouri Highway and Transportation Department, utility companies and other such public agencies as �ay be necessary. 3. Booker will prepare a complete set of front end documents and tecnnical specifications. 4. Booker will provide quantities and a detailed estimate of cost for the work. 5. Booker will prepare the Notice to Contractors for bidding purposes, notify Dodge Reports of the progress of the project, and send written notices to a number of contractors qualified to bid on the work. C. Construction Services 1. Booker will assist the City in advertising for bids, attend the bid openings, and assist in analyzing bids and making a recommendation with respect to the selection of a qualified contractor for the construction of the work. Site visits to observe the construction for conformance with the plans and specifications or interpretations of the plans and specifications. Daily construction inspection is not included. 4. Final inspection of the work to determine that all construction has been co�npleted as provided for in the plans and specifications . PROVIDED BY BOOKER In undertaking and accomplishing the work, Booker will provide: 1. The services of all professional and technical personnel required for the performance of the work described under Scope of Services above. 2. One (1) set of reproducible plans of the final drawings. 3. Ten (10) sets of blueline prints of the plans, specifications, and contract documents. PROVIDED BY CLIENT In order to assist Booker in the provision of professional services, the Client will provide: 1. The name of a representative to whom Booker will report and from whom Booker will receive review comments, instructions, directions and authorizations. 2. Such legal , accounting and insurance consulting services, if any, which may be necessary to complete the project. 3. Any and all exlsting data concerning the project which may be available. 4. Right of access to all properties as required during the execution of the work. 5. Al1 necessary Resident Engineering services. 6. Services of an independent testing laboratory to perform all materials testing necessary for control of the project during the construction phase. Mr. Gary Worth Booker Proposal iVo. PE-87523 September 28, 1987 Page 4 TIME OF PERFORMANCE Booker will cornmence work immediately upon authorization to do so and complete the project within the time periods given below: 1. The Survey Phase combined with the preliminary design documents will be completed and submitted for review within thirty (30) calendar days after receipt of written Notice to Proceed. 2. Final Contract Documents will be submitted for review within fifteen (15) calendar days after receipt of final Client review comments. FEES AND PAYMENTS The Client will compensate Booker for the provision of tne professional services described above in the amount of Twenty Five Thousand Eight Hundred Fifteen Dollars ($25,815.00) . Said lump sum amount shall constitute complete payrnent for all professional services, direct and subcontract costs and all other costs incidental to the work. Pay�nent shall be made monthly upon subrnission of a proper invoice in an amount equal to the percent of work completed in the preceding month. All invoices shall be due and oayable witnin thirty (30) calendar days. As a professional firm, we have a responsibility to our clients and our share- holders to represent and protect their interests. One way to protect these interests is to maintain various types of insurance coverage. One of the coverages thus provided is professional liability insurance which is currently underwritten by the Design Professionals Insurance Corporation (DPIC) through an organization known as the American Consulting Engineers Council (ACEC) . It has been determined to be prudent business to include a Limitation of Liability which is representative of the level of involvement of our firm in the design and construction process . The inclusion of this Limitation of Liability results in a reduced premium which ultimately translates to a lower overhead. This then, permits us to provide professional services to you, our client, at the lowest cost possible. Therefore, the use of the liability clause is strictly one of practicality and is in no way reflective of the quality of work performed by Booker Associates, Inc.
