HomeMy WebLinkAboutRES.263.06-15-1987 BILL N0. 87-112 RESOLUTION N0. ;.�^ �� A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH THE COUNTY OF CAPE GIRARDEAU, CLERK OF THE COUNTY COMMISSION AND THE COUNTY COLLECTOR FOR TAX COLLECTION SERVICES BE IT RESOLVED BY THE COUNCIL OF THE CITY OF- CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: SECTION 1 . The City Manager on behalf of the City of Cape Girardeau, Missouri , is hereby authorized to enter into an agreement with the County of Cape Girardeau, Clerk of the County Commission and the County Collector for tax collection services . Stoverink , City Clerk AGREEMENT THIS AGREEMENT, made and entered into this day of , 1987 , by and between the City of Cape Girardeau , Missouri , a municipal corporation, hereinafter called the "City" , and the County of Cape Girardeau, Missouri , hereinafter called the "County" , and Rodney Miller , Clerk of the County Commission, and Harold Dean Kuehle , County Collector . WITNESSETH : WHEREAS , the City and County are empowered, under Article VI , Section 16 , of the Missouri Constitution and Section 70 . 220 RSMo , to enter into certain cooperative agreements; and WHEREAS, it is deemed by the parties hereto to be mutually advantageous to all parties for the County, by use of electronic data processing equipment, to prepare and collect taxes for the City for an agreed compensation; and WHEREAS , the Collector of Cape Girardeau County, Missouri , has expressed a willingness to cooperate and provide the mechanics for the collection of City real estate and personal property taxes as accrue in the County. NOW, THEREFORE, in consideration of the mutual promises and covenants herein contained, the parties agree as follows: I. The County, by and through the County Clerk and the County Collector hereby agrees to send out, on behalf of the City, tax bills relating to all real and personal property located within that portion of the City boundaries which lie within Cape Girardeau County, Missouri . II . The County, by and through the County Collector , hereby agrees to collect, on behalf of the City, all monies due and owing the City for taxable property within that portion of the boundaries of the City which lie within Cape Girardeau County, Missouri . III . City agrees to provide all assistance, documentation, and other information as may be needed by County and the County collector to carry out the purposes of this contract . IV. City will furnish to County its annual tax levy for the tax year no later than August 31 of each calendar year during which this agreement remains in force . V. The County agrees that the City shall have access , at all reasonable times , and under the supervision of the County Collector , to all data accumulated under the data processing system, including but not limited to the following, which shall be provided annually or as otherwise requested by City in printed form: A. Alphabetical listing for all real estate, personal proper ty. B. A delinquent listing file upon request. C. Magnetic Tape of Tax Rolls - Real & Personal Property. The County agrees to remit to the City the receipts due the City at the same time the County deposits with the Treasurer its own receipts; provided that there shall be a remittance to the City at least once per month . VI. The County agrees to notify City of any tax sales involving property within the City. VII . The County will not be responsible for collecting any of the City ' s 1986 and prior delinquent real or personal property taxes . The County agrees to collect any 1987 delinquent real and personal property taxes in the same manner as the County now follows , including necessary tax sales conducted in accordance with applicable Missouri Statutes . VIII . The City agrees that the County may withhold a sum equal to one percent ( 1$ ) of all taxes collected by the County on behalf of the City as compensation for the services herein provided by the County. The County will remit to City ninety-nine percent ( 99$ ) of all taxes , collected on behalf of the City. Said money shall be remitted by the County Collector to the City on the same basis and in the same manner as other tax monies are remitted by the County to the various taxing bodies within the County, except that, during the peak collection periods , remittance shall be made on a more frequent basis as agreed by the Collector and City representatives . All interest earned on taxes collected will be remitted by the County Collector to the City on the same basis and in the same manner as other tax monies are remitted, except when advance payments are made, the interest earned on the advanced amount will be paid at the time of full monthly settlement and in the same manner as other monies are remitted. -2- IX. One Half (1/2) of One (1 ) percent will be withheld from all taxes per Section 137 .720 for County Assessment Fund . X. This contract may be modified by a written instrument executed by both parties . XI. The parties hereto mutually agree that the term of this agreement is for one year , beginning July 1 , 1987, and ending June 30 , 1988 , provided however , that either party may terminate this agreement within ninety ( 90) days by serving upon all other parties to the agreement written notice of its intention to terminate this agreement . The parties hereto mutually agree that this contract will be automatically renewed subject to modification on July 1 , 1988, and will continue to renew on July 1 , of each subsequent year unless either party serves written notice of termination no less than ninety ( 90) days prior to the renewal date.
