A RESOLUTION AUTHORIZING THE CITY MANAGER TO
ENTER INTO A CONTRACT WITH CAPE CENTRAL AIRWAYS,
INC . FOR A WERTHER INFORMATION STATION AND
SUPPLEMENTAL RADAR SYSTEM AT THE CAPE GIRARDEAU
MUNICIPAL AIRPORT
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU ,
MISSOURI , AS FOLLOWS:
SECTION l . The City Manager , for anc� on behalf of the City of
Cape Girardeau , Missouri , is hereby authorized to enter into a
Contract with Cape Central Airways , Inc . , for a weather information
station and supplemental radar system at the Cape Girardeau
Municipal Airport . A copy of said Contract is attached to this
Resolution and made a part hereof .

CONTRACT
This Contract entered into this day of ,
1989 , by and between CAPE CENTRAL AIRG7AYS , IP�C . , a Missouri
Corporacion , hereinafter referred to as "Cape Central " and the the
CTTY OE CAPE GIRARDEP.U, MISSOURI , a Municipal Corpora'tion ,
hereinafter referred to as "City" ,
NOW, THEREFORE, in consideration of the promises and
obligations entered in�o herein , the parties agree to bind
'themselves as follows :
1 . Cape Central aqrees to purchase a computerized, automated
weather information station known by its trade name as a "Pan Am
ti,��.=�atherma 'tion System" for use at the Ca�e GirarCeau N,unicipal
A��rrport located in Scott County, r7issouri . Cape CenLral agrees to
m�ke appropriate space available in i�s �raining room for
i � ; ,::alla 'tion and operation of the weather information station .
2 . The par 'ties agree that the City of Cape Girardeau will
reimburse Cape Central for the purchase price and installation
costs associated with the acquisition of this weather information
station . The parties agree that the City will pay to Cape Central
an amount equal �o its cost upon submission of invoices or other
proof of the actual cost .
3 . The parties agree that in addition to the automated
weather information station , Cape Central will also acquire and
install a supplemental radar system known as a "WSI Radar System"
upon the same terms and conaitions as for the Pan Am tiaeather
Station System and tne parties further agree that the CiLy will
also reimburse Cape Central for its purchase and installation
costs associated with this radar system. It is agreed by and
between the parties tha 't the City ' s total reimbursement to Cape
Central for �he weather information station and the supplemental
radar station shall not exceed Fifteen Thousand Dollars
( �15 ,000 . 00 ) for the two syscems combined.
4 . Cape Cen�ral agrees to provide appropriate space in its
training room for the installation of these above c,escribed items
of equipment and furtt�er , Cape Central agrees to provide access
and use of the equipmen't to the aviation public. The parties
agrr«� r,�at access to t'..e Pan Am V�eather S'tation System will be

a��;3 c';�� ci�e c�J13C101"1 public may also have access to the WSI Radar
Sy� c �.n ��.��,�n payment of access fees equal to the fees incurred by
Cape Cencral Air�aays ior each usaqe of Lhe system. Such access
fees mus't be approved by the Airport P�lanager of the City.
5 . Cape Cen�ral agrees to pay any access fees and
main 'tenance and enhancement charges for both sysLerns .
G . I 't is agreed by and between tl�e narties that the City
�,._:,�il be the owner of the equipment so purci-iased under this
contract and that Cape Central may use both systems on the same
terms and conditions as the general aviation public .
7 . Either party to this Agreement shall have the right to
terminate this Agreement at any time upon sixty ( 60 ) days notice
in writing to the other par 'ty,
The parties hereto set their hand to this agreement the day
and year written above .
