The City Manager , for and on behalf of the City of Cape Girardeau, Missouri , is hereby authorized to enter into an Agreement with the P��issouri Department of Natural Resources to accept a grant for construction of Phase III , Section II of the Upper Cape LaCroix Sewer project , Grant I .D . Ronald Fischer Page 2 February 6, 1989 Grant funds will be paid in four installments upon completion of 25 percent, 50 percent, 90 percent, and 10U percent of project construction. To request payment of grant funds, you must submit payment request forms (copies enclosed for your use) at these milestones. You must also document costs claimed by submitting copies of contractor's pay estimates, engineering invoices, and other appropriate documentation. Final payment will be withheld until all grant requirements and conditions have been met. The following items will also need to accompany the final payment request: a copy of a final inspection report performed by the Regional Office Program, copies of all change orders, includin� final quantities, and a Statement of Work Completed (copy enclosed) . The final payment will only be in the amount sufficient to complete the project, not to be exceeded by the amount of the grant award. The award of grant funds is subject to all applicable statutory provisions and the rules and regulations pertaining to the grant program. You should be made aware that a detailed project audit may be made upon completion of the proposed project. This audit will reflect receipt and expenditure of all funds associated with the project. Any improper use of fUnds will result in recovery of these funds. If officials of the City of Cape Girardeau agree to accept grant funds for the proposed project from the State of Missouri , please sign the attached agreement and return it to the Water Pollution Control Program, P.O. Box 176, Jefferson City, Missouri 65102, within three weeks. This grant amount represents 55% of the estimated eligible costs, and will be adjusted downward if bids are lower than the estimated cost. The grantee agrees to comply with the following grant conditions: 1 . The grantee agrees to complete the above described project on or before Julv 1 . 1991 Date 2. The grantee agrees to submit signed pay estimates for approval and reimbursement at 25%, 50%, 90% and 1007. of completion. 3. The grantee will submit one copy of the bidding documents to permit DNR to determine eligibility for funding. 4. An audit may be performed by DNR on yoUr project. The grantee agrees to keep records for a period of three (3) years following final payment conforming with generally accepted accounting practices. 5. A final inspection by the DNR regional office must be done prior to final payment. All projects must have a statement signed by the consulting engineer certifying that the project has been built according to the approved plans and specifications prior to final payment. 6. The grantee agrees to submit one copy of all change orders to DNR. 7. All cost overruns shall be borne by the applicant.
