A RESOLUTION DECLARING IT NECESSARY TO IMPROVE THAT PART
OF LEXINGTON AVENUE FROM 338 . 74 FEET EAST OF THE
CENTERLINE OF MISSOURI ROUTE W EXTENDING NORTHERLY AND
EASTERLY 2120 FEET MORE OR LESS TO A POINT 242 .71 FEET
WEST OF FLAD AVENUE, BEING THE WEST END OF THE LEXINGTON
1A PROJECT IN THE CITY OF CAPE GIRARDEAU, MISSOURI
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
That the Council of the City of Cape Girardeau, Missouri, deems
and declares hereby that a public necessity exists for the
improvement of Lexington Avenue from a point 338 . 74 feet East of the
centerline of Missouri Route W (Sta. 9+30) extending northerly and
easterly 2120 feet, more or less, to a point 242 . 71 feet west of
Flad Avenue (Sta. 30+50) being the west end of the Lexington 1a
project, by grading to the established grade and constructing
thereon a Portland Cement Concrete Pavement, 6 inches thick and 44
feet in width between the backs of 6 inch upright integral curbs, OR
an Asphaltic Concrete Pavement, 7 inches thick and 44 feet in width
between the backs of 6 inch upright integral curbs, except at the
various intersection streets, where the pavement shall be
constructed as shown on the plans, together with necessary pipe and
inlets for the removal of storm water, all as shown on the plans for
said improvement.
That said improvement of Lexington Avenue shall be done in
accordance with the plans and specifications and estimate of cost
for said improvement prepared by the City Engineer, filed with the
City Clerk, approved and adopted by the City Council, and now on
file in the Office of the City Clerk, and in accordance with Chapter
88 , Revised Statutes of Missouri, and all ordinances and resolutions
which may be enacted governing the construction of this particular
improvement.
That the proposed work shall be done by contract, as provided
by law and ordinance or resolution and upon completion of the
project, the cost of the proposed work, not to exceed $25. 00 per
front foot shall be charged to the abutting property for the
issuance of special tax bills and only $25. 00 per front foot shall
be charged against the abutting property, all in accordance with
Chapter 88 , RSMo and such ordinances as may be hereafter enacted to
carry out said work.
That the City Clerk is hereby instructed to publish this
Resolution in seven (7) consecutive issues of the Cape Girardeau
Southeast Missourian, a daily newspaper printed and published in the
City of Cape Girardeau, Missouri. Anyone desiring to do so may
appear before the City Council at 7 : 30 P.M. , Tuesday, September 24,
1990, and be heard on the question of the necessity of the work
sought to be done.
