A RESOLUTION GRANTING AN EXTENSION OF TIME TO NIP
KELLEY EQUIPMENT COMPANY TO COMPLETE THE
IMPROVEMENT OF LEXINGTON AVENUE, PHASE la , IN THE
CITY OF CAPE GIRARDEAU, MISSOURI
WHEREAS, by contract duly entered into August 24 , 1989 ,
between Nip Kelley Equipment Company and the City of Cape
Girardeau , Missouri , for improvement of Lexington Avenue , Phase
la; and
VJHEREAS , by the term of the original contract , this work was
to be completed March 20 , 1990; and
WHEREAS , due to inability to work on the project on account of
weather conditions and unavailability of materials, the City
Council granted an extention of time until June l , 1990 , within
which to complete said project ; and
WHEREAS , the City Council deems it necessary to grant an
additional extension of time .
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI , AS FOLL04JS:
ARTICLE l . Nip Kelley Equipment Company, contractor for the
improvement of Lexington Avenue , Phase la , is hereby given an
extention of time until July 15 , 1990 , within which to complete
this improvement within the City.
