A RESOLUTION ESTABLISHING AND EMPOWERING A CITIZENS COMMITTEE FOR
THE PURPOSE OF MAKING AN INVESTIGATION AND RECOMMENDATIONS TO THE
CITY COUNCIL OF CAPE GIRARDEAU WITH RESPECT TO RENEWAL OF THE
CURRENT CABLE TELEVISION FRANCHISE
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI , AS FOLLOWS :
ARTICLE 1 . There is hereby established a citizens
committee , which committee is empowered to act on behalf of the
Citv of Cape Girardeau and authorized and directed to oversee
proceedinas which will afford the public in the City of Cape
Girardeau , Missouri , with appropriate notice and participation for
the purpose of identifyinq the future cable related community
needs and interests ; and reviewincr the performance of the cable
operator under the franchise durinq the current franchise term.
ARTICLE 2. Upon completion of the proceedinqs as set out in
Article 1 above , this commi �tee shall have the authority to
request of the cable operator a proposal for renewal of the
operator ' s franchise to operate the cable television svstem in the
City of Cape Girardeau , Missouri .
ARTICLE 3. Upon submittal by the cable operator of a
proposal to the City of Cape Girardeau for the renewal of the
franchise , the citizens committee shall provide prompt public
notice of such proposal and shall assess the cable operator ' s
proposal and make recommendations to the City Council . If the
Council makes a preliminarv assessment of nonrenewal of the
proposed franchise , the committee shall consider whether :
( a) The cable operator has substantially complied with the
material terms of the existinct franchise and with applicable law
(b) The quality of the operator ' s service includinq siqnal
ctuality , response to consumer complaints , and billinq practices ,
but without reqard to the mix , quality or level of cable services
or other services provided over the system, has been reasonable in
liaht of community needs
(c ) The operator has the financial , leQal , and technical
ability to provide the services , facilities , and eauipment as set
forth in the operator ' s proposal , and
( d ) The operator ' s proposal is reasonable to meet the future
cable related community needs and interests takina into account
the cost of ineetinQ such needs and interests .
ARTICLE 4 . The adoption of this resolution constitutes the
commencement of proceedinqs for the purpose of identifyinq future
cable related community needs and interests and reviewinct the
current cable operator ' s performance under the current franchise .

ARTICLE 5. In order to provide notice to the public of its
riaht to participate in these proceedinqs and to encoura4e citizen
involvement in the ascertainment of these issues it is directed
that the City Clerk publish a copy of this resolution in a local
newspaper for seven ( 7 ) consecutive publications .
ARTICLE 6 . Further the City Council requests that all
citizens or persons who wish to participate in the committee
proceedinqs or to provide information for the committee should
contact the City Attorney ' s Office of the Citv of Cape Girardeau
by directinQ a letter to the City Attorney , Warren Wells at 401
Independence , Cape Girardeau, Missouri 63701 , or by telephonina
the office at 334-3036.
