A RESOLUTION AUTHORIZING THE CITY MANAGER TO
ENTER INTO AMENDMENT NUMBER 1 TO THE GRANT
AGREEMENT FOR PROJECT NUMBER 3-29-0013-04 FOR
IMPROVEMENTS AT THE CAPE GIRARDEAU MUNICIPAL
AIRPORT
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI , AS FOLLOWS :
ARTICLE 1 . The City Manager, for and on behalf of the City of
Cape Girardeau, Missouri , is hereby authorized to enter into
Amendment Number 1 to the Grant Agreement for Project Number
3-29-0013-04 for improvements at the Cape Girardeau Municipal
Airport . A copy of said Amendment Number 1 is attached to this
Resolution and made a part hereof .

AMENDMENT NUMBER 1 TO GRANT AGREEMENT FOR PROJECT NUMBER 3-29-0013-04
WHEREAS, the Federal Aviation Administration (hereinafter referred to as the
"FAA") has determined it to be in the interest of the United States that the
Grant Agreement between the FAA, acting for and on behalf of the United
States , and the City of Cape Girardeau, Missouri, (hereinafter referred to as
the "Sponsor") , accepted by said Sponsor on the 6th day of August 1990, be
amended as hereinafter provided.
WHEREAS, it has been determined necessary to amend the description of
development to be accomplished under the pro�ject, to delete renovation of
existing terminal building.
NOW THEREFORE, WITNESSETH:
That in consideration of the benefits to accrue to the parties hereto, the FAA
on behalf of the United States, on the one part, and the Sponsor, on the other
part, do hereby mutually agree that the said Grant Agreement be and is hereby
amended by:
1. Deleting from the description, as it appears on Page 1, the following:
"Renovate existing terminal building" .

Z. Deleting condition 10 from page 3, and substituting therefor the following:
10. It is understood and agreed by and between the parties hereto
that work added by this grant amendment is offered on the basis of
preliminary plans and/or specifications and the parties hereby
covenant and agree that by June 15, 1991, the sponsor shall furnish
final plans and/or specifications to the FAA and that there shall
be no advertisement for bids for accomplishment of work and no
commencement of work added by this amendment until the final plans
and/or specifications therefor have been approved by the FAA. The
parties do hereby further covenant and agree that any reference to
plans and/or specifications for work added by this amendment shall
be considered as having reference to said final plans and/or
specifications as so approved."

That I have examined the foregoing Amendment to Grant Agreement and the
proceeding taken by said Sponsor relating thereto, and find that the execution
thereof by said sponsor has been duly authorized and is in all respects due and
proper and in accordance with the laws of the State of Missouri, and further that,
in my opinion, said Amendment to Grant Agreement constitutes a legal and binding
obligation of the sponsor in accordance with the terms thereof.
