A RESOLUTION DECLARING IT NECESSARY TO IMPROVE THAT
PART OF OZARK STREET, WEST OFF WEST END BOULEVARD;
0'CONNELL DRIVE, OFF OF RAND; MAGNOLIA AVENUE, FROM
CAROLINA TO RAMPART; JASMINE LANE, FROM CAROLINA TO
RAMPART; NANCY LANE, FROM BLOOMFIELD TO JAN;
MONTGOMERY STREET, FROM MINNESOTA TO LOUIS; LOUIS
STREET, FROM MONTGOMERY TO BRINK; HAZEL STREET, 600
BLOCK; GIBONEY AVENUE, FROM ELM TO WILLOW; DUMAIS
DRIVE, WEST OFF COUNTRY CLUB; SECOND STREET, FROM
MAIN TO WATER; AND MARY ANN, WEST FROM BRIICHER; IN
THE CITY OF CAPE GIRARDEAU, MISSOURI
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAII,
MISSOURI , AS FOLLOWS :
ARTICLE l . That the Council of the City of Cape Girardeau,
I�Iissouri , deems and declares hereby that a public necessity exists
for the improvement of OZARK STREET, West off `rlest End Boulevard
for a distance of 740 feet , by grading to the established grade
and constructing thereon an Asphaltic Concrete Pavement Surface,
three ( 3 ) inches thick and eighteen ( 18 ) feet in width, with road
ditches, all as shown on the plans and specifications for said
improvement .
ARTICLE 2 . That the Council of the City of Cape Girardeau,
Missouri , deems and declares hereby that a public necessity exists
for the improvement of 0'CONNELL DRIVE, off of Rand for a
distance of 356 feet , by grading to the established grade and
constructing thereon an Asphaltic Concrete Pavement Surface, three
( 3 ) inches thick and twenty ( 20 ) feet in width, with road ditches,
all as shown on the plans and specifications for said improvement .
ARTICLE 3 . That the Council of the City of Cape Girardeau,
Missouri , deems and declares hereby that a public necessity exists
for the improvement of MAGNOLIA AVENUE, from Carolina to Rampart
for a distance of 575 feet , by gradinq to the established grade
and constructing thereon an Asphaltic Concrete Pavement Surface,
three ( 3 ) inches thick and twenty ( 20 ) feet in width, with road
ditches, all as shown on the plans and specifications for said
improvement .
ARTICLE 4 . That the Council of the City of Cape Girardeau,
Missouri , deems and declares hereby that a public necessity exists
for the improvement of JASMINE LANE, from Carolina to Rampart
for a distance of 592 feet , by grading to the established grade
and constructing thereon an Asphaltic Concrete Pavement Surface,
three ( 3 ) inches thick and twenty ( 20 ) feet in width, with road
ditches, all as shown on the plans and specifications for said
improvement ,
ARTICLE 5 , That the Council of the City of Cape Girardeau,
Missouri , deems and declares hereby that a public necessity exists
for the improvement of NANCY LANE, from Bloomfield to Jan for a
distance of 558 . 2 feet , by grading to the established grade and
constructing thereon an Asphaltic Concrete Pavement Surface, three
( 3 ) inches thick and twenty ( 20 ) feet in width, with road ditches,
all as shown on the plans and specifications for said improvement .
ARTICLE 6 . That the Council of the City of Cape Girardeau,
Missouri , deems and declares hereby that a public necessity exists
for the improvement of MONTGOMERY STREET, from Minnesota to
Louis for a distance of 367 feet , by grading to the established
grade and constructing ther2on an Asphaltic Concrete Pavement
Surface, three ( 3 ) inches thick and twenty ( 20 ) feet in width,
with road ditches, all as shown on the plans and specifications
for said improvement .
ARTICLE 7 . That the Council of the City of Cape Girardeau,
Missouri , deems and declares hereby that a public necessity exists
for the improvement of LOUIS STREET, from Montgomery to Brink
for a distance of 225 feet , by grading to the established grade
and constructing thereon an Asphaltic Concrete Pavement Surface,
three ( 3 ) inches thick and twenty ( 20 ) feet in width, with road
ditches, all as shown on the plans and specifications for said
improvement .
ARTICLE 8 . That the Council of the City of Cape Girardeau ,
i�issouri , deems and declares hereby that a public necessity exists
for the improvement of HAZEL STREET, 600 Block for a distance of
365 feet , by grading to the established grade and constructing
thereon an Asohaltic Concrete Pavement Surface, three ( 3 ) inches
thick and twenty (20 ) feet in width, with road ditches, all as
shown on the olans and specifications for said improvement .
ARTICLE 9 . That the Council of the City of Cape Girardeau ,
Missouri , deems and declares hereby that a public necessity exists
for the improvement of GIBONEY AVENUE, from Elm to Willow for a
distance of 775 feet , by grading to the established grade and
constructing thereon an Asphaltic Concrete Pavement Surface, three
( 3 ) inches thick and twenty ( 20 ) feet in width, with road ditches,
all as shown on the plans and specifications for said improvement .
ARTICLE 10 . That the Council of the City of Cape Girardeau,
Missouri , deems and declares hereby that a public necessity exists
for the improvement of DUMAIS DRIVE, West off Country Club for a
distance of 651 feet , by grading to the established grade and
constructing thereon an Asphaltic Concrete Pavement Surface, three
( 3 ) inches thick and twenty ( 20 ) feet in width, with road ditches,
all as shown on the plans and specifications for said improvement .
ARTICLE 11 . That the Council of the City of Cape Girardeau,
Missouri , deems and declares hereby that a public necessity exists
for the improvement of SECOND STREET, from Main to Water for a
distance of 286 feet , by grading to the established grade and

constructing thereon an Asphaltic Concrete Pavement Surface, three
( 3 ) inches thick and twenty ( 20 ) feet in width, with road ditches,
all as shown on the plans and specifications for said improvement .
ARTICLE 12 . That the Council of the City of Cape Girardeau,
Missouri , deems and declares hereby that a public necessity exists
for the improvement of MARY ANN, West from Brucher for a
distance of 190 feet , by grading to the established grade and
constructing thereon an Asphaltic Concrete Pavement Surface, three
( 3 ) inches thick and twenty ( 20 ) feet in width, with road ditches,
all as shown on the plans and specifications for said improvement .
ARTICLE 13 . That said improvement of Ozark Street , 0 'Connell
Drive, Maqnolia Avenue, Jasmine Lane, Nancy Lane, Montgomery
Street , Louis Street , Hazel Street , Giboney Avenue, Dumais Drive,
Second Street and Mary Ann shall be done in accordance with the
plans and specifications and estimate of cost for said improvement
prepared by the City Engineer , filed with the City Clerk, approved
and adopted by the City Council , and now on file in the Office of
the City Clerk, and in accordance with Chapter 88 , Revised
Statutes of Missouri , and all ordinances and resolutions which may
be enacted governing the construction of this particular
imarovement .
ARTICLE 14 . That the proposed work shall be done by contract ,
as provided by law and ordinance or resolution and upon completion
of the project , the cost of the proposed work, not to exceed
$10 . 00 per front foot shall be charged to the abutting property
for the issuance of special tax bills and only $10 . 00 per •front
foot shall be charged against the abutting prooerty, except such
additional cost as set out herein below which may cause said
project cost to exceed $10 . 00 per front foot for certain
properties, all in accordance with Chapter 88, RSMo and such
ordinances as may be hereafter enacted to carry out said work .
ARTICLE 15 . That individual property owners shall provide a
serviceable driveway culvert pipe as may be required for their own
driveway and that in the event that any individual property owner
fails to provide the needed driveway culvert pipe, then the City
through its contractor may provide such pipe and add the cost of
such pipe to the individual property owner ' s tax bill .
ARTICLE 16 . That the City Clerk is hereby instructed to
publish this Resolution in seven ( 7 ) consecutive issues of the
Cape Girardeau Southeast Missourian, a dailv newspaper printed and
published in the City of Cape Girardeau, Missouri . Anyone
desiring to do so may appear before the Citv Council at 7 : 30 P.M. ,
Monday, May 20 , 1991 , and be heard on the question of the
necessity of the work sought to be done .
