A RESOLUTION DECLARING IT NECESSARY TO IMPROVE THAT
PART OF STODDARD STREET, FROM PERRY AVENUE TO EAST OF
MISSOURI AVENUE; PARK AVENUE, FROM JEFFERSON TO
COUSIN; SPANISH STREET, FROM FIRST STREET TO SECOND
STREET; SPRING AVENOE, FROM THEMIS STREET SOUTH TO
OLD RAILROAD RIGHT-OF-WAY; SHARON LANE, NORTH FROM
LEAR; HILLCREST, FROM COUNTRY CLUB TO TIMON; NORTH
MIDDLE, FROM NORTH STREET TO WASHINGTON; AMETHYST
STREET, FROM FREDERICK TO MIDDLE; SCOTT STREET, FROM
PERRY TO MISSOURI ; JOHNSON STREET, FROM MAIN TO RAND;
RAND STREET, FROM GREEN ACRES DRIVE TO CAPE ROCR
DRIVE; AND SPRING AVENUE, FROM GOOD HOPE TO
BLOOMFIELD ROAD, IN THE CITY OF CAPE GIRARDEAU,
MISSOURI
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI , AS FOLLOWS :
ARTICLE l . That the Council of the City of Cape Girardeau,
Missouri , deems and declares hereby that a public necessity exists
for the improvement of STODDARD STREET , from Perry Avenue to
East of Missouri Avenue for a distance of 520 feet , by grading to
the established arade and constructing thereon an Asphaltic
Concrete Pavement Surface, three ( 3 ) inches thick and twenty ( 20 )
feet in width, with road ditches, all as shown on the plans and
specifications for said improvement .
ARTICLE 2 . That the Council of the City of Cape Girardeau,
Missouri , deems and declares hereby that a public necessity exists
for the improvement of PARK AVENUE , from Jefferson Street to
Cousin Street for a distance of 287. 5 feet , by gradinQ to the
established grade and constructinq thereon an AsphalticJConcrete
Pavement Surface, three ( 3 ) inches thick and twenty ( 20 ) feet in
width, with road ditches, all as shown on the plans and
specifications for said improvement .
ARTICLE 3 . That the Council of the City of Cape Girardeau,
Missouri , deems and declares hereby that a public necessity exists
for the improvement of SPANISH STREET, from First to Second
Street for a distance of 150 feet , by arading to the established
grade and constructing thereon an Asphaltic Concrete Pavement
Surface, three ( 3 ) inches thick and twenty ( 20 ) feet in width,
with road ditches, all as shown on the plans and specifications
for said improvement .
ARTICLE 4 . That the Council of the City of Cape Girardeau,
Missouri , deems and declares hereby that a public necessity exists
for the improvement of SPRING AVENUE , South to the Old Railroad
Right-of-way for a distance of 398, 5 feet , by grading to the
established grade and constructing thereon an Asphaltic Concrete
Pavement Surface, three ( 3 ) inches thick and twenty ( 20 ) feet in
width, with road ditches, all as shown on the plans and
specifications for said improvement .
ARTICLE 5 . That the Council of the City of Cape Girardeau,
Missouri , deems and declares herebv that a public necessity exists
for the improvement of SHARON LANE , North from Lear for a
distance of 532 . 2 feet , by grading to the established grade and
constructing thereon an Asphaltic Concrete Pavement Surface, three
( 3 ) inches thick and twenty ( 20 ) feet in width, with road ditches,
all as shown on the plans and specifications for said improvement .
ARTICLE 6 . That the Council of the City of Cape Girardeau ,
Missouri , deems and declares hereby that a public necessity exists
for the improvement of HILLCREST, from Country Club to Timon for
a distance of 782 feet , by arading to the established grade and
constructing thereon an Asphaltic Concrete Pavement Surface, three
( 3 ) inches thick and twenty ( 20 ) feet in width, with road ditches,
all as shown on the plans and specifications for said improvement .
ARTICLE 7 . That the Council of the City of Cape Girardeau,
Missouri , deems and declares hereby that a public necessity exists
for the improvement of NORTH MIDDLE, from North Street to
��ashinaton Avenue for a distance of 640 feet , by grading to the
established grade and constructing thereon an Asphaltic Concrete
Pavement Surface, three ( 3 ) incres thick and twenty ( 20 ) feet in
width, with road ditches, all as shown on the plans and
specifications for said improvement .
ARTICLE 8 . That the Council of the City of Cape Girardeau,
Missouri , deems and declares hereby that a public necessity exists
for the improvement of AMETHYST STREET, from Frederick Street to
Middle Street for a distar.ce of 370 feet , by arading to the
established grade and constructina thereon an Asphaltic Concrete
Pavement Surface, three ( 3 ) inches thick and twenty (20 ) feet in
width, with road ditches, all as shown on the plans and
specifications for said improvement .
ARTICLE 9 . That the Council of tre City of Cape Girardeau,
Missouri , deems and declares hereby that a public necessity exists
for the improvement of SCOTT STREET, from Perry Avenue to
Missouri Avenue for a distance of 338 feet , by grading to the
established grade and constructinq thereon an Asphaltic Concrete
Pavement Surface, three ( 3 ) inches thick and twenty ( 20 ) feet in
width, with road ditches, all as shown on the plans and
specifications for said improvement .
ARTICLE 10 . That the Council of the City of Cape Girardeau,
Missouri , deems and declares hereby that a public necessity exists
for the improvement of JOHNSON STREET, from Main Street to Rand
Street for a distance of 648 feet , by gradina to the established
grade and constructina thereon an Asphaltic Concrete Pavement
Surface, three ( 3 ) inches thick and twenty ( 20 ) feet in width,
with road ditches, all as shown on the plans and specifications
for said improvement .

ARTICLE 11 . That the Council of the City of Cape Girardeau,
Missouri , deems and declares hereby that a bublic necessity exists
for the improvement of RAND STREET , from Green Acres Drive to
Cape Rock Drive for a distance of 400 feet , by grading to the
established grade and constructing thereon an Asphaltic Concrete
Pavement Surface, three ( 3 ) inches thick and twenty ( 20 ) feet in
width, with road ditches , all as shown on the plans and
specifications for said improvement .
ARTICLE 12 . That the Council of the City of Cape Girardeau,
Missouri , deems and declares hereby that a public necessity exists
for the improvement of SPRING AVENUE, from Good Hope Street to
Bloomfield Road for a distance of 470 feet , by grading to the
established grade and constructing thereon an Asphaltic Concrete
Pavement Surface, three ( 3 ) inches thick and twenty ( 20 ) feet in
width, with road ditches, all as shown on the plans and
s�ecificatior.s for said improvement .
ARTICLE 13 . That said improvement of Stoddard Street , Park
P.venue , Spanish Street , Sprinq Avenue, Sharon Lane, Hillcrest ,
North Middle, Pmethyst Street , Scott Street , Johnson Street , and
Rand Street shall be done in accordance with the plans and
specifications and estimate of cost for said improvement prepared
by the City Engineer, filed with the City Clerk, approved and
adopted by the City Council , anc� now on file in the Office of the
City Clerk, and in accordance with Chapter 88, Revised Statutes of
Missouri , and all ordinances and resolutions which may be enacted
governing the construction of this particular improvement .
ARTICLE 14 . That the proposed work shall be done by contract ,
as provided by law and ordinance or resolution and upon completion
of the project , the cost of the proposed work, not to exceed
�10 . 00 per front foot shall be charged to the abuttinq property
for the issuance of special tax bills and only $10 . 00 per front
foot shall be charged against the abutting property, except such
additional cost as set out in Article 15 herein which mav cause
said project cost to exceed �10 . 00 per front foot for certain
properties, all in accordance with Chapter 88, RSMo and such
ordinances as may be hereafter enacted to carry out said work .
ARTICLE 15 . That individual property owners shall provide a
serviceable driveway culvert pipe as may be required f_or their own
driveway and that in the event that any individual property owner
fails to provide the needed driveway culvert pipe , then the City
through its contractor may provide such pipe and add the cost of
such pipe to the individual pronerty owner ' s tax bill .
ARTICLE 16 . That the City Clerk is hereby instructed to
publish this Resolution in seven ( 7 ) consecutive issues of the
Cape Girardeau Southeast Missourian, a daily newspaper printed and
published in the City of Cape Girardeau, Missouri , Anyone
desiring to do so may appear before the City Council at 7 : 30 P .M. ,

Monday, April 15, 1991, and be heard on the question of the
necessity of the work sought to be done .
