FOR A CANOPY BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI , AS FOLLOWS : ARTICLE 1 . The City Manager, for and on behalf of the City of Cape Girardeau, T�issouri , is hereby authorized to enter into an Agreement for Use of Public Right-of-Way with Dejoys of Carbondale, Inc , for a canopy on Lorimier Street . Dale De y City Clerk AGREEMENT FOR USE OF PUBLIC RIGHT-OF-WAY Comes now the City of Cape Girardeau, P�issouri , a P4unicipal Corporation, hereinafter referred to as "City" , and DeJoys of Carbondale, Inc . , her_einafter referred to as "DeJoys" and the parties enter into this Agreement for the use and occupation of a portion of public street right-of-way adjacent to DeJoys property located on the West side of Lorimier Street in Cape Girardeau, P�issouri , and more particularly described as Part of Lot 11, F.ange "E" in the City of Cape Girardeau, Missouri , under the following conditions : l . DeJoys is granted the use of the public right-of-way adjacent to the above described real estate on Lorimier Street solely for the purpose of erecting a pcst suppor_ted canopy for the East side entrance to the Royal N 'Orleans Restaurant on Lorimier Street . 2 . The parties agree that the poles supporting this canopy �aill be set back a minimum of four ( 4 ) feet nine ( 9 ) inches from the street side edge of the curb and that the canopy will not project beyond the curb line of the street . 3 . The parties agree the the pole supported canopy may be installed on the public right-of-way pursuant to this agreement, the location of which shall be as indicated on the exhibit marked �xnibit "A" and attached hereto and made part hereof by reference . 4 . DeJoys shall have the full and complete responsibility for the ins+�allation, maintenal�re and repair o!� �his canopy and the City assumes no responsibility wtiatsoever for any damage or maintenance or other expense that ir,ay be required. for the ront:inued use of this canopy. 5 . The parties hereto agree that either party may terrninate this agreement upon thirty ( 30 ) days written notice and that upon such termination the canopy shall be removed from the public right-of-way within thirty ( 30 ) days after receipt of such notice . It is agreed that De,7oys will remove the canopy should this agreement be terminated by e.ither party and shall do so at De,7oys' expense and shall r_epair and restore the sidewalk to a sa,:e c�nc�i�.:iori ior the use oi_ pedestrians. 6 . Except as provided herein for termination, this agreement shall run with the land and shall be binding upon the successors and assigns of the parties hereto. 7 . De�7oys agrees to defend, indemnify and hold the City harmless as to any and all claims or suits of whatever kind or character that may arise as a result of the placement of this canopy on the City' s right-of-way and the use of the City' s right-of-way for maintenance of this canopy pursuant to this agreement . B . DeJoys agrees to purchase and maintain during the life of this agreement a policy of general liability insurance providing coverage for DeJoys ' use of_ the street right-of-way for this canopy in a minimum amount ot �100, 000 . 00 for injury to any one person and �1, 000, 000 . 00 for personal injury in the aggregate for any one incident or accident and $100, 000 . 00 for property damage .
