AND JO ELLEN OLIVER; JAMES W. AND LINDA S. RESTER; THE NOLA M. NITSCH TRUST; JOHN AND MARY WALTHER; MICHAEL C. EVANS; MICIiAEL P. DRURY, ET AI�. AND CAPE SPECIAL ROAD DISTRICT WHEREAS, the City Council of Cape Girardeau, Missouri, is considering the annexation of certain lands to the City of Cape Girardeau, and WHEREAS, a portion of these lands are commonly known as Twin Lakes Subdivision and other of the lands are owned by Mark E. and Jo Ellen Oliver; James W. and Linda S. Kester; the Nola M. Nitsch Trust; John and Mary Walther; Michael C. Evans; Michael P. Drury, et al. and Cape Special Road District, and WHEREAS, these lands currently are contiguous to the existing city limits of Cape Girardeau, Missouri, and WHEREAS, Section 71. 015 RSMo requires the governing body of Cape Girardeau to make a determination that the land proposed to be annexed is contiguous to the existing city limits and that the length of the contiguous boundary common to the existing city limits and the proposed area to be annexed is at least fifteen per cent (15%) of the length of the perimeter of the area proposed for annexation. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: 1. That it has conducted an examination of the area proposed to be annexed, more particularly described as follows: Part of Sections 27 and 34 and U. S. Survey 2241 in Township 31 North, Range 13 East of the Fifth Principal Meridian, in the County of Cape Girardeau, Missouri, more particularly described as follows: Commencing at an Iron Pin marking the Corner to Sections 27 , 28, 33 and 34; thence South 0° 07' 06" East, along West line of Section 34 , 391. 27 feet to the point of beginning; said point of beginning also being a corner of Twin lakes Subdivision and the Southwest Corner of Country Place Subdivision; thence North 89° 18' 54" East, 417 . 25 feet to an Iron Pin, said Iron Pin being the Southeast Corner of Country Place Subdivision; thence North 0° 07 ' 06" West, 834 . 09 feet to the Northwest Corner of Twin lakes Subdivision, said point also being the Northeast Corner of Country Place Subdivision and on the South line of U.S. Survey 2241; thence North 0° 07' 06" West, 25. 00 feet to a point, said point being in a tract of land owned by Michael Drury as recorded in Book 457 on Page 807; thence North 89° 17 ' 12" East, along a line parallel and 25. 00 feet North of the North line of Twin Lakes Subdivision and the South Line of U. S. Survey 2241, 476. 8 feet plus or minus to a point in the North/South dividing line between Michael Drury as recorded in Book 457 on Page 807 and Michael C. Evans as recorded in Book 509 on Page 234 ; thence North 89° 17 ' 12" East, 466. 7 feet plus or minus to a point in the North/South dividing line between aforesaid Michael C. Evans and John and Mary Walther as recorded in Book 139 on Page 463 ; thence North 89° 17' 12" East, 127 . 3 feet plus or minus to the East Line of U.S. Survey 2241, also being the West Line of a tract of land owned by John and Mary Walther as recorded in Book 122 on Page 210; thence North 89° 17 ' 12" East, 857 . 28 feet to a point; thence leaving a parallel line to the North Line of Twin Lakes Subdivision, North 82° 11' 12" East, 333 . 48 feet to an Iron Pin, said Iron Pin being the Southwest Corner of a tract of land owned by Mid America Hotels as recorded in Book 510 on Page 484; thence North 68° 04 ' O1" East, 178 . 74 feet to a right-of-way marker, said point being the existing City Limits; thence South 23° 50' 05" West, along the existing City Limit Line, 96.71 feet to a right-of-way marker; thence South 66° 10' 01" East, along the existing City Limit Line, 209 . 99 feet to a right-of-way marker; thence South 66° 26' 15" East, along the existing City Limit Line, 189 . 95 feet to a point, said point being on the West right-of-way for I- 55; thence South 21° 17 ' 38" East, along the existing City Limit Line, 1765. 35 feet to a right-of-way marker; thence South 21° 17 ' 38" East, along the existing City Limit Line, 43 . 92 feet to a point on the South Line of the Northwest Quarter of the Northeast Quarter of Section 34 ; thence South 89° 23 ' 40" West, along said 1/16 Section Line, 1150. 12 feet to an Iron Pipe, said Iron Pipe being the Southwest Corner of the Northwest Quarter of the Northeast Quarter of Section 34 and on the East line of Twin Lakes Subdivision; thence South 0° 07' 17" West, along said East line of Twin Lakes Subdivision, 1355. 06 feet to an Iron Pin, said Iron Pin being the Southeast Corner of Twin lakes Subdivision and the Center of Section 34 ; thence South 89° 20' 07" West, along the South Line of Twin Lakes Subdivision and the South line of the Northwest Quarter of Section 34 , 2666. 15 feet to an Iron Pin, said Iron Pin being the Southwest Corner of Twin Lakes Subdivision and the West Quarter Corner of Section 34; thence North 0° 07 ' 06" West, along the West Line of Twin Lakes Subdivision and the West line of -2- Section 34 , 2332 .96 feet to the point of beginning, containing 221. 02 acres, more or less. and further that the City Council of Cape Girardeau has and does hereby determine and find that the above described land which is proposed to be annexed into the City of Cape Girardeau, Missouri, is contiguous to the existing city limits of Cape Girardeau, Missouri, and that the length of the contiguous boundary common to the existing city limits of Cape Girardeau, Missouri, and the proposed area to be annexed is more than fifteen per cent (15%) of the length of the perimeter of the area proposed for annexation.
