A RESOLUTION AUTHORIZING THE CITY MANAGER TO
PURCHASE RIGHT OF WAY FOR THE EXTENSION OF
RUST AVENUE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Manager, for and on behalf of the City of
Cape Girardeau, Missouri, is hereby authorized to purchase right of
way from the E. F. Brase Trust No. 2 , Charles Priest and Robert
Earley, Trustees, and the Rebecca Heuer Trust, Rebecca Heuer,
Trustee for the extension of Rust Avenue, more particularly
described as follows:
A tract of land in Township 30 North, Range 13 East of
the Fifth Principal Meridian in Outlot 54 of U.S. Survey
2199, in the City and County of Cape Girardeau, Missouri,
more particularly described as follows:
Commencing at a stone, said stone being the Northeast
corner of Fractional Section 12; thence South 84° 43 ' O1"
East, 138. 3 feet to a point; thence South 6° 15' 13"
West, 294 .91 feet to the point of beginning; said point
of beginning also being the centerline of an existing 60'
wide right of way to Rust Avenue; thence South 6° 15' 13"
West, along said most Western line of existing Rust
Avenue right of way, 30. 05 feet to a point, said point
also being the most Southwestern corner of an existing
right of way to Rust Avenue; thence North 87° 13 ' 03"
West, 138. 3 feet to a point, said point also being the
intersection of the South line of existing Rust Avenue
right of way and the East line of Fractional Section 12;
thence North 6° 15' 13" East along said East line of
Fractional Section 12, 30. 05 feet to a point, said point
also being the intersection of the center line of
existing Rust Avenue and the East line of Fractional
Section 12 ; thence South 87° 13 ' 03" East, 138 . 3 feet to
the point of beginning. Containing 4, 156 square feet,
more or less.
