A RESOLUTION RESCINDING RESOLUTION NO. 750 AND
DECLARING IT NECESSARY TO MAKE CERTAIN SEWER
IMPROVEMENTS IN LATERAL SEWER DISTRICT NO.
14-1-D-2 AND IN LATERAL SEWER DISTRICT NO.
14-1-D-4
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. Resolution No. 750, passed and adopted
September 9, 1992, is hereby rescinded in its entirety.
ARTICLE 2 . The City Council of the City of Cape Girardeau,
Missouri, hereby declares that a public necessity exists for making
certain sewer improvements in Lateral Sewer District No. 14-1-D-2
and in Lateral Sewer District No. 14-1-D-4 , including the
construction of a sanitary sewer eight (8) inches in diameter along
with manholes, wyes, pavement restoration and other necessary
appurtenances to serve Lateral Sewer District No. 14-1-D-2 and
Lateral Sewer District No. 14-1-D-4 . It is the intention of the
City Council to have this project done by contract and to tax bill
the property owners in Lateral Sewer District No. 14-1-D-2 and in
Lateral Sewer District No. 14-1-D-4 in an amount not to exceed
$0. 22 per square foot in accordance with applicable law.
ARTICLE 3 . The City Manager is hereby directed to file with
the City Clerk for public inspection the following:
A. The plans and specifications for the project.
B. An estimate of the total cost of the project, including
construction, construction contingency and fees and other
expenses.
C. An estimate of the portion of the total cost to be
assessed against each property to be benefitted by the
project.
ARTICLE 4 . A public hearing will be held before the City
Council at 7 : 30 P.M. on Monday, October 5, 1992 , at City Hall, 401
Independence, Cape Girardeau, Missouri at which citizens and all
interested parties may express their assent or objection to the
project.
ARTICLE 5. The City Clerk is hereby directed to publish
notice for seven (7) consecutive insertions in a daily paper that
the items set forth in Article 2 have been filed with the City
Clerk for public inspection and that a public hearing will be held
at the time and place and for the purpose stated in Article 3 .
