A RESOLUTION ACKNOWLEDGING RECEIPT OF AN
ANNEXATION PETITION AND SETTING A PUBLIC
HEARING REGARDING THE PROPOSED ANNEXATION
WHEREAS, a Petition for Annexation has been presented to the
City Council of Cape Girardeau, Missouri, requesting that certain
properties be annexed into the City Cape Girardeau, Missouri; and
WHEREAS, the Petition has been presented in accordance with
Chapter 71. 012 Revised Statutes of Missouri, which statute provides
for voluntary annexation upon request of the affected property
owners; and
WHEREAS, it is the desire of the City Council of Cape
Girardeau, Missouri, to consider whether such area should be
annexed into the City of Cape Girardeau.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1. That the City Council of Cape Girardeau, Missouri,
does hereby accept and receive a Petition for Voluntary Annexation
of certain real estate, described as follows:
WAL-MART STORES, INC.
A part of Lot 2 of Commissioners Plat of Subdivision of
United States Private Survey No. 3090, Township 30 North,
Range 13 East of the Fifth Principal Meridian, County of
Cape Girardeau, State of Missouri, being more
particularly described as follows:
Beginning at the southeast corner of Lot No. 5 of Cape
West Second Subdivision as recorded in the land records
of the County Recorders Office in Plat Book No. 16 at
Page No. 78, from which point the Southwest corner of
said Lot No. 5 bears North 86° 45' 23" West, 1014 .71
feet; thence South 04° 02' 18" West, 428 . 96 feet to the
North line of a tract of land recorded in the land
records of the County Recorders Of f ice in Book No. 3 00 at
Page No. 975; thence North 84° 43 ' 15" West, 67. 25 feet
to the Northwest corner of said tract, said point also
being the Northeast corner of a tract of land recorded in
Book No. 273 at Page No. 737, and being the true point of
beginning:
Thence South 04° 46' 05" West, 424 . 58 feet along the East
line of said tract recorded in Book No. 273 at Page No.
737 ; thence North 86° 45' 23" West, 911. 91 feet; thence
North 03° 14' 37" East, 457 .25 feet to the North line of

said tract recorded in Book No. 273 at Page No. 737;
thence South 84° 43 ' 15" East, 923 . 79 feet along said
North line to the point of beginning containing 9.29
acres more or less.
SECTION 2 . Be it further resolved that in accordance with
Chapter 71. 012 RSMo it is now ordered that a public hearing be set
for August 17, 1992 , at which hearing any interested person,
corporation or political subdivision may present evidence regarding
the proposed annexation.
SECTION 3 . It is further resolved that notice of said public
hearing be published in a newspaper of general circulation
qualified to publish legal matters not less than seven (7) days
prior to August 17, 1992 .
