A RESOLUTION AUTHORIZING THE CITY MANAGER TO
ENTER INTO AN AGREEMENT WITH MONROE PLUMBING &
HEATING FOR CONSTRUCTION OF THE UPPER CAPE LA
CROIX SEWER SYSTEM, PHASE IV, SECTION II
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Manager, for and on behalf of the City of
Cape Girardeau, Missouri, is hereby authorized to enter into an
Agreement with Monroe Plumbing & Heating for construction of the
Upper Cape LaCroix Sewer System, Phase IV, Section II. A copy of
said Agreement is attached to this Resolution and made a part
hereof.

AGREEMENT FORM

WITNESSETH:
THAT WHEREAS: in accordance with Iaw, Owner has caused Contract Documents
to be prepared and an Invitation To Bid to be published, for and in con-
nection with

WHEREAS, Contractor, in response to the Invitation To Bid, has submitted
to Qwner, in the manner and at the time specified, a sealed Bid in accor-
(� dance with Instructions To Bidders; and
WHEREAS, Owner, in the mannez prescribed by law, has publicly opened�
examined, and canvassed the Bids submitted, and has determined Contractor
to be the lowest and best Bidder for the Work and duly awarded to Contrac-
tor a contract therefor, for the sum or sums named in Contracto�r's Bid.
NOW, THEREFORE, ia consideration of the compensation to be paid to Con-
tractor and of the mutual agreements hereia contained, the parties to
these presents have agreed and hereby agree, Owner for itself and its .
successors, and Coatractor for itself, himself, or themselves, and its,
his, or their successors and assigns, and its, his, or their executors
and administrators, as follows:
ARTICLE I. Contractor shall perform all Work, including the assumption
of all obligations, duties and reponsibilities aecessary to the success-
ful completion of the contract and the furnishing of all material� and �
equipment required to be incorporated in and form a permanent part of
the Work; tools, equipment, supplies, transportation, facilities, labor,
superintendence and services required to perform the Work; and Bonds,
insurance and submittals; a11 as indicated or specified in the Contract
Documents to be performed or furnished by Contractor for the Work included

such award being based on the acceptance by Owaer of Contractor's Bid,

FINAL CHANGE ORDER
I . SCOPE
This Final Change Order covers the revisions to the Contract Documents
as described herein. This document shall be considered a vital part of
the Construction Contract for the Cape Girardeau, Missouri , Upper Cape
LaCroix Sewer System, Phase IV - Section II project that has been
executed between the Owner, The City of Cape Girardeau, Missouri , and
the Contractor, Monroe Plumbing & Neating Company of Cape Girardeau,
Missouri . Following final execution, this document will become a part
of the Contract.
II . REASONS FOR CHANGE
This Final Change Order covers changes in the scope of the Contract, and
modifies the Bid Form in the Contract Documents to reflect the actual
quantities used for construction of the Project. This Change Order also
modifies the Contract Time to reflect all adjustments in time based on
weather considerations.
III . CHANGES TO THE CONTRACT
A. CONTRACT SCOPE.
1 . UPPER CAPE LACROIX TRUNK SEWER.
l . l Item l .l , 18-inch Gravity Sewer Pipe. The quantity shall
be revised from 6,239 linear feet to 6,353.61 linear
feet. The Item Total shall be revised from $262,786.68
to $267 ,614.05.
1 .2 Item 1 .2, 15-inch Gravity Sewer Pipe. The quantity shall
be revised from 788 linear feet to 780.58 linear feet.
The Item Total shall be revised from $29,337.24 to
$29,060.99.

1 .3 Item 1 .3, 8-inch Gravity Sewer Pipe. The quantity shall
be revised from 139 linear feet to 133.45 linear feet.
The Item Total shall be revised from �3,336.00 to

1 .4 Item 2. 1 , Standard Manholes. The quantity shall be
revised from 25 to 26. The Item Total shall be revised
from $36,000.00 to $37,440.00.
1 .5 Item 2.2, Drop Manholes. The quantity shall be revised
from 5 to 4. The Item Total shall be revised from
$8,375.00 to $6,700.00.
1 .6 Item 2.3, Additional Depth. The quantity shall be
revised from 246 vertical feet to 228.61 vertical feet.
The Item Total shall be revised from �24,600.00 to
$22,861 .00.
1 .7 Item 7.7 , Asphalt Driveway. The description shall be
revised from "Asphalt Driveway, Station 127+08" to
"Gravel Driveway, Station 127+08" . The Unit Price shall
be revised from $68.60 per linear foot to $15.65 per
linear foot. The Item Total shall be revised from
$960.40 to $219. 10.
2. GOLF COURSE INTERCEPTOR SEWER
2.1 Item l . l , 8-inch Gravity Sewer Pipe. The quantity shall
be revised from 766 linear feet to 752.55 linear feet.
The Item Total shall be revised from $18,384.00 to
$18,061 .20.
2.2 Item 2.3, Additional Depth. The quantity shall be
revised from 12 vertical feet to 10 vertical feet. The
Item Total shall be revised from $1 ,200.00 to $1 ,000.00.
2.3 A new line item number 2.4 shall be added. The new line
item shall have a description "15" stubout at Station
128+55" , and shall have a lump sum value of $450.00.
3. HUMANE SOCIETY INTERCEPTOR SEWER
3. 1 Item 1 . 1 , 8-inch Gravity Sewer Pipe. The quantity shall
be revised from 1 ,072 linear feet to 1 ,075.28 linear
feet. The Item Total shall be revised from $25,728.00 to
$25,806.72.
3.2 Item 2.2, Additional Depth. The quantity shall be
revised from 10 vertical feet to 8 vertical feet. The
Item Total shall be revised from $1 ,000.00 to $800.00.

4. SAN DANGARO INTERCEPTOR SEWER
4. 1 Item 1 . 1 , 12-inch Gravity Sewer Pipe. The quantity shall
be revised from 229 linear feet to 229.98 linear feet.
The Item Total shall be revised from $8,067.67 to
$8, 102.20.
4.2 Item 1 .2, 10-inch Gravity Sewer Pipe. The quantity shall
be revised from 1 ,371 linear feet to 1 ,375.40 linear
feet. The Item Total shall be revised from $46,655. 13 to
$46,804.86.
4.3 Item 1 .3, 8-inch Gravity Sewer Pipe. The quantity shall
be revised from 305 linear feet to 324.79 linear feet.
The Item Total shall be revised from $7,320.00 to
$7 ,794.96.
4.4 Item 2. 1 , Standard Manholes. The quantity shall be
revised from 8 to 7. The Item Total shall be revised
from $11 ,520.00 to $10,080.00.
4.5 Item 2.2, Drop Manholes. The quantity shall be revised
from 1 to 2. The Item Total shall be revised from
$1 ,675.00 to $3,350.00.
4.6 Item 2.3, Additional Depth. The quantity shall be
revised from 24 vertical feet to 29.74 vertical feet.
The Item Total shall be revised from $2,400.00 to
$2,974.00.
4.7 A new line item number 10. 1 shall be added. The new line
item shall have a description "New manhole invert for
stubout at Station 6+16" , and shall have a lump sum value
of $390.00.
4.8 A new line item number 10.2 shall be added. The new line
item shall have a description "Open Cut at El Rio Drive,
Station 19+92" , and shall have a lump sum value of
$2,920.00.
4.9 A new line item number 10.3 shall be added. The new line
item shall have a description "Flap valve at Station
17+50" , and shall have a lump sum value of $240.00.
4. 10 A new line item number 10.4 shall be added. The new line
item shall have a description "Excavate storm sewers at
Station 19+92" , and shall have a lump sum value of
$205.00.
4. 11 A new line item number 10.5 shall be added. The new line
item shall have a description "Survey Roth Property at
Station 19+92" , and shall have a lump sum value of
�195.00.

4.12 A new line item number 10.6 shall be added. The new line
item shall have a description "Connect Roth Sewer at
Station 19+92" , and shall have a lump sum value of
$730.07.
B. CONTRACT TIME. The required time to complete all Work shall be extended
by 46 calendar days as a result of this Final Change Order. Therefore,
the required time to achieve Substantial Completion shall be revised
from 330 days to 376 days, and the required time to achieve Final
Completion shall be revised from 365 days to 411 days.
IV. CONTRACT PROVISIONS
A. CONTRACT PRICE. The total Contract Price shall be increased by a
total of $5,595.00 as a result of this Final Change Order. The
revised Contract Price shall be Six Hundred Forty Five Thousand,
Nine Hundred Seventy Eight and 70/100 ($645,978.70) .
B. CONTRACT TIME. The time required to achieve Substantial Completion
and Final Completion shall be increased by a total of 46 days as a
result of this Final Change Order. The revised time to achieve
Substantial Completion shall be 376 days, and the revised time to
achieve Final Completion shall be 411 days.
All other provisions of this Contract are unchanged and shall remain in
effect.
