A RESOLUTION ACKNOWLEDGING RECEIPT OF AN
ANNEXATION PETITION AND SETTING A PUBLIC
HEARING REGARDING THE PROPOSED ANNEXATION
WHEREAS, a Petition for Annexation has been presented to the
City Council of Cape Girardeau, Missouri, requesting that certain
properties be annexed into the City Cape Girardeau, Missouri; and
WHEREAS, the Petition has been presented in accordance with
Chapter 71. 012 Revised Statutes of Missouri, which statute provides
for voluntary annexation upon request of the affected property
owners; and
WHEREAS, it is the desire of the City Council of Cape
Girardeau, Missouri, to consider whether such area should be
annexed into the City of Cape Girardeau.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1. That the City Council of Cape Girardeau, Missouri,
does hereby accept and receive a Petition for Voluntary Annexation
of certain real estate, described as follows:
TRACT 1 -- UNION ELECTRIC
All that part of the Southwest Quarter of Section 13 ,
Township 31 North, range 13 East, County of Cape
Girardeau, Missouri, described as follows: Start at the
Southwest corner of Section 13 , Township 31 North, Range
13 East, and run North 89° 34' East along the South line
of said Section 13 , a distance of 26. 0 feet to the
intersection of said South line of Section 13 with the
East right-of-way line of State Route "W" for the point
of beginning; thence North 0° 56' West along said right-
of-way line 133 . 0 feet; thence South 84° 56' East, 181.0
feet to a point in the center of Cape LaCroix Creek;
thence South 26° 22' West with the center of said creek
129 .7 feet to a point in the South line of Section 13;
thence South 89° 34 ' West along said Section line 120.4
feet to the point of beginning, containing 0.435 acres
more or less.
TRACT 2 -- HAMILTON AND LAMP-HAMILTON
All that part of the West Half of the Southwest Quarter
of Section 13 , Township 31 North, Range 13 East, in the
County of Cape Girardeau, Missouri, described as follows:
Start at the Southwest corner of said Section 13 ; run
North 89° 34' East, 26.0 feet to the intersection of the
South line of Section 13 and the East right-of-way line
of State Route "W" for the point of beginning; thence
North 0° 56' West along the East right-of-way line of
Route "W", 898 . 0 feet; thence North 3° 48' West, 100. 1
feet; thence North 0° 56' West, 764 . 3 feet; thence South
89° 44' East, 515. 2 feet to a point in the center of the
Perryville Road; thence South 12° 13 ' East with the
center of said road, 467 .9 feet; thence South 7° 03'
East, 490. 0 feet; thence South 16° 22 ' West, 200.5 feet
to a point in the center of a creek; thence South 56° 22'
West with the center of said creek 276. 3 feet; thence
South 26° 22' West, 524. 0 feet to a point in the South
line of Section 13 ; thence South 89° 34' West with said
section line, 120.4 feet to the point of beginning,
except 0.435 acres conveyed to Missouri Utilities Company
by deed recorded in Book 310, Page 388 of the land
records of Cape Girardeau County, Missouri, containing
19. 525 acres, more or less.
SECTION 2 . Be it further resolved that in accordance with
Chapter 71. 012 RSMo it is now ordered that a public hearing be set
for July 20, 1992 , at which hearing any interested person,
corporation or political subdivision may present evidence regarding
the proposed annexation.
SECTION 3 . It is further resolved that notice of said public
hearing be published in a newspaper of general circulation
qualified to publish legal matters not less than seven (7) days
prior to July 20, 1992 .

PETITION FOR ANNEXATION
1. Comes now the Union Electric Company, a Missouri
Corporation, acting by C � � ��-�� �"� �' , and comes also
Thomas E. Hamilton and Cecilia A. Lamp-Hamilton, husband and wife,
and they state that they are the owners of all fee interest of
record of the following described tracts of real estate, being in
Cape Girardeau County and contiguous and compact to the existing
corporate limits of the City of Cape Girardeau, Missouri:
UNION ELECTRIC TRACT:
All that part of the Southwest Quarter of Section 13 ,
Township 31 North, range 13 East, County of Cape
Girardeau, Missouri, described as follows: Start at the
Southwest corner of Section 13 , Township 31 North, Range
13 East, and run North 89° 34' East along the South line
of said Section 13 , a distance of 26. 0 feet to the
intersection of said South line of Section 13 with the
East right-of-way line of State Route "W" for the point

2 . The Petitioners herein are desirous of having the above
described property annexed to and included within the city limits
of the City of Cape Girardeau, Missouri.
WHEREFORE, Union Electric Company, a Missouri Corporation and
Thomas E. Hamilton and Cecilia A. Lamp-Hamilton, husband and wife,
request that the City Council of the City of Cape Girardeau,
Missouri, extend the limits of the City of Cape Girardeau,
Missouri, by ordinance to include the above described real estate,
taking whatever action necessary to facilitate said annexation so

as to include said real property within the city limits of the City
of Cape Girardeau, Missouri.
