A RESOLUTION AUTHORIZING THE SUBMISSION OF AN APPLICA-
TION TO THE STATE ENVIRONMENTAL IMPROVEMENT AND ENERGY
RESOURCES AUTHORITY AND EXPRESSING THE INTENT OF THE
CITY OF CAPE GIRARDEAU, MISSOURI TO PARTICIPATE IN THE
MISSOURI LEVERAGED STATE WATER POLLUTION CONTROL
REVOLVING FUND PROGRAM.
WHEREAS, the Federal Water Quality Act of 1987, 33 U. S . C.
Section 1381 et seq• (the "Federal Act" ) , authorizes the
Administrator of the United States Environmental Protection
Agency (the "EPA" ) to make capitalization grants to states for
deposit in state water pollution control revolving funds to
provide assistance for constructing publicly owned wastewater
treatment works and for certain other purposes ; and
WHEREAS, Section 644 . 122 Revised Statutes of Missouri , as
amended ( "RSMo" ) , establishes "The Wastewater Loan Fund" in the
Treasury of the State of Missouri and requires that all moneys
received from the EPA capitalization grant program and state
matching funds be deposited in The Wastewater Loan Fund; and
WHEREAS, the State Environmental Improvement and Energy
Resources Authority, a body corporate and politic and a
governmental instrumentality of the State of Missouri �the
"Authority" ) , is authorized and empowered under the provisions
of Section 260 . 005 to 260 . 125 , inclusive, RSMo . 1986 , as
amended and Appendix B( 1) thereto (the "Act" ) , to issue bonds
and/or notes for paying the cost of any facility to be acquired
or constructed by the Authority for the purpose of preventing
or reducing pollution or disposal of solid waste or sewage,
including expenses incurred in acquiring or constructing
buildings , improvements , machinery and equipment relating to
any such pollution control project, interest expenses incurred
during the construction of any such project , and other expenses
incurred for engineering, research, legal , consulting and other
services necessary or incidental to determining the feasibility
or practicability of any such project and in carrying out the
same and, further, to acquire, construct , reconstruct , enlarge,
improve, furnish, equip, maintain, operate, lease, finance and
sell or lease such projects to any private pPrson, firm or
corporation or to any public body, political subdivision or
municipal corporation; and
WHEREAS, by resolution adopted by the Authority on
February 23 , 1988 , the Authority has heretofore approved the
development and implementation of the Missouri Revolving Fund
and Local Share Water Polution Control Facilities Financing
Program, which Program is now referred to as the Missouri
Leveraged State Water Pollution Control Revolving Fund Proqram
(the "SRF Program" ) and has stated its intent to issue its
bonds or notes to finance projects pursuant ot the SRF
Program, said bonds or notes to be payable solely out of the
revenues and receipts derived by the Authority in connection
with such projects; and
WHEREAS, the City of Cape Girardeau, Missouri (the "City" )
wishes to submit a Request for Financing (the "Application" ) to
the Authority for participation in the SRF Program and
requesting the Authority to issue its bonds or notes in a
principal amount set forth in the Application in accordance
with the SRF Program to provide funds to finance the costs of
construction of certain wastewater treatment, sanitary sewerage
and water pollution control facilities described in the
Application (the "Project" ) to be constructed by the City for
the purpose of preventing or reducing pollution; and
WHEREAS, the City represents that the Project will be in
furtherance of applicable federal and state standards and
regulations with respect to the control of water pollution or
the disposal of sewage .
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF CAPE GIRARDEAU, MISSOURI , AS FOLLOWS :
Section l . That the City hereby finds and determines that
the participation by the City of the SRF Program to finance the
costs of construction of the Project is in the public interest
and within the power and authority vested in the City, in that
the Project constitutes facilities for the reduction or preven-
tion of water pollution and the financing of the costs of con-
struction of the Project will result in reducing the overall
costs to the City for the construction of the Project , and will
provide for the public health, safety and welfare of the resi-
dents of the City by promoting, developing and assisting in the
construction of wastewater treatment , sanitary seweraqe and
water pollution control facilities by the City. The City
hereby expresses its intent to participate in the SRF Program
as described in the Application.
Section 2 . That the Mayor, City Clerk or City Manager of
the City are hereby authorized to submit the Application to the
Authority in accordance with the SRF Program requesting financ-
ing in a principal amount set forth in the Application, to
provide funds to finance the costs of construction of the
Project , and to receive a loan from the Wastewater Loan Fund.
Section 3 . That the Mayor, the City Clerk and the City
Manager are hereby authorized to take such further actions as
may be necessary or desirable to implement the intent of this
Resolution.
