A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE AN AGREEMENT TO RENEW AN AGRICULTURAL
LEASE WITH ROBERT J. NIEDERKORN, AT THE CAPE
GIRARDEAU MUNICIPAL AIRPORT
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Manager, for and on behalf of the City of
Cape Girardeau, Missouri, is hereby authorized to execute an
Agreement to Renew an Agricultural Lease with Robert J. Niederkorn,
at the Cape Girardeau Municipal Airport. A copy of said Agreement
is attached to this Resolution and made a part hereof.

AGREEMENT TO RENEW AGRICULTURAL LEASE
This Agreement, made and entered into this day of
, 1994 , by and between the City of Cape Girardeau,
Missouri, a Municipal Corporation, hereinafter referred to as
"Lessor" and Robert J. Niederkorn, 221 Vicki Lynn Circle, Scott
City, Missouri 63780, hereinafter referred to as "Lessee" ;
IN CONSIDERATION OF THE MUTUAL COVENANTS CONTAINED HEREIN, THE
PARTIES AGREE AS FOLLOWS:
1. The parties have previously entered into an Agricultural
Lease for farming operations on certain land owned by the City and
located at the Municipal Airport in Scott �County, Missouri, dated
February 21, 1990.
The original Lease was for a period of five (5) years and
is due to expire December 31, 1994.
2 . By the terms of the Agricultural Lease previously entered
into, either party may renew the Lease for an additional term of
f ive (5) years.
3 . Lessee has indicated in writing that he intends and
desires to execute his option to renew the Lease and the parties
now therefore agree to renew the Agricultural Lease dated February
21, 1990 for an additional term of five (5) years to expire
December 31, 1999.
4 . Because of anticipated construction on the airport
property, an area previously included in the Agricultural Lease
dated February 21, 1990, is now hereby excluded from this Agreement
to Renew the Agricultural Lease for the period January l, 1995
through December 31, 1999 . The following area comprising 16.9

acres is hereby excluded from this Agreement. The area generally
described as being situated south and east of the General Aviation
Apron and north of Taxiway "C" . The eastern boundary of said area
begins at the easternmost line of the Taxiway Clearance Zone on
Taxiway C, said line being 65 feet from the centerline of said
taxiway; thence extending north to the south right-of-way line of
the proposed access road to the proposed Corporate Parcels on the
south side of the General Aviation Apron, said south right-of-way
line being 260 feet, more or less, from the south edge of the
General Aviation Apron; thence extending east and then north with
the right-of-way line of the said proposed access road to the
airport property line, said line also being the southwest right-of-
way line of Interstate 55. The area hereby excluded is also
illustrated on Exhibit "B" attached hereto.
5. In all other respects, all other terms and conditions of
the Agricultural Lease remain unchanged.
