A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE A CONTRACT WITH THE DEPARTMENT OF
PUBLIC SAFETY, MISSOURI DIVISION OF HIGHWAY
SAFETY FOR A TEAM SPIRIT TRAINING CONFERENCE
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE l. The City Manager, for and on behalf of the City of
Cape Girardeau, Missouri, is hereby authorized to execute a
Contract with the Department of Public Safety, Missouri Division of
Highway Safety, for a team spirit training conference. A copy of
said Contract is attached to this Resolution and made a part
hereof.

It is mutually agreed by the parties executing this contract to the following: the reimbursable costs shall
not exceed $2,000 ;the recipient of funds shall proceed with the Implementation of the program
as detailed in attached forms which become part of this agreement and shall adhere to conditions
specified in attachments which become part of this agreement; all Federal and State of Missouri laws and
regulations are applicable, and any addendums or conditions there to, shall be binding; any facilities
and/or equipment acquired in connection with this agreement shall be used and maintained for highway
safety purposes; the recipient of funds must comply with Title VI of the Civil Rights Act of 1964, and
Federal funds form other sources, excluding Federal Revenue Sharing Funds, will not be used to match
the Federal funds obligated to this project.

CONTRACT CONDITIONS 94-YA-03-17
IN ORDER TO RECEIVE FEDERAL FUNDING, THE GRANTEE/CONTRACTOR AGREES TO COMPLY WITt%THE FOLLOWING
CONDITIONS IN ADDITION TO THOSE OUTLINED IN THE NARRATIVE OF THE CONTRACT.
I. RELATIONSHIP: The relationship of the Grantee/Contractor to the MDHS (Missouri Division of Highway Safety)shall be that of an
independent contractor, not that of a joint enterpriser. The GranteelContractor shall have no authority to bind the MDHS for any
obligation or expense without the express prior written approval of the MDHS.
II. EQUIPMENT
A. PROCUREMENT: Grantees may use their own procurement regulations which reflect applicable state and local laws, rules
and regulations provided they also adhere to the following:
1. Equipment with a cost of$1,000.00 or more must be purchased on a competitive bid basis, or purchased through use of
state cooperative procurement;
2. Price or rate quotations shall be solicited from at least three (3)qualified sources;
3. All procurement transactions, regardless of whether by sealed bids or by negotiation, shail be conducted in a manner that
provides maximum open and free competition;
4. Grantees shall have a clear and accurate description of the item to be purchasad. Such description shal�not, in competi-
tive procurements,contain features which unduly restrict competition. A"brand name or equal"description may be used
as a means to define the performance or other requirement of a ptocurement;
5. If for some reason the low bid is not acceptable,the grantee must have written approval from the Director of MDHS prior to
the purchase of other than the low bid. '
B. DISPOSITION: The Grantee/Contractor shall make written request to MDHS for instructions on the proper disposition of all
items of equipment provided under the terms of this contract.
C. REPLACEMENT: No equipment may be funded on a replacement basis. Participation in equipment and manpower projects
must be in addition to the grantee's previous twelve months authorized strength.
ill. FISCAL RESPONSIBILITY
A. MAINTENANCE OF RECORDS: The Grantee/Contractor agrees that MDHS,the National Highway Traffic Safety Administra-
tion,the Federal Highway Administration and/or any Federal audit agency with jurisdiction over this program,the Auditor of the
State of Missouri or any of their duly authorized representatives may have access,for purpose of audit and examinations,to
any books, documents, papers or records maintained by the Grantee/Contractor pertaining to this contract and the Grantee/
Contractor further agrees to maintain such books and records for three years after the date of final project disposition.
B. PAYMENT SCHEDULE: The MDHS agrees to reimburse the Grantee/Contractor for accomplishment of all authorized
activities performed under this contract. Reimbursement proceedings will be initiated upon the receipt of a claim voucher and
supporting documentation from the Grantee/Contractor, as required by the MDHS. Vouchers received by MDHS after the
seventh day of each month cannot be processed until the following month. Final payment is contingent upon receipt of
final voucher and supporting documentation no later than thirty(30)days after the closing date of the contract.
C. AUDITS: Grantee/Contractor will be responsible for the required financial and compliance audit. The audit should be per-
formed within two years of the final financial transaction of this contract, as required by OMB Circular A-128 (or A-133 for
institutions of higher education). Failure to furnish an acceptabie audit may be basis for refunding federal funds.
IV. TERMINATION: If,through any cause,the Grantee/Contractor shall fail to fulfill in timety and proper manner its obligation under
this contract, or'rf the Grantee/Contractor shall violate any of the covenants, agreements or stipulations of this contract,the MDHS
shall thereupon have the right to terminate this contract and withhold further payment of any kind by giving written notice to the
Grantee/Contractor of such termination and specifying the effective date thereof, at least thirry (30) days before such date. MDHS
shall be the sole arbitrator of whether the Grantee/Contractor or its subcontractor is performing fts work in a proper manner with
reference to the quality of work performed by the Grantee/Contractor or its subcontractor under the provisions of this contract. The
Grantee/Contractor and the MDHS further agree that this contract may be terminated by either party by giving written notice of such
termination and spec'rfying the effective date thereof, at least thirty (30) days before such date.
V. STATUTORY REClUIREMENTS
A. COMPLIANCE: The Grantee/Contractor agency must comply with the following Statutes or Rules:
1. Peace Officer Standards and Training (P.O.S.T.)Certification—RSMo 590-100 through 590-180—Department of Public
Safety certification of peace officers
2. Traffic Accident Reporting Thresholds—RSMo 43.250—Law enforcement agency to file accident report with Missouri
State Highway Patrol
3. Nondiscrimination—CFR Chapter 50—Prohibits discrimination on the basis of race,color, religion, sex or national origin
including DBE and Segregated Facilities (Meets or exceeds Attachment A)
B. ENACTMENT AND ENFORCEMENT: Priority will be given to the Grantee/Contractor whose projects will incorporate
activities which reduce traffic crashes involving 16-20 year old drivers,alcohol and speed related crashes,and
that enforces a local ordinance(where ordinance making authority exists)which meets or exceeds the following:
1. Model Traffic Ordinance—RSMo 300.00—Rules governing traffic administration and regulation
2. Child Restraints—RSMo 210.104—Passenger restraint system required for children under four (Primary Offense)
3. Seat Belts—RSMo 307.178—Seat belts required for passenger cars (secondary offense)
4. Open Container—A model ordinance prohibiting the transportation of an open container of alcoholic beverages in a
motor vehicle or the possession of alcoholic beverages in public places.

The fact that younger drivera have long been foun.d to be overinvolved in alcohol
and other drug-related motor vehicle cra�hes ha� remained unchang�d.
Natianal�y, dxiver� b�tween the age� af 16 and 21 ac�ount fnr the �ar�eet
proportion (90% - ��%) of all ir�junea and fatal crashe�, In Mis�ouri, driver�
under 2� year� of age accaunt for 28,6°k af all crashe�, and 24.2�'0 of all fatal
crashe�. Mator vehicle acGident reports indicate that drin.king anc�/or drug usage
was a key factor in many of the�e crashes.
Teenage drivers have different driving beha�►iors when drinl�ing than do their
more mature Caunterparts. Teenagere tend to drink while driving in their care
(crui�ing) while adults tend ta drink in bars, nightclubs, and privat,e homes,
Teenagexs tend to drive faster and take mora chances when impaired; adult� tend
to elow down and became mare cautxous in ordex to compensate for thair
impaxrment. In alcohal-related craeh.es, teenagers are more aikely ta have 3 ar 4
pageengere with them while the average for adults ie 1.4 per car.
The 1993 Missouri Traffic Safety Compendium indicates that Cape Grirardeau
County rank� tenth in the s�ate for young driver involved craehes. meene in thie
area currently have no appropriate training program� available to help them
addrees, and work toward resolving, youth drinking and driving problem�,
DESCRIP'1'I�N
The Division of Highway Safety will fund one 3-day regional meam Spirit Training
Conference thraugh the Cape Girardeau Cammunity Traffic Safety Frogxam.
The current Caordinator wiil ca-coordinate this project with an addit,ional part-
ti�.e coordinator to be employed epecifica,lly for thi� project.
The Tearn Spirit Frogram w�.s develaped in 1889 as a Nationai pragram and w��
designed by the National Highway Traffac Safety Admini�tration (NHTSA) and
Of'�ice of Ju�renile Justiee and Delinquency Prevention (OJJDP) for this purpose.
Beginning in 1991, Mathers Again�t Drux�k Driving tMA�I7) took a lead role in
�ponsuring Team Spirit an.d continue� that commitment a� part of MADD's
Yauth Pragrame,
The Teazn Spirit program, i� deeigned to empower hi�h �chool-aged youth to take
an active role in preventing alcohol and other drug use and impaired driving by
theix peera, It is b�sed on the belief that youth themselvea can become a potent
force �n combating aubstance use among other youth. Through their involvement
in thie program, Team Spirit member� �trengthen f,heir individua� reeolve and
capacity to rems.in free of alcohol and other drugs. Working togethez', they
become effective agents of poeitive change withi.n their �chools and comxn�uriitiee.

The 'Team Spirit model ig designed to develop natural leadership �kills� aa well ae
ather skilla; to explore �nowledge, atti�tude� and behaviar related to substance use
and imp�.ired drivi.ng; and to pxamata prevention and alternative activi.tiee,
actually enabling young peaple to plan and carry out several epecial projects
during the echool ye�r. A.s a re�ult, the program has the potential to have positive
effecte not only on the participants themselveg, but on their echool� and the wider
community, a� well.
OB�CTIVE
The objective of�,kie Team Spirit Tra�z�ing is to provide specific information to
increase awarenege of 12 area High Schaol teanas (each team is made up of 6�10
�tudent� and 2 advi�or�) in the specific area� of:
• alcohol and drug in�'arma�ion
• the effect o£alcahal and other drugs on dri�*ing skills
• the value of seat belt u�age
• leadership �kills
• action planning
• pxogr�m implementatian strategies
�

The program will be evaluated by the Missouri Division of Highway Safety and the
Coordinators of the Team Spirit Conference based on approved evaluation
measures. The evaluation form will be submitted for approval to the Missouri
Division of Highway Safety by January 1, 1995.
