The City Manager, for and on behalf of the City of Cape Girardeau, Missouri, is hereby authorized to execute an Agreement to Provide Special Heavy Rescue Services with the County of Cape Girardeau, Missouri and the City of Jackson, Missouri. ' � AGREEMENT TO PROVIDE �- SPECIAL HEAVY RESCUE SERVICES THIS AGREEMENT made this 8th day of Sep�ember , 1994, by and among the COUNTY OF CAPE GIRARDEAU, MISSOURI, the CITY OF CAPE GIRARDEAU, MISSOURI and the CITY OF JACKSON, MISSOURI. In consideration of the mutual covenants, terms and conditions hereinafter set forth, the parties agree as follows: 1. The parties previously entered into a similar Contract dated May 8, 1986, which remains in effect and will expire by its own terms in 1996. 2 . The City of Cape Girardeau shall provide specialized heavy rescue services throughout Cape Girardeau County. Examples of these services shall include (but not be limited to) : vehicle extrication, farm machinery extrication, cave-ins, industrial accidents, entrapped persons, and other related incidents. 3 . The City of Cape Girardeau shall apprise all agencies providing law enforcement, fire protection or ambulance services within Cape Girardeau County of the availability and proper manner of requesting emergency extrication service. 4. The City of Cape Girardeau shall p�zrchase an additional rescue vehicle which will be available for use in performing emergency extrication service. 5. The County of Cape Girardeau shall pay the City of Cape Girardeau the sum of Fifty Thousand Dollars ($50, 000. 00) within thirty (30) days of notification by the City of Cape Girardeau that it has received delivery of the aforementioned rescue vehicle. 6. The City of Jackson shall provide police and fire support services whenever the City of Cape Girardeau provides emergency extrication service within the city limits of the City of Jackson. 7. The City of Jackson shall pay the City of Cape Girardeau the sum of One Thousand Five Hundred Dollars ($1, 500. 00) no later than June 1 of each year this contract is in effect, except that the City of Jackson's payments will not start until such time as the City of Cape Girardeau acquires the additional vehicle. 8. The City of Cape Girardeau shall not be liable to the County of Cape Girardeau or the City of Jackson for failure to respond to any call or for delay or negligence or mistake in receiving or responding to any call nor shall this agreement be interpreted as being an agreement for the benefit of any third party. 9. This agreement shall be in effect for a period of ten (10) years from and after its execution. . � 10. If for some reason the City of Cape Girardeau�� cannot fulfill the obligations of this agreement for the full term,' due to a change in law or for other reason, the City of Cape Girardeau will refund to the County of Cape Girardeau a pro rata proportion of County's original payment for the period of time the agreement was unable to be completed. Section 5 of the agreement states that the County shall pay to the City of Cape Girardeau the sum of $50,000 within thirty days of notification by the City that it has received delivery of an additional heavy rescue unit. This letter serves as notification that the heavy rescue unit has been received and placed into service by the City of Cape Girardeau, and we are now requesting payment of$50,000.
