A RESOLUTION ACKNOWLEDGING RECEIPT OF AN
ANNEXATION PETITION AND SETTING A PUBLIC
HEARING REGARDING THE PROPOSED ANNEXATION
WHEREAS, a Petition for Annexation has been presented to the
City Council of Cape Girardeau, Missouri, requesting that certain
properties be annexed into the City of Cape Girardeau, Missouri;
and
WHEREAS, the Petition has been presented in accordance with
Chapter 71. 012 Revised Statutes of Missouri, which statute provides
for voluntary annexation upon request of the affected property
owners; and
WHEREAS, it is the desire of the City Council of Cape
Girardeau, Missouri, to consider whether such area should be
annexed into the City of Cape Girardeau.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
SECTION 1. That the City Council of Cape Girardeau, Missouri,
does hereby accept and receive a Petition for Voluntary Annexation
of certain real estate, described as follows:
CAPE SPECIAL ROAD DISTRICT, a Political Subdivision of
the State of Missouri, actinq by C. Andy Juden, Jr. ,
Chairman of its Board of Commissioners
All of that part of United States Private Survey Number
797, Township 30 North, Range 13 East of the Fifth
Principal Meridian, in the County of Cape Girardeau,
State of Missouri, being commonly known as the Bloomfield
Road, lying from the South line of Stonebridge
Subdivision at the present (June 23 , 1994) city limits of
the City of Cape Girardeau, to a point 45 feet South of
the intersection of the centerlines of the Bloomfield
Road and the Old Jackson-Benton Road, and all of what is
commonly known as the Old Jackson-Benton Road, lying from
the intersection of the centerlines of the Bloomfield
Road and the Old Jackson-Benton Road, Westerly
approximately 1500 feet to the West line of the Thomas H.
Froemsdorf and Mary E. Froemsdorf Tract, said tract being
recorded in the land records of Cape Girardeau County, at
deed book 455, pages 270 to 271.
SECTION 2 . Be it further resolved that in accordance with
Chapter 71. 012 RSMo it is now ordered that a public hearing be set
for August 1, 1994, at which hearing any interested person,

corporation or political subdivision may present evidence regarding
the proposed annexation.
SECTION 3 . It is further resolved that notice of said public
hearing be published in a newspaper of general circulation
qualified to publish legal matters not less than seven (7) days
prior to August 1, 1994 .
