A RESOLUTION QUALIFYING THE CITY OF CAPE
GIRARDEAU, MISSOURI TO EXERCISE RATE
REGULATORY JURISDICTION IN MATTERS PERTAINING
TO CABLE TELEVISION SERVICE
WHEREAS, the City of Cape Girardeau, Missouri, is a
"Franchising Authority" pursuant to Federal Statutes and as a
Franchising Authority, the City of Cape Girardeau, Missouri, is
empowered by Federal law to seek to exercise regulatory
jurisdiction over basic tier cable television rates.
WHEREAS, the City of Cape Girardeau, Missouri, desires to
obtain approval by the Federal Communications Commission to
exercise its statutory regulatory jurisdiction relative to cable
television rates.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City of Cape Girardeau, Missouri, will adopt
and administer regulations with respect to the rates subject to
regulation under appropriate Federal Statutes that are consistent
with the regulations prescribed by the Federal Communications
Commission, all pursuant to Section 623 of the 1992 Cable Act.
ARTICLE 2 . The City of Cape Girardeau, Missouri, has the
legal authority to adopt and the personnel to administer such
regulations.
ARTICLE 3 . The procedural laws and regulations applicable to
rate regulation proceedings by the City of Cape Girardeau,
Missouri, provide a reasonable opportunity for a consideration of
the views of interested parties.
ARTICLE 4. The City Clerk is directed to certify a copy of
this Resolution for filing with the Federal Communications
Commission and to provide a certified copy of this Resolution to
TCI Cablevision of Missouri, Inc.
