A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A GRANT AGREEMENT WITH THE FEDERAL AVIATION ADMINISTRATION FOR IMPROVEMENTS AT THE CAPE GIRARDEAU MUNICIPAL AIRPORT BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1. That J. Ronald Fischer, City Manager, is hereby authorized to execute, for and on behalf of the City of Cape Girardeau, Missouri, a Grant Agreement with the Federal Aviation Administration, Project No. 3-29-0013-07 to renovate the terminal building, rehabilitate the terminal parking lot, construct a portion of the water system for fire protection, and rehabilitate the general aviation apron, at the Cape Girardeau Municipal Airport. A copy of said Agreement is attached to this Resolution and made a part hereof. ARTICLE 2 . That the City Manager is hereby authorized and directed to provide all other necessary documents pertaining to this Grant Agreement. Conrad, Deputy City Clerk , Page 1 of 6 pages U.S. DEPARTMENT OF TRANSPORTATION FEDERAL AVIATION ADMINISTRATION GRANT AGREEMENT Part 1 - Offer � Date of Offer Q�� 3 1 1993 Cape Girardeau Municipal Airport/Planning Area Project No. 3-29-0013-07 Contract No. DTFA09-93-A-40049 T0: City of Cape Girardeau, Missouri (herein called the "Sponsor") FROM: The United States of America (acting through the Federal Aviation Administration, herein called the "FAA") WHEREAS, the Sponsor has submitted to the FAA a Project Application dated August 25, 1993, for a grant of Federal funds for a project at or associated with the Cape Girardeau Municipal Airport/Planning Area which Project Application, as approved by the FAA, is hereby incorporated herein and made a part hereof; and WHEREAS, the FAA has approved a project for the Airport or Planning Area (herein called the "Project") consisting of the following: Renovate terminal building; rehabilitate terminal parking lot; construct portion of water system for fire protection; rehabilitate general aviation apron (approximately 1,000 s.y. ) , all as more particularly described in the Project Application. FAA Form 5100-37 (8-90) Page 2 of 6 pages NOW THEREFORE, pursuant to and for the purpose of carrying out the provisions of the Airport and Airway Improvement Act of 1982, as amended, herein called the "Act, " and/or the Aviation Safety and Noise Abatement Act of 1979, and in consideration of (a) the Sponsor' s adoption and ratification of the represen- tations and assurances contained in said Project Application and its acceptance of this Offer as hereinafter provided, and (b) the benefits to accrue to the United States and the public from the accomplishment of the Project and compliance with the assurances and conditions as herein provided, THE FEDERAL AVIATION ADMINISTRATION, FOR AND ON BEHALF OF THE UNITED STATES, HEREBY OFFERS AND AGREES to pay, as the United States' share of the allowable costs incurred in accomplishing the Project, ninety percent (90�) as pertains to apron rehabilitation and eligible portions of water system construction, eighty-five percent (85X) as pertains to rehabilitation of terminal parking lot, and seventy-five percent (75X) as pertains to eligible portions of the terminal. This Offer is made on and subject to the following terms and conditions: Conditions 1. The maximum obligation of the United States payable under this offer shall be $282,289. For the purposes of any future grant amendments which may increase the foregoing maximum obligation of the United States under the provisions of Section 512(b) of the Act, the following amounts are being specified for this purpose: $ -0- for planning $2g2,289 for airport development or noise program impleraentation. 2. The allowable costs of the project shall not include any costs determined by the FAA to be ineligible for consideration as to allowability under the Act. 3. Payment of the United States' share of the allowable project costs will be made pursuant to and in accordance with the provisions of such regulations and procedures as the Secretary shall prescribe. Final determination of the United States share will be based upon the final audit of the total amount of allowable project costs and settlement will be made for any upward or downward adjustments to the Federal share of costs. 4. The Sponsor shall carry out and complete the Project without undue delay and in accordance with the terms hereof, and such regulations and procedures as the Secretary shall prescribe, and agrees to comply with the assurances which were made part of the project application. 5. The FAA reserves the right to amend or withdraw this offer at any time prior to its acceptance by the Sponsor. 6. This offer shall expire and the United States shall not be obligated to pay any part of the costs of the project unless this offer has been accepted by the Sponsor on or before September 24, 1993, or such subsequent date as may be prescribed in writing by the FAA. The Sponsor shall take all steps, including litigation if necessary, to recover Federal funds spent fraudulently, wastefully, or in violation of Federal antitrust statutes, or misused in any other manner in any project upon which Federal funds have been expended. For the purposes of this Grant Agreement, the term "Federal funds" means funds however used or disbursed by the Sponsor that were originally paid pursuant to this or any other Federal Grant Agreement. It shall obtain the approv- al of the Secretary as to any determination of the amount of the Federal share of such funds. It shall return the recovered Federal share, including funds recovered by settlement, order, or judgment, to the Secretary. It sha11 furnish to the Secretary, upon request, all documents and records pertaining to the determination of the amount of the Federal share or to any settlement, litigation, negotiation, or other efforts taken to recover such funds . A11 settlements or other final positions of the Sponsor, in court or otherwise, involving the recovery of such Federal share shall be approved in advance by the Secretary. 8. The United States shall not be responsible or liable for damage to property or injury to persons which may arise from, or be incident to, compliance with this Grant Agreement. 9. The Sponsor agrees to perform the following: a. Furr.ish a construction management program to FAA prior to the start of construction, which shall detail the measures and procedures to be used to comply with the quality control provisions of the con- struction contract, including, but not limited to, all quality control provisions and tests required by the Federal specifica- tions. The program shall include as a minimum: 1) The name of the person representing the Sponsor who has overall responsibility for contract administration for the project and the authority to take necessary actions to comply with the contract. 2) Names of testing laboratories and consulting engineer firms with quality control responsibilities on the project, together with a description of the services to be provided. 3) Procedures for determining that testing laboratories meet the requirements of the American Society of Testing and Materials standards on laboratory evaluation, referenced in the contract • specifications (D 3666, C 1077) . 4) Qualifications of engineering supervision and construction inspection personnel. 5) A listing of all tests required by the contract specifications, including the type and frequency of tests to be taken, the method of sampling, the applicable test standard, and the acceptance criteria or tolerances permitted for each type of test. FAA Form 5100-37 (8-90) Page 4 of 6 pages 6) Procedures for ensuring that the tests are taken in accordance with the program, that they are documented daily, that the proper corrective actions, where necessary, are undertaken. b. Submit at completion of the project, a final test and quality control report documenting the results of a11 tests performed, highlighting those tests that failed or did not meet the applicable test standard. The report shall include the pay reductions applied and reasons for accepting any out-of-tolerance material. An interim test and quality control report shall be submitted, if requested by the FAA. c. Failure to grovide a complete report as described in paragraph b, or failure to perform such tests, shall, absent any compelling justification, resulting in a reduction in Federal participation for costs incurred in connection with construction of the applic- able pavement. Such reduction shall be at the discretion of the FAA and will be based on the type or types of required tests not performed or not documented and will be commensurate with the proportion of applicable payment with respect to the total pavement constructed under the Grant Agreement. d. The FAA, at its discretion, reserves the right to conduct indepen- dent tests and to reduce grant payments accordingly if such independent tests determine that Sponsor test results are inaccurate. 10. The Sponsor agrees that unless otherwise approved by the FAA, it will not acquire or permit any contractor or subcontractor to acquire any steel or manufactured products produced outside the United States to be used for any project for airport development or noise compatibility for which funds are provided under this grant. The Sponsor will include in every contract a provision implementing this special condition. 11. It is understood and agreed by and between the parties hereto that any reference herein or in the aforesaid Application for Federal Assistance dated August 25, 1993, to plans and/or specifications which pertain to terminal renovation shall refer to plans and/or specifications as approved by the FAA on November 1, 1991, and as pertains to water systems and parking lot rehabilitation shall refer to plans and/or specifications as approved by the FAA on March 24, 1993. It is further understood and agreed that this Grant Offer is made and accepted on the basis of preliminary plans and/or specifications for all work pertain- ing to apron rehabilitation, and the parties hereby covenant and agree that by June 1, 1994, the Sponsor shall furnish such final plans and/or specifications to the FAA and that there shall be no advertisement for bids for acquisition of equipment or accomplishment of such work and no commencement of such work until the final plans and/or specifications, therefore, have been approved by the FAA. The parties do hereby fur- ther covenant and agree that any reference made in this Grant Offer or in the aforesaid Project Application to plans and/or specifications for said apron rehabilitation shall be considered as having reference to said final plans and/or specifications as so approved. For purposes of computing the United States' share of the allowable project costs, the allowable cost of the terminal renovation and the water system for fire protection included in the project shall not exceed 68.89X of actual costs. The allowable project cost portion (68.89�) is limited to the percentage of the terminal building which serves public access areas. Therefore, 31.11X of total allowable costs of the terminal building and water system is ineligible for any Federal participation. The parties hereto understand and agree that Federal participation as pertains to renovation of the terminal building (at the rate of 75X as hereinbefore set forth) shall be 52I (75X x 68.89% = 52�) , and construction of a water system for fire protection (at the hereinbefore stated rate of 90Z) shall be 62I (90z x 68.89z = 62L) . FAA Form 5100-37 (8-90) Page 6 of 6 pages The Sponsor' s acceptance of this Offer and ratification and adoption of the Project Application incorporated herein shall be evidenced by execution of this instrument by the Sponsor, as hereinafter provided, and this Offer and Acceptance shall comprise a Grant Agreement, as provided by the Act, consti- tuting the contractual obligations and rights of the United States and the Sponsor with respect to the accomplishment of the Project and compliance with the assurances and conditions as provided herein. Such Grant Agreement shall become effective upon the Sponsor' s acceptance of this Offer. The FAA participation was 75% of the costs of eligible public azeas of the building. Based upon this cost sharing formula, the FAA's cost sharing for the terminal building was $428,499.00 and pazking lot improvement was $0.00. The 1993 Federal airport development funding legislation passed during the 1992 congressional session included a revised funding formula for FAA participation in costs of passenger terminal development. Three issues were addressed. 1. FAA financial participation in the public areas of terminal buildings was increased to include a more liberal calculation of eligible costs. 2. FAA participation in the cost of vehiculaz parking lots providing free pazking for the public using a passenger ternunal building was increased from zero to 85 percent of eligible costs. 3. Although the legislation enabled FAA cost participation in airport development for fiscal year 1993, the revised funding formula was made retroactive to include projects begun in 1992. The total cost of the Terminal Building to date is as follows: $923,770 --- Construction Costs 77,300 --- Design Costs 53,900 --- Construction Inspection $1,054,970 --- Total Project Cost FAA Fundable Area = 68.89% (per letter from Mr. Doug Johnson dated 3-17-93) FAA Funding Level of Terminal Buildings = 75% Based on this new funding levels the FAA's fundable portion of the Terminal has increased to $545,077. This is an increase of 116 578 from the original funding and will be the aznount that is requested in this grant application as Terminal Building Reconstruction, Phase II Funding. The parking lot improvements requested in this application are portions of the original pazking lot improvements funded under the FAA AIP Grant No. 3-29-0013-04, but were not considered eligible under old legislation. The estimate for this work is $64,669. Federal participation is 85% of this cost. Due to new legislation, the increase in Federal Funds requested is 54 969. ITEM 3 - FIRE PROTECTION WATER SYSTEM The City of Cape Girardeau requires that building design and construction conform to the BOCA National Building Code for public safety. This code requires that public transportation terminal facilities be equipped with an automatic water-supplied sprinkler system. The terminal building project includes a sprinkler system in conformance with the BOCA code. The National Fire Protection Association Standard on Construction and Protection of Airport Terminal Buildings states: "Fire hydrants shall be provided on both the ramp and street sides of airport terminal buildings. Such hydrants shall be located so that no portion of the terminal building is more than 500 ft. from a hydrant. "Water supply from public or private sources shall be adequate to supply maximum calculated sprinkler demand plus a minimum of 500 gal. per minute for hose streams. Where sprinklers are not provided, a minimum of 1000 gal. per minute at not less than 20 psi residual pressure shall be provided to supply fire department pumpers. The supply shall be available at the rate specified for a period of at least one hour." The calculated sprinkler demand is 150 gallons per minute, or a minimum of 650 gallons per minute for both sprinklers and hose streams. The existing airport water supply consists of two 100-gallon per minute wells and two 300-gallon pressure tanks and cannot supply the required rates of fire flow water. The City of Cape Girardeau potable public water supply system is several miles from the airport and would be quite expensive to extend to the airport. Studies by the City have resulted in the conclusion that the most cost effective, dependable, and adequate source of water for fire protection at the airport is the extensiori of an existing fire protection system into the airport frontal area. The portion of this system funded under this grant is that which is under the proposed parking lot improvements. This project will result in separate systems for fire flow and potable water. An advantage of this project is that the water main constructed and dedicated to fire flow can, at some future date, become part of the City water system when the City system is extended to the industriaUairport �azea. The FAA funding level will be at 85% of 68.89% (from terminal building funding per Mr. Doug Johnson). The total cost of this portion of the system is estimated to be $65,065 with the FAA's portion at $38,100. ITEM 4 - GENERAL AVIATION APRON RECONSTRUCTION ($757,950) Removal and replacement of the most deteriorated pavement. The estimated age of this pavement is over 50 years. Also included in this item is rehabilitation of an area of pavement that is estimated at 40 yeazs of age with replacement of isolated shattered panels and some panels to restore grade. - The funding level for this work is 90% FAA funds.
