A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE AN AGREEMENT WITH SVERDRUP CIVIL, INC.
FOR UTILITY RELOCATIONS FOR THE MISSISSIPPI
BRIDGE ROUTE PROJECT
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Manager, for and on behalf of the City of
Cape Girardeau, Missouri, is hereby authorized to execute an
Agreement with Sverdrup Civil, Inc. for professional services for
utility relocations for the Mississippi Bridge Route Project. A
copy of said Agreement is attached to this Resolution and made a
part hereof.

AGREEMENT FOR PROFESSIONAL SERVICES
DESIGN SANI'TARY SEWER RELOCATIONS
HIGHWAY 74 PROJECT
This Agreement is made and entered into this�day o 199�by and between the
City of Cape Girardeau, (Owner), and Sverdrup Civil, Inc. (Sverd ).
ARTICLE 1
SVERDRUP'S SERVICFS
Sverdrup shall provide or fumish to Owner professional services for design of the relocation of
combine� and/or sanitary sewers associated with improvements to Missouri Route 74 in the Ciry
of Cape Girardeau, hereinafter referred to as "Project". These services are identifie� and
described in the Scope of Services (APPENDIX A) attached to and made a part of this
Agreement.
ARTICLE 2
OWNER'S RFSPONSIBILITIFS
A. Owner's Renresentative
Owner shall designate in writing a person to act as Owner's Representative with respect
to the services to be rendered under this Agreement. Such person shall have complete
authority to transmit instructions, receive information, interpret and define Owner's
policies and make decisions with respect to Sverdrup's services for the Project.
B. Information
1. Owner shall provide to Sverdrup in a timely manner information and services
pertinent to the Project including:
a. Provide copies of all special design and construction standards which the
Owner will require to be included in the drawings and specifications.
b. Provide all data and information available to the Owner relevant to the Project
including but not limited to those items listed in Additional Owner Supplie�
Information (APPENDIX B).
c. Apply for any grants loans or funding support required.
d. Arrange for reviews and approvals of regulatory agencies, and pay any
applicable fees of the regulatory agencies for such reviews, with such
assistance from Sverdrup as may be described in Appendix A.

e. Owner agrees to comply with the "Hazard Communication Standard" of the
Occupational Safety and Health Administration.
f. Owner shall furnish to Sverdrup as required for performance of Sverdrup's
services (except to the extent provide�otherwise in the Scope of Work), data
prepared by or services of others, including, without limitation, soil borings,
probings and subsurface explorations, hydrographic surveys, laboratory tests
and inspections of samples, materials and equipment; appropriate professional
interpretation of all the foregoing; boundary, easement, right-of-way,
topographic and utility surveys; property descriptions; zoning, deed and other
land use restriction; and other special data, professional opinions or
consultation; all of which Sverdrup may use and rely upon in performing its
services.
g. Owner shall provide such accounting, independent cost estimating and
insurance counseling services as may be required for the Project, such legal
services as Owner may require or Sverdrup may reasonably request with
regard to legal issues pertaining to the Project including any that may be raised
by Contractor(s), suGh auditing service as Owner may require to ascertain how
or for what purpose any Contractor has used the moneys paid under the
construction contract, and such inspection services as Owner may require
(except to the extent provide� otherwise in the Scope of Work) to ascertain
that Contractor(s) aze complying with any law, rule, regulation, ordinance,
code or order applicable to their fumishing and performing the work. Owner
shall include in all construction contracts a requirement that Sverdrup be
named either as: 1) an indemnitee under Contractor's indemniry obligation,
and 2) an additional insured under Contractor's General Liability Insurance
Policy.
2. Owner shall provide information and services not specifically include�under Article
1 which are necessary to complete the Project, or authorize Sverdrup to finish such
under provisions of Article 5.
C. Access and Approvals
1. Owner shall arrange for access to and make ali provisions for Sverdrup to enter
upon public and private property as required for Sverdrup to perform its services
under this Agreement.
2. Owner shall furnish at its cost approvals and permits from all governmental
authorities having jurisdiction over the Project and such approvals and consents from
others as may be necessary for completion of the Project except as stated in
Append'uc A.
D. Notice
Owner shall give prompt written notice to Sverdrup whenever Owner observes or
otherwise becomes aware of any development that affects the scope or timing of
Sverdrup's services, or any defects or nonconformance in the work of Sverdrup or any
Contractor.

ARTICLE 3
COMPENSATION AND PAYMENT
A. ost
Owner shall compensate Sverdrup for the performance of the services, described in the
Scope of Work under Articie 1, on a cost plus a fixe� fee basis.
The total cost (exclusive of fixed fee) is estimated to be$35,219. The fixed fee shall be
$3,551. The total amount to be paid for design and construction services under this
Agreement shall not excee�538,770, including cost and fixed fee, without approval of the
Owner. Sverdrup shall notify the Owner when costs incuned and obligate�i amount to
95% of the total estimated cost and shall not incur costs beyond the estimated cost without
prior approvai of the Owner. A cost summary is presented in APPENDIX C.
B. Cost Comnutation
Sverdrup's costs shall include the hourly salary of each associate and employee, salary-
related expenses, general overhead, and direct non-salary costs as allowed by Volume 1,
Chapter 7, Section 2 of the Federal Aid Highway Program Manual (FMPM 1-7-2) and
Part 31 of the Federal Acquisition Regulation (FAR 31). Definition of terms to be use�
in computation of payments are as follows:
l. Salary costs are defined as the salaries paid for regular time and overtime (including
any premium overtime)worked, plus provision for applicable annual Salary Related
Expenses, including sick leave, vacation pay, holiday pay, and other ordinary and
customary paid time off, bonuses, the employer's portion of social security,
unemployment, and other payroll taxes, Employee's Retirement and Benefit Plan
contributions, employer's poRion of the group hospitalization and medical insurance
and the cost of worker's compensation insurance. The provisional Salary Related
Expense overhead rate for 1994 is 0.428. At the end of each calendar year, the
actual rate for the year will be applied and adjustment in the compensation made
accordingly. The maximum Salary Related Expense overhead rate that shall be
applie� is 0.43.
2. Salary costs as define� above aze multiplied by a provisional General and
Administrative overhead factor for 1994 of 0.925. Included in the General and
Administrative overhead are:
a. The salaries of officers, except for technical or advisory services directly
applicable to the project.
b. The salaries of employees doing general administrative work; also
nonproductive professional and technical salaries, including maintenance of
staff to provide readiness to serve.
c. Rent and costs of light, heat and water; equipment depreciation and
maintenance cost; costs of o�ce supplies and reproduction of data for our
intemal use; general communications expense, including local telephone calls
and postage; taxes; insurance premiums and license fees; automotive expense

and other transportation and travel expense not chargeabie to specific contracts;
and other miscellaneous costs.
At the end of each calendaz year, the actual General and Administrative
overhead rate for that year will be applied and adjustment of the compensation
made accordingly. The maximum General and Administrative overhead rate
that shall be applied is 0.95.
3. In addition to salary costs, Sverdrup will be reimbursed for Other Reimbursable
costs as follows:
a. Travel, subsistence, and incidental expenses of personnel while traveling in
connection with the work.
b. Transportation by passenger automobiles that Sverdrup supplies intermittenfly
in connection with the work. All costs of owne�, lease�, or rented passenger
vehicles assigned to the work. Reimbursement for the cost of special types of
vehicles when such vehicles are required.
c. Reproduction of drawings, photographs, maps, charts and reports which are
prepared for the Owner's periodic or interim review and also the cost of the
reproductions which constitute the delivery of work.
d. Wire and wireless communication of inessages and data in connection with the
work.
e. Insurance required by the Owner in addition to the coverages or in excess of
the limits normally carried.
f. Subcontracted services such as, but not limited to, borings, surveys,
photogrammetry, testing and computing services, if require� in the
performance of the work.
g. Technical suppoR services providetl from our own facilities, as require�in the
performance of the work.
h. Special consultants, as approve�by the Owner, if required in the performance
of the work.
i. Technical and advisory services of officers directly applicable to the project at
the hourly rate of$125.
4. A fixe� fee will constitute profit for the work described in ARicle 1.
C. Terms of Payment
Progress payments for services rendere� shall be made monthly upon submission of an
invoice for work performed during the previous month. For interim billings,the portion
of the fixe� fee payable shall be equal to the total fixe� fee multiplied by the ratio of
salary costs plus general and administrative overhead plus other reimbursable costs to date
of billing divided by the estimated total cost listed under Article 3A above less the fixed
fee bille� to date. Invoices submitted to the Owner by the 20th of each month will be
included in the Owner's normal payment cycle for payment by the lOth of the following
month.

If there are disputed items and/or amounts on any invoice, the balance of such invoice,
after deducting any disputed items, shall be paid in full, and the disputed items and
amounts shall be presented to Sverdrup for resolution as soon as such dispute� items have
been determined by Owner. Payments due but unpaid more than thirty (30) days after
presentation of the invoice, ezcluding any amounts and items disputed by Owner, shall
bear interest at one percent (196) interest per month (or any lesser legal limit applicable)
until paid.
ARTICLE 4
TIl1� FOR PERFORMANCE
A. Commencement
Sverdrup shall commence the performance of the services for the Project upon the date
of this Agreement and complete the work in accordance with such schedule as may be
mutually agreed to by the parties. A potential Schedule pending timely compilation of
survey and other information, timely review by the Owner and Missouri Highway and
Transportation Department, and no changes in scope is listed in APPENDIX D.
B. Delav
If Sverdrup's services for the Project are delayed for reasons beyond its control, the
compensation provideQ for elsewhere in this Agreement and the time for performance
shall be subjeet to equitable adjustment.
ARTICLE 5
CHANGES IN THE WORK
A. Ch�
Owner reserves the right, without impairing this Agreement, to order changes or
alterations in the work to be performed hereunder by Sverdrup. If changes or alterations
ordered affect the cost or progress of the work, adjustment shall be made in the time for
performance of the work and compensation owing to Sverdrup, as the case may be.
B. ('��cealed Conditions
Should concealed or unknown conditions be encountered in the performance of the work
which present the risk of discharge, dispersal, release or escape of pollutants, asbestos,
any hazardous substance or any hazardous waste, Sverdrup shall promptly suspend its
performance of the Work for the protection of the parties and their employees and notify
Owner of the conditions encountered. Owner and Sverdrup shall prompdy investigate the
conditions and, if warranted, equitable and necessary adjustments shall be made in the
terms and conditions of this Agreement. It is agreed, however, that Article 5 above not
withstanding, Sverdrup shall have no duty to determine the existence of pollutants,
asbestos or any other hazardous substance or hazardous waste at the site of the work or
to provide response action or remedial services.

ARTICLE 6
STANDARD OF CARE
Sverdrup represents that its services shall be performed with the skill and care which would be
ezercised by comparable qualified design professionals performing similar services at the time
and place such services are performed. If the failure to meet these standazds results in
deficiencies in the design, Sverdrup shall, furnish at its own cost and expense, the redesign
necessary to correct such deficiencies. If the failure to meet these standards results in damages
incurrefl by Owner for the repair, or conection of any part of the Project, Sverdrup shall be
liable to Owner for the construction costs associated with such repair or conection except to the
extent that such costs constitute an addition of value to the Project; provided, however, that in
no event shali such damage for which Sverdrup may be liable under this paragraph or otherwise
include any consequential, special, contingent or penal damages.
ARTICLE 7
INDEMIVITY
A. Sverdru�'s DutX
Sverdrup shall indemnify Owner against all claims and suits by third parties for loss of
or damage to property, or personal injury, including death, to persons, and from all
judgments recovered therefor, and from all expenses for defending such claim or suit,
including court costs and attomey's fees, azising out of the negligent acts, enors, or
omissions of Sverdrup in connection with Sverdrup's performance of this Agreement. In
no event shall Sverdrup have any duty to indemnify Owner hereunder against claims
arising as a result of Owner's sole or contributing negligence. In no event shall Sverdrup
be liable under this pazagraph or otherwise for indirect or consequential damages.
B. pwner's Duty
Upon and after final completion of the Project, Owner shall indemnify and hold Sverdrup
harmless from all claims and suits for damages arising from personal injuries, including
death to persons, or to property, and from all judgments recovered therefor, and from all
expenses for defending such claim or suit, including court costs and attomey's fees, which
result from Owner's negligent use, operation or maintenance of the facilities, equipment
or materials designed or provided by Sverdrup under this Agreement.
ARTICLE �
INSURANCE
Without limiting its liability hereunder, Sverdrup shall maintain during the life of this Agreement
the following insurance and fixmish Owner, in duplicate, certificates of insurance as evidence
thereof. Such certificate.s shall provide that cancellation of said insurance shall not be effected
without thirty (30) days prior written notice to Owner. The certificates shall plainly designate
the name of the project for which the certificate is provided.

1. Workers' Compensation Insurance,providing coverage in compliance with the laws
of the state in which any part of the work is to be performed, and Employer's
Liability Coverage in the minimum amount of�100,000 for each occurrence.
2. Commercial General Liability Insurance written on an occunence basis with the
following limits of liability:
General Aggregate $ 4����
Products/Completed Operations Aggregate $ 2����
Personal and Advertising Injury $ 2����
Each Occurrence $ 2,000,000
Fire Damage $ 25�000
Medical Expense $ 1��
3. Automobile Liability Insurance. Bodily injury and property damage combined single
limit - �1 million each occunence, $1 million aggregate.
4. Architect's and Engineer's Professional Liability Insurance. Bodily injury and
property damage combine� single limit - $1 million each claim, $5 million
aggregate.
The Commercial General Liability and Architect's and Engineer's Professional Liability Insurance
shall include Contractual Liability Coverage for the liability assumed by Sverdrup in Article 7
herein. The Owner shall be named as an additional insure� in the Certificate for Commercial
General Liabiliry.
ARTICLE 9
TERMINATION
A. Termination By Owner
1. In the event Sverdrup fails to comply with any provisions of this Agreement, or if
the progress or quality of the work is unsatisfactory, Owner may serve writxen
notice thereof upon Sverdrup, and if Sverdrup neglects within a period of twenry
(20) days thereafter to commence its efforts to conect such failure, Owner may
terminate the Agreement upon written notice to Sverdrup. Upon such termination,
Sverdrup shall cease its performance of this Agreement and shall deliver to Owner
all completed or partially completed satisfactory work and Owner shall pay to
Sverdrup costs incuned to effective date of termination.
2. Owner also reserves the right to terminate this Agreement in the event it shall
abandon or indefinitely postpone the project. Such termination shall be
accomplished by written notice to that effect delivered to Sverdrup. Upon receipt
of such notice, Sverdrup shall imme�iately cease work and deliver to Owner all
completed or partially completed work. Payment to Sverdrup shall be made for
work performed prior to receipt by Sverdrup of such termination notice, together
with Sverdrup's cost for closing down its work, and Sverdrup shall have no claim
for loss of anticipate� profits or any additional compensation.

B. Termination By Sverdrun
In the eveat Owner fails to comply with any provisions of this Agreement, or if it fails
to timely pay compensation due to Sverdrup, Sverdrup may serve written nodce thereof
upon Owner, and if Owner fails within a period of twenty (20) days thereafter to correct
such failure, Sverdrup may terminate this Agreement upon written notice to Owner.
Upon such termination, Sverdrup shall cease its performance of this Agreement and when
paid the amount due for such work, shall deliver to Owner all completeci or partially
completed work for the project.
ARTICLE 10
GENERAL CONSIDERATIONS
A. Use of Documents
All documents including Drawings,Specifications,and CADD discs prepare�or furnished
by Sverdrup pursuant to this Agreement shall become the property of the Owner. Such
materials are not intended or represented to be suitable for reuse by Owner or others on
extensions of the Project or on any other project. Any reuse without written verification
or adaptation by Sverdrup for the specific purpose intended will be at Owner's sole risk
and without liability or legal exposure to Sverdrup, and Owner shall indemnify and hold
harmless Sverdrup from all claims,damages, losses and expenses including attomeys'fees
arising out of or resulting therefrom. Any such verification or adaptation will entitle
Sverdrup to further compensation at rates to be agreed upon by Owner and Sverdrup.
B. Oninions of Cost
Since Sverdrup has no control over the cost of labor, materials, equipment, or services
fumished by others, or over the Contractor(s)' methods of determining prices, or over
competitive bidding or market conditions, Sverdrup's opinions of probable Total Project
Costs and Construction Cost provided for herein are to be made on the basis of
Sverdrup's experience and represent Sverdrup's best judgment as an experienced and
qualifie� professional, familiar with the construction industry; but Sverdrup cannot and
does not guarantee that proposals, bids or actual Total Project or Construction Costs will
not vary from opinions of probable cost prepared by Sverdrup. If, prior to the
construction phase of the Project, Owner wishes greater assurance as to Total Project or
Construction Costs, Owner shall employ an independent cost estimator as provide� in
ARTICLE 2.
C. Controlling Law
This Agreement is to be govemed by the law of the State of Missouri.
D. Successors and Assigns
1. Owner and Sverdrup are each hereby bound and the partners, successors, executors,
administrators and legal representatives of Owner and Sverdrup are hereby bound
to tlie other party to this Agreement and to the partners, successors, executors,

administrators and legal representatives (and said assigns) of such other party, in
respect of all covenants, agreements and obligations of this Agreement.
2. Neither Owner nor Sverdrup shall assign, sublet or transfer any rights under or
interest in this Agreement without the written consent of the other, except to the
extent that any assignment, subletting or transfer is mandated by law or the effect
of this limitation may be restricted by law. Unless specifically stated to the contrary
in any written consent to an assignment, no assignment will release or dischazge the
assignor from any duty or responsibility under this Agreement. Nothing contained
in this paragraph shall prevent Sverdrup from employing such independent
professional associates and consultants as Sverdrup may deem appropriate to assist
in the performance of services hereunder.
3. Nothing under this Agreement shall be construe� to give any rights or benefits in
this Agreement to anyone other than Owner and Sverdrup, and all duties and
responsibilities undertaken pursuant to this Agreement will be for the sole and
exclusive benefit of Owner and Sverdrup and not for the benefit of any other party.
ARTICLE 11
MISSOURI HIGHWAY AND TRANSPORTATION COMMISSION REQUIREMENTS
The following additional clauses are added to meet requirements of the Missouri Highway and
Transportation Commission:
A. Audit Records
For purpose of an audit, Sverdrup shall maintain all tliose records relating to this
Agre�ment, including but not limited to invoices, payrolls, bills, receipts, etc. These
records must be available at all reasonable time to the Owner, Missouri Highway and
Transportation Commission, Federal Highway Administration, and their designees and
representatives, at Sverdrup's offices, at no charge, during the contract period and any
extension thereof, and for the three (3) year period following the date of final payment
made under this Agreement. If the Owner has notice of a potential claim against Sverdrup
and/or the Owner, based on Sverdrup's work under this Agreement, Sverdrup, upon
written request by the Owner shall retain and preserve its records until the Owner has
advised Sverdrup in writing that the dispute� claim is resolved.
B. Pro�� and Eguipment
The property and equipment use� on this project, such as automotive vehicles, inspection
equipment, office equipment, etc., shall be owned, rented, or leased by Sverdrup and
charges will be made to the project for the use of such property at the rate established by
company policies and practices. Approval of the Owner will be required prior to
acquisition of reimbursable special equipment.
C. Nondiscrimination Provision
Sverdrup, with regazd to the work performed by it after award and prior to completion
of the contract work, will not discriminate on the ground of race, color or national origin

in the selection and retention of subcontractors. Sverdrup will comply with Title VI of
the Civil Rights Act of 1964, as amended. More specifically, Sverdrup will comply with
the regulations of the Department of Transportation relative to nondiscrimination in
federally-assisted programs of the Department of Transportation, as contained in
49 CFR 21 through Appendix H and 23 CFR 710.405(b), which are herein incorporated
by reference and made a part of this contract. In all solicitations, either by competitive
bidding or negotiation made by Sverdrup for work to be performed under a subcontract,
including procurements of materials or equipment, each potential subcontractor or supplier
shall be notified of Sverdrup's obligations under this contract and the regulations relative
to nondiscrimination on the ground of color, race or national origin.
D. Contingent Fees
Sverdrup warrants that we have not employe� or retained any company or person, other
than a bona fide employee working for Sverdrup to solicit or secure this contract, and that
we have not paid or agree� to pay any company or person, other than a bona fide
employee, any fee, commission, percentage, brokerage fee, gifts or any other
consideration, contingent upon or resulting from the awazd or marking of this contract.
For breach or violation of this warranty, the City shall have the right to annul this
contract without liability, or, in its discretion to deduct from the contract price or
consideration,or otherwise recover, the full amount of such fee, commission,percentage,
brokerage fee, gift, or contingent fee.
E. Disputes Resolution
If any disputes regarding this agreement cannot be resolved by the parties, the dispute
shall be litigated in any court having jurisdiction.
ARTICLE 12

CITY OF CAPE GIItARDEAU
HIGHWAY 74 5EWER RELOCATION
SCOPE OF WORK
November 1994
The Missouri Highway and Transportation Department is relocating State Highway 74 in
conjunction with the construction of a new Mississippi River bridge at Cape Girardeau.
This project is to provide design services for the relocation on two sewers that have been
identified to interfere with the Highway 74 construction:
- 6 inch and 8 inch sewer running beside Aquamsi and just inside the east side of
the embankment for the relocated highway from approximately Station 182
to 184 (Aquamsi Sewer).
- 24 inch combined sanitary and storm sewer crossing the relocated highway at
Station 175 (24 inch sewer).
Sverdrup will provide the design and geotechnical engineering services for the Project, soil
boring will be subcontracted and the Owner will do any required surveys. The detailed scope
of work is as follows:
1. Visit the site and collect existing information relative to the project from the
Owner.
2. Conduct geotechnical investigations to develop an estimate of the potential for
settlement of the 24 inch pipe when the highway embankment fill is placed. Two
borings will be drilled to an average depth of 40 feet or auger refusal.
Laboratory tests will be performed as appropriate to determine moisture content,
Atterberg limits, gradation, unconf'ined compression and consolidation.
3. Prepare a memorandum type geotechnical report discussing the potential effects
of subsurface material on settlement of the pipeline, trench excavation, temporary
excavation support, backfill and groundwater control.
4. Investigate sewer flow and sizing requirements. It is assumed the 24 inch sewer
will be diverted to surface drainage north of the highway embankment when the
sanitary sewers are segregated in the Sanitary Sewer Improvement Program. The
new 24 inch sewer under the highway right-of-way would then become a sanitary
sewer or serve as a casing for the smaller pipe. The 6 inch seminary sanitary
sewer will tie into an extension of the relocated City sewer. It will be assumed
the 6 inch seminary sanitary sewer is adequately sized. The 8 inch sewer will be
resized if necessary to conform to the Sanitary Sewer Improvement Design.

5. Prepare a brief design memorandum defining the design parameters, sewer sizing
and locations for review and approval by the Owner before the design package
drawings are begun.
6. Meet with the Owner and or the Highway Department to review the design
memorandum.
7. Prepare bid documents, including plans, specifications, contract and instruction
to bidders. Engineer Joint Council Contract Documents typically used by the
Owner will be used. Special or supplementary conditions will be added to
incorporate any modifications or additions required by the Highway Department.
Three sets of bid documents will be provided for review.
8. Review comments on the bid documents with the Owner and or Highway
Department by phone or letter.
9. Incorporate comments and finalize the bid documents. It is anticipated that
comments will require only minor modification. Major changes should be picked
up in the design memorandum review meeting.
10. Assist during the bid process, including coordination with the Owner for
advertisement of bid, responding to technical questions raised during bid,
preparing addenda, evaluating bids and providing recommendations of award to
the Owner. Fifteen sets will be printed for bidding and record by the Owner.
Additional sets will be provided to the Owner at cost as an additional cost.
11. Review shop drawings and other Contractor submissions in response to the
Contract Document requirements, for conformance with the design concept and
the concept of the information given in the drawings and technical specifications.
Sverdrup's review and recommendation shall not extend to means, methods,
sequences, techniques or procedures of construction, or to safety precautions or
programs incident thereto, as such these are the responsibility of the construction
Contractor. Sverdrup's action shall be taken with such reasonable promptness as
to cause no delay in the Work, while allowing sufficient time in Sverdrup's
professional judgement to permit adequate review. Review of such submittals is
not conducted for the purpose of determining the accu�acy and completeness of
other details such as dimensions and quantities or for substantiating instructions
for installation. Sverdrup's approval of a specific item shall not indicate an
approval of an assembly of which the item is a component. When professional
certification of performance characteristics of materials is required of the

contractor by the drawings or technical specifications, Sverdrup shall be entitled
to rely upon such certification. Sverdrup will not be liable for the results of
interpretations or decisions rendered in good faith with the referenced submittals.
12. Owing to the defined scope and small size of this project, change orders are not
anticipated and have not been included in the manhour estimate.

ADDITIONAL OWNER SUPPLIED INFORMATION AND ACTIVITIES

1. Drawings of existing sewers
2. Special or supplementary conditions required by the Highway Department to be
incorporated into the Engineers Joint Council Up Front Documents typically used
by the Owner.
3. Highway Department drawings pertinent to the Project that are available to the
City.
4. Cultural resource survey or any other environmental assessment investigations if
these should be required.
5. Survey for topographic features, significant vegetation, utilities, manhole
elevations and invert elevations as needed for preparation of the construction
documents. Some of the needed information may be available from Highway
Department drawings and survey notes but additional data is required especially
for the 24 inch sewer .
6. Locate property lines, lot lines , new highway right-of-way property owners, and
existing easements in the vicinity of the sewers to be relocated.
7. Any existing geotechnical reports and borings from the vicinity that may provide
information on rock or settlement potential.
8. No easements are anticipated but should these be required, surveys, easement
documents and negotiation of easements will be by the City.
9. Request any permits that may be required.
8. Inspection during the construction phase of the project.
