The City Manager, for and on behalf of the City of Cape Girardeau, Missouri, is hereby authorized to execute Supplement No. 3 to an Interim Liability Agreement dated December 20, 1995, (Contract No. DTFA09-96-A-10204) with the Federal Aviation Administration for the Cape Girardeau Regional Airport Traffic Control Tower. Terms of the Agreement shall not extend beyond July 31, 1996, unless amended by Supplemental Agreement hereto. All other terms and conditions of Contract No. DTFA09-96-A-10204 shall remain the same. This is in response to your letter of December 8, 1995, regarding your request to continue Air Traffic Control (ATC) service and assume ownership of the A.irport Traffic Control Tower (ATCT) facility and its equipment at Municipal Airport, Cape Girardeau, Missouri, effective January 1, 1996. Unfortunately, we cannot complete the transfer w-ithin your requested timeframe. A transition period will be required to complete the final transfer of this facility prior � to April 1, 1996. During this interim period we will continue to provide maintenance on the ATCT electronic equipment until April 1, 1996. This will allow adequate time to complete the transfer of property and maintenance responsibilities. On December 20, we sent a facsimile copy (nek-t-day delivered the original)Letter of Agreement for liability at the ATCT during the interim period until the transfer of property can be completed. Our letter also asked that you provide a copy of your Certificate of Insurance as proof of your acceptance of liability. Advisory Circular(A/C)No. 90-93 provides the necessary guidance for the operation of a non- federal ATCT. Several provisions will need to be addressed for the transfer to take effect on the April 1 deadline. In order to operate a non-federal public use ATCT, the City of Cape Girardeau will be required to provide its own maintenance of the facility after April 1, 1996. Three copies of the Centra] Region approved FAA/Sponsor ATCT Memorandum of Understanding (MOI� and Operations and Maintenance Manual (OMI�� are enclosed for the review and acceptance by the city. The MOU/Oi��1 contains the minimum requirements for non-federal ATCT equipment, maintenance procedures, and intervals. It also explains the requirements that must be met by the sponsor's Electronic i�laintenance Technician. The majority of the ATCT MOU/0��1 is generic in nature, with Appendix 2 containing site specific information. This appendix �;�ill be filled out with the hel p of the s ponsor's assigned E;ectror�c I�laintenance Technician to reflect actual installed facility equipment, and then later inserted into the approved FAA/Sponsor �10U/OA�A1 prior to facility .� n .: � _ 2 transfer. If acceptable, the appropriate city official should sign the front page on all t}iree copies; retain one for your records, provide one for the ATCT maintenance technician, and send one back to the Central Region Airway Facilities Division. . The facility will require ground inspection by FA.A on an annual basis in accordance with FA.A � Order 6700.20A, Non Federal Navigational A.ids and Air Traffic Facilities, paragraph 22d2. We suggest that the City of Cape Girardeau may want to continue the preventive maintenance of the ATCT structure and its equipment on the same schedule being utilized by our technicians. Maintenance task requirement checkoff sheets, handbooks, and instruczion manuals will be provided to the Sponsor to help establish a preventive maintenance schedule for the equipment. The Point of Contact (POC) for establishment of maintenance procedures and technician qualifications on the ATCT will be John Scott,Non-Federal Facilities Program Manager, ACE-471N, at telephone number (816) 474-6214. The City will also need to verify that the requirements for operation of the ATC services are in compliance with the above A/C. Parts 65 of the Federal Aviation Regulations (FAR) requires that the appropriate local ATC official(s) hold Control Tower O a�o need toObe de eloped in Directives on operations and procedures for ttus fac�lity accordance with Section 8 of AlC 90-93. Copies of the CTOs and a listing of directives and procedures need to be filed with the Central Region's A.ir Traffic Division. The POC for fhe ATC functions at Cape Girardeau will be Charles Raymond, ACE-531 A, at (816) 426-2274. During the interim period, the Central Region will work with you to transfer the utilities, technical equipment, real property, and any surplus office equipment to your inventory. An Environmental Due Diligence Audit (EDDA) is required prior to transferring title of the structure to the city. Ms. Sally Chafa will serve as the POC for the transfer of the utilities and property associated with this facility. She will be contacting you to work the issues regarding the transfer of the FA.A owned property and electrical utility contract. It is our goal to work with you to insure that Class D airspace remains in effect, as well as the . services the control tower provides to pilots operating into and out of Cape Girardeau airport.
