A RESOLUTION TERMINATING THE LEASE AND
OPERATIONS AGREEMENT BETWEEN THE CITY OF CAPE
GIRARDEAU, MISSOURI, AND MDI, INC. FOR FIXED
BASE OPERATOR SERVICES AT THE CAPE GIRARDEAU
REGIONAL AIRPORT
WHEREAS, on January 17, 1995, the City Council adopted
Resolution No. 1011, authorizing the City Manager to execute a
Lease and Operations Agreement with MDI, Inc. d/b/a Prestige Air
Services, for a fixed base operation at the Cape Girardeau Regional
Airport; and
WHEREAS, on June 27, 1995, the Lease and Operations Agreement
with formally executed by the parties; and
WHEREAS, Article VII, Section C, Paragraphs (4) and (5) state
that the Lease is subject to termination at the option of Lessor if
the Lessee shall abandon the demised premises or shall discontinue
any of the required commercial aviation operations of an FBO; and
WHEREAS, Lessee has abandoned the demised premises and is not
conducting full FBO operations as outlined in the Lease; and
WHEREAS, no rent has ever been paid under said Lease, nor have
any of the improvements required of Lessee under Article III,
Sections C, been performed during the time therein provided.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Council hereby terminates the Lease and
Operations Agreement dated June 27, 1995, between the City of Cape
Girardeau, Missouri, and MDI, Inc. , d/b/a Prestige Air Services for
an FBO operation at the Cape Girardeau Regional Airport.
ARTICLE 2 . The officers of the City, including the City
Manager and Deputy City Clerk, shall be, and they hereby are,
authorized and directed to execute all documents and take such
actions as they may deem necessary or advisable in order to carry
out and perform the purposes of this Resolution.
ARTICLE 3 . This Resolution shall take effect and be in full
force immediately after its passage by the City Council.
