FOR THE WATER TREATMENT AND DISTRIBUTION SYSTEM PROJECT BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1. The City Manager, for and on behalf of the City of Cape Girardeau, Missouri, is hereby authorized to execute Authorization No. 5B to an agreement dated March 21, 1994, with Burns & McDonnell Engineering Company, Inc. For the potable water treatment and distribution system project. A copy of said Authorization Nol 56 is attached to this Resolution and made a part hereof. SB For PROFESSIONAL ENGINEERING SERVICES To BURNS &McDONNELL ENGINEERING COMPANY, INC. St. Louis, Missouri In accordance with the AGREEMENT For PROFESSIONAL ENGINEERING SERVICES dated March 21, 1994 between the City of Cape Girardeau, Missouri, (hereinafter called OWNER) and Burns & McDonnell Engineering Company, Inc. (hereinafter called ENGINEER),OWNER hereby authorizes ENGINEER to proceed with the following services: I. SCOPE Authorization Nos. 5 and SA authorized compensation for services involved in performing detailed design engineering and preparin�bid documents (drawin�s and specifications)related to the implementation of the recommendations contained in April 1994 Report on Study of Raw Water Supply Reliabilitv Enhancement Methods prepared by ENGINEER for OWNER's application to the Economic Development Administration (EDA) for a grant to improve the reliability of the OWNER's existing Cape Rock Water Treatment Plant ra�v�vater intake system; and/or other related improvements intended to achieve the same purpose (such as the development of an alluvial �vell field to provide an alternate to Mississippi River�vater as the source of supply for the Cape Rock Water Treatment Plant). Specifically,ENGINEER through Authorization Nos. 5, SA, and SB will provide all services as reasonably necessary for the successful prosecution of this project, including consultations, surveying, soil investigations, design, supervision, travel, bid document preparation, schedulin�, occasional site visits during construction, shop dra��in�review, record drawing preparation, contractor payment request review, and incidental costs. All of these services will be oriented toward the �oal of creating a final project in accordance with the intent of the Grant Aareement beriveen the OWNER and EDA. This Authorization No. SB covers engineering services to be provided during construction of the Cape Rock Water Treatment Plant Intake Modifications to enhance the reliability of the Cape Rock Plant. Specific services to be provided under this Authorization No. SB are as set forth in Attachment A to this Authorization. II. TIME OF SERVICE ENGINEER will proceed with providing the services set forth herein immediately upon verbal notice to proceed from OWNER. ENGINEER will complete this third phase of services described herein, in a timely fashion to permit the OWNER to conform with a Project Schedule established by the Contractor in support of the construction contract documents. Engineer's services under this Authorization No. SB will be completed within three(3) months after Contractor completes construction of the facilities. SB control of the ENGINEER(such as regulatory agency actions, force majeure events, etc.). III. COMPENSATION l. OWNER shall compensate ENGINEER for providing the services set forth herein in accordance with the terms of the existing Agreement, based on a cost reimbursable basis with a maximum (ceiling) amount. 2. Total additional payment for the third phase Scope of Services described in this Authorization No. SB shall not exceed the maximum of Forty-two Thousand Three Hundred five Dollars($42,305.00) without prior written approval by OWNER. The attached spreadsheet, which is included for information onl , provides a breakdown of this maximum amount. IV. SPECIAL PROVISIONS 1. OWNER, EDA, the Comptroller General of the U.S., or any of their duly authorized representatives shall have access to all records of ENGINEER directly pertaining to project for the purpose of audit or examination for a period of three (3) years after EDA has made final payment to OWNER. 2. ENGINEER shall submit a report to OWNER, at least quarterly, coverin�the general progress of the job and describing any problems or factors contributin; to delay (if any). Prepare and disti-ibute Conformed Contracts reflecting award of the contract to the successful bidder. 2. Arrange and conduct the preconstruction conference in Cape Girardeau. Prepare and issue minutes of the conference for the OWNER's and Contractor's designated persons. 3. Review compliance submittals submitted by Conri�actor for all major materials and equipment furnished by Contractor. Distribute copies of reviewed submittals with ENGINEER's comments to OWNER's and Contractor's designated persons. 4. Conduct a maximum of seven(7)construction progress meetings in Cape Girardeau. Prepare and issue minutes of each conference to the OWNER's and Contractor's desi�nated persons. 5. Interpret the intent of the drawings and specifications for OWNER and ConU-actor when requested. Assist OWNER on resolving conflicts with Contractor when requested by OWNER. Prepare change orders to the construction contract alon�with ENGINEER's opinion of construction costs when requested by OWNER. 6. Review Contractor's monthly construction payment requests which reflect construction progress and material delivered to the site. 7. Coordinate with OWNER's resident project representative and�vater plant operating staff durin� construction. Coordination will include keeping these persons advised of the status of submittal review, Contractor's schedule, and other items pertaining to overail administration of the construction contract. 8. Occasional visits to the project site by design discipline engineers at a maximum of five(5)strategic times during construction. 9. Assist the OWNER and Contractor in startin�-up and testing the modified intake pumps. 10. Revise the contract drawings to conform to records which the Contractor and OWNER keep of chan�es made durin�construction. Provide four(4)sets of these final drawin�s to the OWNER. 11. Microfilm key project documents after construction is complete and final payment has been made to the Contractor. Drawing originals will be turned over to the OWNER along with one(1)set of CADD disks. ENGINEER will retain microfilm of records and will destroy all originals of project records not otherwise turned over to OWNER. 12. Provide PLC prograinming for interface of operation of intake structure equipment with the water treatment plant. The OWNER will make the Wunderware Development Software,Allen-Bradley pro�ramming software and Allen-Bradley PLCS software available to the ENGINEER's St.Louis Office. ENGINEER's not to exceed compensation is based on start-up activities associated with the PLC equipment not exceeding n�o(2) days.
