A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE A WATER MAIN EXTENSION AGREEMENT WITH
ASHLAND DEVELOPMENT CORPORATION
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, AS FOLLOWS:
ARTICLE 1. The City Manager, for and on behalf of the City of
Cape Girardeau, Missouri, is hereby authorized to execute a Water
Main Extension Agreement with Ashland Development Corporation. A
copy of said Agreement is attached to this Resolution and made a
part hereof.

AGREEMENT FOR WATER MAIN EXTENSION
BETWEEN THE CTTY OF CAPE GIRARDEAU, MISSOURI
AND ASHLAND DEVELOPMENT CORPORATION
THIS AGREEMENT, by and between the City of Cape Girardeau, hereinafter referred
to as "City", and Ashland Development Coporation, hereinafter referred to as "Developer".
WI-�REAS, the City has plans to install a new water distriburion main as part of the
Twin Lakes Main Extension Project, but is unable to bid the entire project for construction at
the present time;
WI�EREAS, the Developer is developing a subdivision that will also be served by a
portion of this project, and desires to extend a water distribution main to the subdivision in a
time that would not hinder the developmen�
NOW THEREFORE, for and in consideration of the mutual covenants and agreements
herein, the parties agree as follows:
1. The City agrees to supply the developer a plan for the extension an 8" water
main to serve the subdivision. This agreement and plan is separate from and does not include
the water distribution system within Ashland Court Subdivision.
2. The Developer agrees to install the main as indicated on the plans in
accordance with the Standard Specifications for Water Distriburion Construction under the
inspection of the City Engineering Division.
3. The parties agree to share the cost of this extension. The City agrees to
reimburse the Developer for the material cost of all pipe, valves, fire hydrants, and fittings
used on the project. The City will reimburse the Developer at a price equivalent to the City's
current annual purchase order for water distribution materials. T'he quantiries for
reimbursement shall be verifietl by the inspection records.
4. The Developer shall be responsible for the cost of installarion of the water
main and all other items incidental to the construction that are not mentioned in Item 3.
5. The City reserves the right to cancel and terminate this Agreement should the
Developer violate any of the terms of this Agreement This Agreement shall be binding upon
the heirs, successors, and assigns of the parties hereto.
