Home My WebLink AboutRES.1375.06-15-1998 I' BILL NO. �8-108 RESOLUTION NO. ! �7 � A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH THE SALVATION ARMY OF CAPE GIRARDEAU FOR EMERGENCY SHELTER GRANT FUNDS FROM THE MISSOURI DEPARTMENT OF SOCIAL SERVICES - DIVISION OF FAMILY SERVICES BE IT RESOLVED BY THE COUNCIL OF THE CITY OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS: ARTICLE 1. The City Manager, for and on behalf of the City of Cape Girardeau, Missouri, is hereby authorized to execute an Agreement with the Salvation Army of Cape Girardeau for Emergency Shelter Grant Funds from the Missouri Department of Social Services - Division of Family Services. Conrad Deputy City Clerk AGREEMENT THIS AGREEMENT, made and entered into this day of , 1998, by and between the City of Cape Girardeau, Missouri, a municipal corporation (hereinafter "City"), and The Salvation Army (hereinafter "Salvation Army"). WITNESSETH: WHEREAS, the City has received Emergency Shelter Grant Funds from the Missouri Department of Social Services - Division of Family Services; and WHEREAS, the Salvation Army has submitted a proposal to provide services to the homeless of Cape Girardeau, which has been approved by the Missouri Department of Social Services - Division of Family Services. NOW THEREFORE, for and in consideration of their mutual covenants and promises hereinafter set forth, the City and Salvation Army agrees as follows: 1 . The Salvation Army will provide the services outlined in its proposal, a copy of which is attached hereto and made a part of this agreement. 2. The Salvation Army wili provide all local cash and in-kind match as outlined in its proposal. 3. Upon presentation of proper documentation by the Saivation Army, the City will reimburse the Salvation Army for all costs, not to exceed Seventeen Thousand One Hundred Dollars (S 1 7,100.00) incurred in providing services as outlines in the Salvation Army proposal. In no event shall the Saivation Army be paid from any City funds other than funds received by tf�e City from the State of Missouri as part of an emergency sheiter-grant. 4. Services provided under this agreement shall be completed no later than July 4, 1 999. 5. The Saivation Army agrees to comply with federal regulations applicable to Emergency Shelter Grant projects, including, but not limited to, , conflict of interest, equal employment opportunity, Section 3, female employment, affirmative action, and lead-based paint prohibition. 6. The Salvation Army agrees to cooperate with City in the City's compliance with all provisions of its Emergency Shelter Grant Agreement with the State of Missouri. 7. In addition to, and not in substitution for, other provisions of this agreement regarding the provision of essential services and/or the payment of operational costs for emergency shelters pursuant to the Emergency Shelter Grant Program, the Salvation Army: a. Represents that it is, or may be deemed to be, a refigious or denominational institution or an organization operated for religious purposes which is supervised or controlled by or in connection with a religious or denominational institution or organization; and b. Agrees that, in connection with such essential services and operational costs: 1 . It wiil not discriminate against any employee or applicant for employment on the basis of religion and will not deny employment or give preference in employment to persons on the basis of religion; 2. It will not discriminate against any persons seeking emergency shelter and related services on the basis of religion and will not limit such services or give preference to persons on the basis of religion; and 3. It will provide no religious instruction or counseling, conduct no religious worship or s'ervices, engage in no religious proselytizing, or exert no other religious influence in the provision of services or the use of facilities or furnishings assisted in any way under this agreement. 2 IN WITNESS WHEREOF, the parties have caused this agreement to be executed by their properly authorized representatives. This award is being made available through the Emergency Shelter Grant Program (ESGP} as authorized by Subtitle B of Title IV of the Stewart B. McKinney Homeless Assistance Act, as amended, and is subject to the streamlined regulations of 24 CFR 576 published in the Federal Rectister October 2, 1996, effective November l, 1996 . It should be noted that ESGP funds may not be obligated or expended for activities or projects that have not been cleared from environmental conditions . Local governments are to assume the environmental responsibilities specified in section 104{g) (1 ) of the Housing and Community Development Act of 1974 . The state will be responsible for providing a release of funds in accordance with the requirements of 24 CFR Part 58_ The contractor may upon written request to the Division, receive a working advance of funds in an amount equal to either 30 days cash need or $5, 000, whichever amount is greater. If this request is made, provide the Division ,with a letter describing the basis for the request and the amount needed in each of the five categories: ESGP Administration, Rehabilitation, Operations, Essential Support Services and Prevention Services. The letter should be signed by the authorized official of county or city. A completed "Recipient Request for Reimbursement and Financial Status Report" form MO 886-2260 (rev. 3/98) should accompany the letter requesting advance. The total amount awarded for your contract is 24 100 . This amount is based upon the budget you submitted for consideration. If you feel that a categorical adjustment/subgrantee allocation of funds needs to be made please so advise prior to your obligation of funds .
