AN ORDINANCE AUTHORIZING THE MAYOR TO
EXECUTE A SPECIAL WARRANTY DEED TO VERNON
RHODES FAMILY PARTNERS LLLP, FOR PROPERTY
ALONG THE RIGHT OF WAY LOCATED AT 2110
SOUTHERN EXPRESSWAY, IN THE CITY OF CAPE
GIRARDEAU, MISSOURI
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF CAPE
GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. The Mayor, for and on behalf of the City of Cape
Girardeau, Missouri, is hereby authorized to execute a Special
Warranty Deed to Vernon Rhodes Family Partners LLLP, for
property along the right of way located at 2110 Southern
Expressway, in the City of Cape Girardeau, Missouri, more
particularly described as follows:
ALL THAT PART OF U.S.P. SURVEY NO. 222 AND PART OF
FRACTIONAL SECTION 12, TOWNSHIP 30 NORTH, RANGE 13 EAST, IN
THE CITY OF CAPE GIRARDEAU, MISSOURI, DESCRIBED AS FOLLOWS:
COMMENCE AT THE SOUTHWEST CORNER OF U.S.P. SURVEY NO. 2199;
THENCE NORTH 06009'13" EAST, 926.69 FEET TO THE
INTERSECTION OF THE NORTH RIGHT-OF-WAY LINE OF SOUTHERN
EXPRESSWAY (FORMERLY KNOWN AS MISSOURI STATE ROUTE 74) WITH
THE WEST LINE OF SURVEY 2199 FOR THE POINT OF BEGINNING;
THENCE SOUTH 12028'34" EAST, 112.45 FEET TO A POINT ON A
LINE 50 FOOT NORTH OF (AS MEASURED PERPENDICULAR THERETO)
TO THE EXISTING CONSTRUCTED CENTERLINE OF SOUTHERN
EXPRESSWAY, FORMERLY KNOWN AS MISSOURI STATE ROUTE NO. 74;
THENCE SOUTH 77031'26" WEST, ALONG A LINE 50 FEET NORTH OF
AND RUNNING PARALLEL TO THE CONSTRUCTED CENTERLINE OF SAID
SOUTHERN EXPRESSWAY, 575.12 FEET; THENCE LEAVING SAID
PARALLEL LINE, SOUTH 80029'54" WEST, 125.64 FEET; THENCE
ALONG AN ARC TO THE RIGHT HAVING A RADIUS OF 495.00 FEET
FOR 172.06 FEET (THE CHORD OF SAID ARC BEARS NORTH
89036'31" WEST 171.20 FEET); TO A POINT ON THE EAST SIDE OF
THE MISSOURI DEPARTMENT OF TRANSPORTATION RIGHT OF WAY,
THENCE NORTH 12041'05" WEST, WITH SAID EAST LINE, 64.65
FEET TO A POINT ON THE NORTH RIGHT-OF-WAY LINE OF SOUTHERN
EXPRESSWAY; THENCE SAID RIGHT-OF-WAY LINE, NORTH 77018'55"
EAST, 867.73 FEET TO THE POINT OF BEGINNING AND CONTAINING
2.55 ACRES, MORE OR LESS.
ARTICLE 2. This ordinance shall be in full force and
effect ten days after its passage and approval.

KNOW ALL MEN BY THESE PRESENTS:
That on this day of , 2023, THE CITY OF CAPE
GIRARDEAU, MISSOURI,a Municipal Corporation organized and existing under the laws of the
State of Missouri, of the County of Cape Girardeau in the State of Missouri, GRANTOR, in
consideration of Ten Dollars ($10.00) and other valuable consideration, to it paid by Vernon Rhodes
Family Partners LLLP , a Missouri Limited Liability Limited Partnership, of the County of Cape
Girardeau, in the State of Missouri, GRANTEE, (mailing address of said first named grantee is: 2075
Corporate Circle, Cape Girardeau, MO 63702 the receipt whereof is hereby acknowledged, and by
virtue and pursuance of an ORDINANCE OF THE CITY COUNCIL OF SAID CITY, does by these
presents, SELL AND CONVEY unto the Grantee, its successors and assigns, the following described
lots, tracts or parcels of land, lying, being and situate in the City and County of Cape Girardeau and State
of Missouri,to-wit:
