ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE
OF ORDINANCES OF THE CITY OF CAPE GIRARDEAU,
MISSOURI, BY CHANGING THE ZONING OF PROPERTY
LOCATED AT 2403 SOUTH SPRIGG STREET, IN THE
CITY AND COUNTY OF CAPE GIRARDEAU, MISSOURI,
FROM M-2 TO AG
WHEREAS, the City Planning and Zoning Commission has
recommended rezoning all of the property described in Article 1
of this ordinance from M-2, Heavy Manufacturing/Industrial
District, to AG, Agricultural District; and
WHEREAS, Public Notice of such change was given as
prescribed in Chapter 30 of the Code of Ordinances of the City
of Cape Girardeau, Missouri, and a public hearing was held on
Monday, March 6, 2023; and
WHEREAS, the City Council of the City of Cape Girardeau,
Missouri, has elected to rezone the property described in
Article 1 of this ordinance from M-2, Heavy
Manufacturing/Industrial District, to AG, Agricultural District.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
OF CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
ARTICLE 1. Chapter 30 of the Code of Ordinances of the
City of Cape Girardeau, Missouri, is hereby amended to change
the zoning from the present M-2, Heavy Manufacturing/ Industrial
District, to AG, Agricultural District, for the following
described property:
2403 South Sprigg Street Legal Description
That part of the South One Half of the East Half of Outlet No.
62 in U.S. Survey No. 2199, described as follows: Begin at the
southeast corner of Outlet 62 and run North 820 West 10.79
chains; thence North 80 East 22.31 chains; thence South 80-;?
East 10.75 chains to a stone corner on the line of Outlots 62
and 63; thence South 80 West 22.31 chains to the place of
beginning.
Also that part of Outlet No. 63 in U.S. Survey No. 2199,
described as follows: Begin at a point 20 feet North of the
south boundary of Outlot 63 on the west boundary line of the Old
Scott County -Cape Girardeau Macadamized Road and run North 184x0
East 7.50 chains; thence North 2742° East 13.66 chains to a
corner on the west side of said road thence North 80-1,i2° West
31.38 chains to a corner, thence South 7-3/40 West 21.50
chains to a corner 20 feet North of the south boundary of
Outlot No. 63; thence South 830 East 25.19 chains parallel with
the south boundary line of Outlet 63 to the place of beginning.
ARTICLE 2. The City Council hereby finds and declares that
the property described in Article 1 of this ordinance is at the
present time particularly suitable for the purposes and uses of
the AG, Agricultural District, and that such changes authorized
hereby are reasonable and in reasonable conformity with the
existing uses and value of the immediately surrounding
properties.
ARTICLE 3. This ordinance shall be in full force and
effect ten days after its passage and approval.
