Resolution No. 336, adopted by the City Council on June 6, 1988, is hereby repealed in its entirety. SECTION 2. The City Council of the City of Cape Girardeau, Missouri, hereby adopts a new City'CQuncil Policy Regarding Paid Fire Protection Outside City Limits. ..A copy of said Policy is attached to this Resolution and made a part hereof. Conrad Deputy City Clerk CITY OF CAPE GIl2ARDEAU Office of the City Manager Council Letter No. 88 Agenda April 4, 1994 The Honorable Mayor and Members of the City Council City of Cape Girardeau, Missouri Dear Mayor and Council Members Subject: City Council Policy - Paid Fire Protection Outside City Limits On June 6, 1988, the City Council adopted, by Resolution No. 336, a policy regarding paid fire protection outside city limits. A copy of that Resolution is attached for your information. In reviewing this policy, it is the Fire Chief's opinion that the policy needs revision so as to be more in line with current developments in the Cape Girardeau County region. A memorandum from Fire Chief Bob Ridgeway is attached which highlights the proposed changes in the policy. It is recommended that the City Council approve the attached Resolution adopting a new policy regarding paid fire protection outside city limits. Respectfully submitted, J. Ridgeway, Fire Chief Date: March 23, 1994 '' ~ R e : Council Policy Regarding Outside Fire Protection Per your request, I have completed a review of the policy adopted by City Council in June, 1988 regarding paid fire protection outside City limits. To summarize, I believe the policy needs significant revision so as to be more in line with current developments in the Cape Girardeau County region. In this regard, I have prepared an updated proposed policy which is attached for your review. Highlights of the revised policy include the following: 1. Paid outside fire protection contracts should �zenerallv_be limited to the Nash Road area and/or other areas that lack available fire protection. Since the existing policy was developed in 1988, paid fire protection districts have developed and currently protect all of the immediate areas around the City with the sole exception of the Nash Road industrial area. To continue to provide contract fire protection service to individuals and businesses outside of the City that lawfully reside in fire protection districts may create legal entanglements. 2. The system for levying fines aaainst businesses _ where automatic fire alarm systems transmit more than four (4) accidental alarms Der vear should be eliminated. This fine -levying system is not currently used for businesses within the City, and (thus) should not be used outside of the City. In its place, it is proposed that business and residences that contract for our services meet City codes and ordinances, and that all new and additional equipment be installed in accordance with same. 3. Statewide and regional mutual aid systems are recognized as viable means of providing assistance to areas outside of the City limits. Under provisions of the State of Missouri, regional and Cape Girardeau County mutual aid agreements, any and all fire departments agree to provide assistance to their neighbors in time of need. Given the provisions of these agreements (which could be implemented automatically), much less bureaucratic `red tape' stands in the way of receiving mutual aid assistance than was the case in 1988. CITY COUNCIL POLICY REGARDING PAID FIRE PROTECTION OUTSIDE CITY LIMITS It shall be the policy of the City Council of the City of Cape Girardeau, Missouri, to upgrade the City Fire Department at all times so as to provide all '-citizens and property owners with adequate fire protection. Efforts shall be made to obtain modern fire fighting equipment and additional vehicles; to establish where necessary new stations; to bring about the creation of adequate water lines and hydrants for those areas not presently equipped with such facilities; and to follow insofar as may be possible the recommendations of the insurance services office. It shall also be the policy of the Council -to furnish fire protection to the Nash Road area (Greater Cape Girardeau Industrial Park). Other areas may be considered on a case- by-case basis, provided the following conditions exist: 1. That the requesting business or area is not located in a municipality providing fire protection services. 2. That the requesting business or area is not located in a fire protection district. 3. That the requesting business or area is located within a 5 mile radius of the city limits. A. All businesses, firms and residences located outside the city limits who desire protection shall on or before July 1 st of each year request fire protection for their land or improvements thereon which may be located in the area. Such request shall be made to the Chief of the Fire Department and after inspection and approval of his property, the applicant shall tender to the City Clerk the amount of Five Hundred Dollars ($500) per year paid in advance on a yearly basis to coincide with the fiscal year (July 1st to June 30th). Such payment shall be for the fire protection requested and a receipt thereof shall be given by the Clerk. When the proper procedure as outlined herein for requesting for protection in the above.area has been followed, the Clerk shall transmit at once to the Chief of the Fire`bepartment the name of the applicant and location of his property and fire protection shall be afforded in accordance with these conditions. The Fire Chief shall insure that a current list of all such properties is maintained by the Emergency Communications Division. B. Businesses, firms and residences shall comply with the maintenance of all existing fire suppression and alarm equipment. All new and additional -equipment required will be installed and maintained under existing city codes. OUTSIDE FIRE PROTECTION PAGE 2 C. Such applicants who have followed the procedures as noted in the preceding paragraph and who have been approved by the City Clerk shall report a fire on their premises in the same manner as if a resident of -the City, of. Cape Girardeau. When such applicant sends in a call for fire protection, the Chief or Acting Chief of the Fire Department shall have full discretion as to the method of furnishing the protection. He shall have the right to recall equipment and personnel answering a call outside the city limits in the event of a serious fire emergency within the city limits at the same time if in his judgement existing equipment and personnel are not adequate to furnish reasonable protection within the city limits. In the event of co -existing fires within and without the city limits, the Chief or person in charge of.the Fire Department shall have sole authority as to dispatching of equipment and -personnel in answering the fire calls. Assuming facilities are available for in limits protection, all calls outside the limits shall be answered with reasonable dispatch and maximum protection afforded those who have qualified in accordance with this policy. D. Although fire protection shall be afforded the areas outside the city limits, the primary duty of the Cape Girardeau Fire Department shall be to furnish fire protection for Cape Girardeau residents and property owners. E. No person or Land owners living outside the limits of the City of Cape. Girardeau shall be entitled to the benefits of this policy unless they have complied in all respects with the conditions as set out herein or unless they receive fire protection under the provisions of reciprocal mutual aid assistance agreements between area and region fire departments. Efforts shall be made to obtain modern fire fighting equipment and additional vehicles; to establish where necessary new stations; to bri.ng about the creation of adequate water lines and hydrants for those areas not presently equipped with such facilities; and to follow insofar as may be possible the recommendations of the insurance services office. It shall also be the policy of the Council to furnish fire protection to the Nash Road area (Greater Cape Girardeau Industrial Park) and, other areas outside the city limits of Cape. Girardeau, but within a five (5) mile radius thereof. Such protection shall be subject to the following conditions: A. All businesses, firms and residences located outside the city limits who desire protection shall on or before July lst of each year request fire protection for their land or improvements thereon which may be located in the area. Such request shall be made to the Chief of the Fire Department and after inspection and approval of his property, the applicant shall tender to the City Clerk the amount of Five Hundred Dollars ($500.00) per year not pro -rated, paid in advance on a yearly basis to coincide with the fiscal year (July 1st to June 30th). Such payment shall be for the fire protection requested and a receipt thereof shall be given by the Clerk. When the proper procedure as outlined herein for requesting fire protection in the above area has been followed, the Clerk shall transmit at once to the Chief of the Fire Department the name of the applicant and location of his property and fire protection shall be afforded in accordance with these conditions. B. A service charge shall be charged to those businesses, firms and residences with fire alarm systems monitored by the City or any third party after the fourth (4th) false alarm to their business, firm or residence. This charge shall be set at Two Hundred Fifty Dollars (250.00) per alarm until the fiscal year is over. . A false alarm shall be defined as any alarm set off by a system malfunction, dusty or dirty smoke detectors, workers or cigarette, cigar and pipe smoke setting off the fire alarm where no flames or smoke from an actual fire set off the fire alarm. (Not to include alarms set. by lightning, power outages and conditions which property owners can not control). The failure to pay the service charge fee can be just cause for not having this policy renewed. C. Such applicants who have followed the procedures in the preceding paragraphs and who have been approved by the City Clerk shall report a fire on their premises in the same manner as if a resident of the City of Cape Girardeau. He shall not dispatch any equipment or personnel outside the city limits which in his discretion would jeopardize the safety of the inhabitants of the City of Cape Girardeau and their property.
