Enclosed is the most complete copy of the Agreement between the County and the
City regarding the Common Pleas Courthouse. Please note that Judge Sander's
signature was whited out on the original and the signature of Paul Stehr was not
notarized. I have also enclosed copies of other papers from our files regarding this
property.

RESOLUTION PROVIDING FOR THE. CONVEYANCE, 014'
A ONE -HALE. INTEREST,, IN:,,.THAT-,,PART,,"OF-COURT
HOUSE PARK IN THE CITY OF CAPE GIRARDEAUJ
MISSOURI, UPON WHICH IS LOCATED THE COMMON
PLEAS COURTHOUSE AND CITY HALL, AND AN AREA
ADJACENT THERETO, FROM THE CITY OF CAPE
GIRARDEAU, MISSOURI, TO THE COUNTY OF CAPE
GIRARDEAU, MISSOURI, AND PROVIDING FOR THE
MAINTENANCE, REPAIR AND UPKEEP THEREOF, AND
PROVIDING FOR, THE CONSTRUCTION OF AN
ADDITION TO THE COMMON PLEAS COURTHOUSE.
WHEREAS, the City of Cape.Girardeau, Missouri, a
City of the Third Class, hereinafter sometimes called "City",
is the feesimple owner of Courthouse Park in said City,
upon which is located a building known as the Common Pleas
Courthouse and City Hall; and
WHEREAS, the County of Cape Girardeau, Missouri, a
County of the Third Class, hereinafter sometimes called
"County", is required by the Statutes of the State of Missouri
to furnish and maintain a place for holding the sessions of
the Cape Girardeau Court of Common Pleas; and
WHEREAS, for many years said Common Pleas Courthouse
and City Hall have been ,jointly used by said City and said
County as and for a City Hall and Common Pleas Courthouse; and
WHEREAS, said Common Pleas Courthouse as it presently
exists is in a state of disrepair and does not contain
adequate room to provide for all the necessary functions of
the City and the County; and

WHEREAS, the City and County desire to construct
for their joint use an addition to said Common Pleas
Courthouse; and
WHEREAS, after the construction of said addition,
said City and County desire to continue their joint
occupancy of said Common Pleas Courthouse and to each pay
one-half of -the cost of operating, maintaining and repairing
said building; and
WHEREAS, said County is prohibited by law from
expending money for capital improvements upon property
not owned by the County; and
WHEREAS, the City desires to convey, and the
County desires to accept the conveyance of a.>one-half
interest in and to that part of Courthouse Park upon which
is located said Common Pleas Courthouse, and an area 30 feet
by 30 feet immediately adjacent to and west of the west
wing thereof upon which said new addition will be con-
structed, to said County, in order that the City and County
will each own an undivided one-half interest in and to said
Common Pleas Courthouse, NOW THEREFORE
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
CAPE GIRARDEAU, MISSOURI, AS FOLLOWS:
1. The Mayor of the City of Cape Girardeau, Missouri,
is hereby authorized to execute and deliver to the County
Court of the County of Cape Girardeau, Missouri, a quit claim
deed. conveying an undivided one-half interest in and to that

part of Courthouse Park in said City upon which is located
said Common Pleas Courthouse, and an area 30 feet by 30
feet immediately west of and adjacent to the west wing
thereof to the County of Cape Girardeau, Missouri, upon the
delivery contemporaneously therewith by the County of Cape
Girardeau to the City of Cape Girardeau of an agreement as
hereinafter set out.
2. Upon the execution and delivery of the deed
mentioned in Paragraph 1 hereof, the -Mayor is hereby
authorized to execute and deliver to the County Court of
the County of Cape Girardeau, Missouri, an agreement by and
between the City of Cape Girardeau and the County of Cape
Girardeau, by the terms of which said City and County shall
agree to participate in equal amounts in the cost of cone
structing an addition to the said Common Pleas Courthouse,
and providing for the joint maintenance, operation and
upkeep of said Common Pleas Courthouse by the City and
County,,which said agreement shall be executed by the
presiding Judge of the County Court of the County of Cape
Girardeau pursuant to a resolution substantially similar
to this resolution.
