TAIL, STREETS KITUVT15, AS THE PTE aI i PC;STOFFICE SITE. dihereas, the United States Government is proposing to build in the City of Cape Girardeau a new Postoffice and Federal building. and =Fhereas, the United States Government has issued an invitation foz- offers of property for said postoffice building to the property owners of Cape Girardeau, Missouri and `hereas, said invitation for offers advises that the United States Government will entertain a proposal for the exchange of property and r�ereas, the City Council by reason of Section 7210 and 7211 3evised Statutes of 4issouri 1929 has authority to sell or dispose of the property known as the Public Square or Commons. NOW, TSE -:moi GRZ, HE IT, -RESCLIE'D 3' T -1HE COM CIL OF TF' CITY OF CAFE, GIRAPMAIJ AS FOLLUNS: That the Yayor is hereby authorized to execute an offer to the United States Government, offering to said Government all that part of the public square or commons known as the Court House Square or Park in the City of Cape Girardeau, I:;issouri described as follows; Begin at a point on the east line of Lorinlier Street said point being five (5) feet south of the center line of Themis Street produced; thence east parallel to 3roadway One Hundred (100) feet; thence south parallel to Lorimier Street One Hundred and Ten (110) feet; thence east parallel to Broadway one Hundred and Fifty (150) feet; thence north parallel to Lorimier 375.6 feet to the north line of Court House Square; thence west alon- the north line -,f Court I- oase Square Two '-Hundred and Fifty ( 250 ) fee t:.: to.. the east line of Lorimier Street thence south along the east line of Lorimier Street 256.6 feet to the point of beginning,, or such other property within said public square or commons as the said Government may desire in exchange for the property now owned by the United States Government located at the Southeast corner of Broadway and Fountain Streets, and 'renown as the present Postoffice and Federal Building site. That the intent and purpose of this resolution is to authorize the mayor and he is hereby given the authority to negotiate and execute any contract, instruments or conveyances with the United States Government conveying to'said government such part of the public square or commons that said gmvernment may desire for the erection of a new Eostoffice and Federal Court building in the City of Cape Girardeau. The considerations for said negotiations, instruments or conveyances to be the. deeding by the United States Government to the City of Cape Girardeau the property now owned by said government at the Southeast corner of the intersection of Broadway and Fountain Streets and known as the present Postoffice and Federal Court property. Government, to -wit: All that part of the public square or co=ons known as Court 'douse Park in the City of Cape Girardeau., Missouri, descried as follows: Begin at a point on the east line of Lorimier Street, said point being five (5 ) feet south of the center line of Themis Street produced* thence east parallel to Broadway Street one hundred (146) feet; thence south parallel to Lorimiiewr Street one hundred ten (110) feet= thence east parallel to Broadway Street one hundred fifty (150 ) feet} thence north parallel to Lorimier :street three .hundred seventy-five and sig -tenths (575,6) feet to the north line of Court House Square; thence vest along; the north line of Coram house Square two hundred fifty (250) .feet to the east line of Lorimier Street; thence south along the east line of Lorimier :street two hundred sixty -fire and six -tenths ( 265.6) feet to the point of beginning, as shoe by the attached plat on which is indicated the correct width of public streets and alleys abutting the site, together with all the improvements thereof. The foregoing proposal is submitted in accordance with and subject to the terms and conditions of the invitation or advertisement appearing in the Local newspapers. It may, become apparent that public opinion in the City of Cape Girardeau would dis- approve of said exchange and in view- of such a contuingency the Ci ty reserves the right to withdratc this proposal at any time prior to the execution of emy contract to eXchan€ e. There are no liens of any character upon said property. it is imPostible to give the assessed valuation of said property, since, being av-vned by a Muricipal Corporation., no assessment has ever been placed on it. The intent and purpose of this proposal is to offer to the United 13tates Government all or any part of the land described here- in and as platted on the attached plat. Should the United Mates Goverment desire an area less thaw that platted, the City -rill ex- pect to receive all of the property now ouned by the Gover=ent at the Southeast cornor of the intersection of." Broadv-:ay and Fountain Streets and hereinabove derscribed, in exchange for all or any part of the land hereby offered to the g�over=ent . 2. Due to the financial condition of the City of Gape Girardeau and the fact that" a part of the Public Square or Cons is beim offer- ed to the Gover=ent, the City cannot ob;.igate itself in any tray to re- move buildings Located on the proposed site. Furthermore, no buildings located within the Matted area are reserved by the City, and title to and all bui.ldinss located on property accepted by the united States Gov- er=ent within said platted area shall Fest in said Gmrernmen - i ediately upon the execution of proper conveyances. 9. There being no buildings on said area reserved by the City: this condition will not be applicable 1.4. Condition No. 10 is satisfactory to the City of Cape Girardeau ll. The Citi* of Cape Girardeau agrees that no variation or de-Darture fron the terms of the contract which may be entered into between the City of Cape Girardeau and the united States Government will be binding on the United States Government unless previously agreed upon in vrri tin:; by the Federal Viorka Agency .
