AN ORDTNANCE AUTHORIZING THE CONS�'RUCTION, MAINTENANCE
AND OPERATION OF A CROSSING OVER SPIIR TRACK N0. 8 OF THE ST.
LOUIS-SAPt FRANCISCO RAILWAY COMPANY ON AQUAMSI STREET AT A
POTNT 200.w�J FE�T NORTH OF THE SOUTHEAST CORNER OF LOT 6,
RANGE G, ON THE NORTH LIIdE OF AQUAMSI STREET.
WHEREAS, F. F. Braun and Delia L. Braun, his kife, of
the City of Cape Girardeau, Missouri, are the owners of Lots
2, 3, �4, 5, g, 9, 10 and 11 of Range G, and the north 25.115
feet of Lot 9, ftange G, in the City of Cape Girardeau,
Missouri; and
WHEREAS, James W. Wilson and Glenda E. Wilson, his
wife, sre the o�rners of the south 5o feet of Lot 9, ftange G,
in the City of Cape Girardeau, Missouri,; and
WI�EREAS, it is the desire af the s�.id F. F. Braun
and Delia L. Braun, his wife, that Lots 2, 3, 4, ��� 5 of
Range G in the Gity of Cape Girardeau, I�issouri, fronting on
�quamsi Street, be made available for industrial and
warehousing purposes; and `
WHEREAS, it is the desire of James W. Wilson and
Glenda E. Wilson� his wife, that they have ingresa from
Aquamsi Street west to their property in Lot 9, Range G, in
the City of Cape Girardeau� Missouri; and
WHEREAS, it is necessary and proper that the present
and future owners of Lots 2, 3, 4, 5,; �� 9, 10 and 11 of
Range G in the City of Cape Girardeau, I�issouri have ingress into
their property frorn 6quamsi Street; and
WHEREAS, there is presently existing on Aquamsi
Street Spur Traek Pdo. 8 of the St. Louis-San Francisco Railwag
Company, extending from the main track of the St. Louis-San
Francisco fta.ilway Company in a north�resterly direction from

a.n extension of Good Hope Street to the northeast corner of
Lot 1 in Range G; and
WHEREAS, ir� order to provide ingress from Aquamsi
Street into Lots No. 2, 3, 4, 5, g, and 9 of Aange G in
the Gity of Cape Girardeau, Missouri, it will be necessary
that a crossing be constructed over Spur Track No. 8 of the
St. Louis-San Francisco Railway Company.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
�F THE CITY OF CAPE GIRARDEAU, �IISSOURI, AS FOLLOWS:
Section 1. That authority is hereby given for the
construction, maintenance and operation of a crossing over
the track of the St. Louis-San Francisco Rail�ay Company on
the west side of Aquamsi Street at a point 200.�.0 feet north
of the southeast corner of Lot 6, Range G, in the City of
Cape Girardeau, Missouri, on the west line of Aquamsi
Street for an entryway from Aquamsi Street to Lots 2, 3, 4,
5, g, 9, IO and 11, Range G, in the City of Cape Girardeau,
Missouri.
Section 2, That the said crossing shall be eonstructed,
maintained and operated without cost to the City of Cape
Girardeau, Missouri.
Section 3. That the said F. F. Braun and Delia L.
Braun, James W. Wilson and Glenda E. Wilson, and their
agents, employees or assigns, or any other person or
corporation using said crossing shall exercise reasonable
precaution in using said crossing and hold harmless the City
of Cape Girardeau, Missouri for any loss, damage or
injuries to any person or property.
Section 4. This ordinance shall take effect and be
in force from and after its passage and approval. ,
