B� IT ORDAIN�,D BY T�iE CITY COUNCIL OF THE CITY OF CAPL GIi�RDF,AU,
STATE OF N�SSOURI, AS FOLI4�TS:
S;�TION 1. That Comnission Form Ord.inance No. 320, passed and approved
by the City Council of the City of Cape Girardeau, Missouri, on A7a.rch
16, 1925, be amended in the following respects, and adding the fol]..owi.ng
para�raphs to said ordinance:
S�TIORT 11. :�ny person� firm, corporation or partnership desiring
to engage in the busines� of tree trimrc�ing sha11 obtain a permit
from the City Clerk of said �ity of Cape Gir�.rdeau, A�issouri.
Said perc�it shall be in forca �;nd efl'ect for a period of one (1)
year and shall be issued by said City Clerk upon the written
application of any person, .firra, corporation or partnership,
provided that the sais� applicant shall file with the City Clerk
at the time of makin� said application an indemnity bond in the
s�un of �2,OOO.rJO approved ba* the May�or. The conditions of said
bond are that it w-�11 protect the city against any da<<a,ge caused
by him or them or their agents, serQants or employees, and that
said principal will save and hold harmless the City from aZl
damages to all persons or t�roperty resulting from or in any way
growin� out ofdamages or injuries to all persons or property by
limbs, branches, treej�s, or toold falling in the streets, sidewal�cs,
alleyways� public hi�hways, ctarbs or any other public property, or
for anz� other injury to any person or property b� reason of said
tree cutting or trimmina which may render the said city liable for
damages. The said bond shall be renewed annuall.y.
S�C;TION 12. Any persan, fir�a, corporation or parthership which
shall trim trees in sa.id City shall notify the Street Co�.issioner
before �xx cutting or trinuai.no any tr.ees in said City and the said
5treet Co�unissianer may adopt rules and regul.ations for the cutting
or trimmi.ng of trees.
Sh;CTION 13. Any person, firra, corporation or partnership which
shall trirn or cut trees in sai.d �ity shall remove all limbs, trees,
branches, leaves ancl twi�s from the streets, public hi;hway, alleys,
sidewalks and czarbs each evening after cornpleting each days work and
must be renyoved at the latest by 7:30 P.M.
S�CTION L�. Any person violiating the provisions of this ordinance
shall upon conviction be fined in ar�y sum not exceedi.n� �l0.rJ0 in
adciition to the charge mentioned.
SiCTION 2. tin emergency existing within said Citv by virtue of said danger
to the public using streets and sidewalks where said trees are being
trinuned and cut, this ordinance shall be in full force and effec� fro�n and
after its passage.
SF,CTION 3. Any ordinance or parts of ordinances in conflict with this
is hereby repealed.
